We did contact this customer immediately and address the issue as soon as humanly possiblyShe called after office hours in the evening and the first thing the next morning the issue was being addressedWe were at her home by 10am the next day. On a daily basis we provide
house clearance for people whose neighbors trees are interfering or touching their propertyIn a perfect world these neighbors would offer to do it & chose a tree company of their preferenceWhen this doesn't happen we are called in to take care on it for the homeowner who doesn't actually own the tree. This is where is can get stickyThe law states we can take those branches back to the property lineThe state of Kansas wants you to have access to your neighbors trees to take care of your propertyUnfortunately the property line that ascends straight up to space doesn't normally land on the best part of that branch or limbWe then have of choicesWe can stub cut that branch at the line which will usually will result in the death of that limb or branchOR We can take it back to a proper lateral or in some cases the trunk because it is a proper arborist cut and the best thing for the treeWe are thanked by people constantly for opting to make cuts that are best for the tree. I had the opportunity to see the tree in question and feel the cuts we made were best for the tree(Especially when you consider the fact that a few of these very small in diameter branches were dead to begin with.) In no way shape or form did the removal of these branches compromise the health of this treeIn fact I have taken pictures of old stub cuts on the opposite side of the same treeIn other words cuts made by their arborists years prior that are not good cuts for the tree. We offered to do some things for the owner of this tree to "keep the peace" but it became very obvious to all of us that this was an attempt at taking advantage of a situation for financial gainThe whole thing has felt like extortion from the beginning. I am rejecting this response because:Eden’s Tree Service’s account of the incident is not an accurate one. They did come out at 10:A.Mthe next morning. The person representing their company did agree that they had trimmed past the property line. He offered to trim my tree which our arborist had done the year before. Eden’s tree service then offered a free EAB treatment which my tree had already had earlier that year. We have an arborist, *** *** with *** *** *** and if we need something done we contact him. The representative from Eden’s Tree Service stated that is all they would do to compensate for the difficulty they had caused and if we did not like it we could talk with their attorney. The first inaccuracy in their report of the situation is that we would not have taken care of trimming our tree. I told my neighbor that we would trim the tree as soon as the weather cooled down. She did not communicate that to her partner who hired Eden’s Tree Service. The second inaccuracy in their report that the tree was trimmed properly and just a few limbs were cut. We have before and after pictures that we will attach that will show that this is not the truthHe cut branches and limbs in all. He did not cut the branches correctly as the picture will show. One of the places that was cut looked like it was torn off the tree. MrC*** did not come out to see my tree at the time of my complaint so his account of seeing my tree is either not correct or a statement that he trespassed on my property again. The law is that a tree is not to be cut past the property line without the home owner’s permission which they clearly violated. To say that it was in the best interest of the tree is a joke. The tree looks misshapen now If he had followed his own invoice instructions he would not have even come close to the property line, let alone cross it and make cuts on our side. When his company met with our neighbors to set up the work, that was the time to explain what they would do. Obviously they didn’t follow what they were contracted to doHe also left branches that were over the fence and others were taken that were not extending into my neighbor’s yard. My arborist saw the tree after the damage Eden’s Tree Service had inflicted and he stated that they had not trimmed the tree correctly. MrC*** is saying our arborist did not trim our tree correctly and has caused dead branches. There is one dead branch which our arborist had nothing to do with. We will attach pictures of our tree that were taken in July of this year so the tree’s health prior to this incident can be seen. The statement of extortion is also a joke. We would not accept what they offered as we never wanted them to touch our tree again so they call it extortion. Our tree was trimmed in a way that has disfigured our tree. At a minimum we will have to pay to have our tree trimmed correctly by our arborist. It will take several years before our tree will look close to again. If they did not clean their equipment properly our tree could have been infected with a fungus which will kill it. We received an estimate to remove the tree without the trunk will cost aprox $2,500. The trunk will be additional. A replacement tree will cost aprox $1,000. To say we are taking advantage of this situation is not accurate. We have spent over $over the past and half years ensuring the health of this tree to have it compromised by someone who obviously did not know what they were doing. We reject their offer of an EAB treatment or trimming. We do not want them on our property ever again and do not want them touching our trees
