In response to Mrs*** complaint, Blakeley Building Inspections took care of all necessary accommodations and claims for the ***They demanded that we pay for two more nights stay after the contractor said that they could move back inI said noThe insurance company has also denied their
claimThey demanded that all their towels and mats that got wet (with clean water) be replacedThey were not damaged and only needed to be laundered and driedThe insurance company also denied their claimThe *** have been very difficult to deal with and have been rude to Ness construction, the insurance agent, and everyone who refused to give in to their outrageous demands I do not know why one would want to stay in a hotel when they could stay in their own home, sleep in their own bed, and eat in their own kitchenThe fact that the vinyl in the bathroom was not down yet, (waiting on the flooring contractor)(and they have another full bathroom with no damage) and the base boards still needed to be installed and the touch up paint completed did not make the home dangerousNess informed me that they could move back in and they refusedThe mother that was living with them did not show up until the last two days they stayed in the hotel on their own dimeThe sale of their home was never in jeopardy and it was restored to better than it was before the accidentIn addition, we had the contractor on site the same afternoon the accident happenedJohn B***, Owner of Blakeley Building Inspections

Dr*** was informed at the time of inspection that our (Blakeley Building Inspections) contract states that our liability is limited to the price of the inspectionAt first she refused a refund of her monies but after researching her options she contacted us and said she would accept a full
refund which was mailed the day she made the requestDr*** fails to understand that it was my job to protect her from unscrupulous contractors who wanted to sell their services and productsShe choose to accept their opinions over that of her home inspectorHer money was refunded nearly a year ago and this complaint is nothing more than a way of trying to discredit our companyThe arched window she refers to needed the lock adjusted at the time of inspection but was not warped or damaged in any way, until her brother-in-law whom she states is a professional window glazer worked on itThe cover photo of her report shows that window in it's undamaged condition

I am rejecting this response because:I was somewhat delayed in filing my complaint b/c I misplaced my inspection book (needed complaint to be based on dates/exact info) and I was getting window bids. I was not presented an inspection contract until the inspection was done. The inspector pointed out anything I disagreed with (he underlined it in the document) needed to be brought to their attention within 14 days. The small print regarding entitled only to inspection fee was not mentioned or underlined. My mother was there and can vouch. After the inspector met with the owner, it was then I was informed they would only refund my fee. Initially I turned this down because this was not a fair trade considering all issues missed, including a window he admitted to missing and indicated maybe they would consider replacing. I later accepted the inspection fee b/c by then they mailed the document highlighting that was all they were going to do. There is no mention of damage or need to adjust the window lock in the inspection. In fact, there is no way to adjust the lock due to severe warping. My BROTHER who has been a professional glazier for 33 yrs had to PERMANENTLY lock it for my safety by manipulating the horizontal frame. The frame would bow back out of position if I unlock. Window is completely inoperable. Replacement is the only option. I determined the window was not locked when the heat exchanger had to be replaced and fumes filled the house requiring windows to be opened. When trying to close the window, my brother-in-law determined the arched window would not lock. I never stated my brother-in-law was a glazier as that is not true and he NEVER worked on the window. The only picture of this window is included in the picture of entire front of home where warping is not visible. My goal is not to discredit. But I wouldn’t recommend. My goal is to have at least my arched window replaced, one of many things missed, and hope no other person has their dream of buying a house ruined.

I do not accept the company's response. However, I wish to move on with my life and to have this matter be closed. I am trying to make the best of a bad situation and for almost a year I have been in problem-solving mode and working extra hours at my job to be able to afford to fix the things this inspector missed. I need to keep focusing on that productive direction.

We stand by our initial response. We will not replace her window. It has been more than a year since the initial inspection.
