I am in receipt of the complaint filed by [redacted]. The following are facts as I know them. In mid July of 2016 I was contacted by a Contractor who has done work independently for Expo Realty asking if I had a unit available for a family member who was in an emergency housing situation. At the...

time [redacted] was being shown to the general interested public for the intent of renting by August 1, 2016. As a favor, and to assist the young woman, I showed her the apartment. She agreed that she would take the unit and gave me a 100.00 deposit. Based on this, I contacted 2 other interested parties and told them that I had rented the unit. At that time in July there were several items that needed to be repaired and/or completed. With the exception of the cleaning the apartment, all repairs were completed. with the exception of the cleaning the apartment, all repairs were scheduled to take place within a few weeks, but not necessarily completed by the first. I made this quite clear to Ms. [redacted]. We negotiated a reduced first months rent in lieu of our hiring an outside cleaner and provided her at no charge several gallons of paint for her personal use. She agreed to these terms and signed the lease, with an interpreter present, July 26th giving the Security Deposit of 700.00, plus the balance of the negotiated 1st months rent of $600.00. As this was an emergency situation for her, she was also given the keys on July 26th and 6 days rent free so that she could move in before the effective date of the lease, On August the 9th, I received a call from Ms. [redacted] via an interpreter that she had decided not to move in to the apartment after all and wanted her money back. I explained, as I had during the lease signing, that a 30 day notice to vacate was required and that Expo Realty was entitled to the 1st month rent. She was informed that at the end of the month, she would receive back her Security Deposited. On September 9th, I cut a check to Ms. [redacted] for 700.00 Security Deposit which she threw back at me and began making veiled verbal threats leaving me concerned for my personal safety. She threatened to "play me dirty", as she claims I played her. However, the lease was carefully and clearly read to her and very clearly states that a 30 day notice is required to cancel a lease. As far as I, as Property Manager for Expo Realty am concerned, Ms. [redacted] was treated fairly and even with special dispensation due to her emergency situation, thaT eXPO realty is entitled to first months rent as stipulated in the lease and that Ms. [redacted] has treated both me and my company unfairly and rudely. Her Security Deposit check is still sitting in my office. She has to date refused to accept it and as I have no forwarding address for her I cannot mail it.
