We received a letter from a lawyer retained by Mullins Construction asking to settle the issues at our property. We are communicating with the attorney and it appears that arbitration will be necessary to settle the many issues created by C.BMullins Construction. We would like to address Mullins Construction response to our complaint.1. Mullins did not complete numerous items on the specs that was written ad signed by Mullins Construction and the homeowners. My husband and I did speak with the county and Mullins Construction prior to start of the project. The contract was our agreement; All our complaints come DIRECTLY from the contract. We understand that is was a lead abatement project; That is not an excuse to perform poor quality workmanship. We called and emailed Mullins Construction after day of the project to express our concerns. This has been an on going issue since day of the project. 2. All baseboards should have been addressed. In the contract it states in capital and bold letters, "The following areas must include all window trim, baseboards, door jambs, shelves and casing: bedroom #1, #2, #3, bathroom complete with door slab, kitchen, living room, hallway to basement, second floor hallway, enclosed porch first floor front, etc." 3. The items on my list were not completed. I was told several times, "No, we are not doing that." That is why we are in this situation today communicating with the Revdex.com and lawyers. In regards to the interior paint, two bedrooms and the second floor hallway was cleaned to remove the white paint splatter. The other areas in the house were NOT cleaned or even looked at. The house is currently bubbling and peeling. In regards to the paint chips, we found new and old paint chips. I have collected and saved the bigger pieces that were found around my home. It doesn't matter if the house was peeling for years; The gutters and downspouts were supposed to be cleaned of ALL debris and flush entire system of water. This is stated on page of Exhibit A of our contract. 4. The downspout was removed by Mullins Construction. I have sent the Revdex.com pictures of the missing downspout while the job was in progress (taken from the street) and pictures of the missing downspout the day moved back to the property. My husband re-installed the downspout. My husband was told on Sunday that the basement was flooded. There was ABSOLUTELY a discussion about the City of Bedford coming to snake the drain. The discussion was between my husband and the project manager, not the painters. The city does this for free for residents in Bedford. I don't think anyone in their right mind would be okay with their belongings sitting in water for several days! 6. The paint was not scraped of all loose, blistering, and peeling paint. I sent the Revdex.com a list of issues we have in regards to the exterior paint. 7. My husband and I hired an attorney to not release funds until this matter has been resolved

I have attached the specs, clearance, and statementThe Melaragno's have said if we deduct $8500.00 she will remove her Revdex.com complaintWe are not going to do thatWe will more than likely be going to arbitration.Specs, clearance, and statement copied and pasted below by Revdex.com staff 8/3/15.1.) Mullins did ALL the items from the specs written by The CountyEvery single item in the specs; that Mullins did not write and that the contract was signed for was 100% completeMrsMelaragno, after the fact, questioned the meaning of some of the specs, she should have had a conversation with the County or Board of Health before they gave us the project to doThis was not a remodel it was a lead abatement projectThere is not one item that was not completed and approved by the County and Board of Health.2.) Possibly some of her baseboards etcare chipping (not every baseboard or trim was addressed), we followed the specs and only lead issues were addressed in specs and that is what we did; exactly what the specs called to do.3.) To address the interior floors and bubbling exterior paint, Mullins Construction along with The Health Dept., and The Cuyahoga County Department of Development representatives were at Lincoln to address any and all of the items on her punch listWhen Mullins left that day the interior floors were free of paint and the exterior of house had no bubbling or peeling paint, and the ground had no paint chipsAfter a heavy rain some paint chips were found (the house had been peeling badly for years) and when she emailed Mullins we were there within the hour to check around house and clean up any chips.4.) The downspout not the gutter was removed to do a proper paint job (it was re-installed)This had nothing to do with any flooding they had what so ever. 5.) The painters saw the homeowner pull into the drive on Sunday the day after the rain There was never a discussion with anyone about going in and snaking any drain or to address the basement flooding It was apparent by marks on the walls that it had flooded before.6.) The exterior of the house along with the windows, glass block windows, doors, overhead garage door, and the smoke alarms have a one year workmanship warrantyThe specs called to scrape all loose, blistering, and peeling paint from the exterior and it was done.7.) As of July 28, no payment has been madeOnly 20% of the total contract is the exterior painting and they have a one year warranty which we have no problem addressing if she were to call us. 8.) We are not putting blame on anyone as we did exactly what the specs called for
