The rock was to be used on street side for water runoff & to save $ of hauling.He lied about town saying it wall couldn’t be built,see email,if they did come why didnt he tell me.I gave him $for leveling front,he had quoted $for widening drive w/o wall,&moving rock to street side,but he took the rock instead.His ads are deceitful,it implies hes licensed contractor.He never told me he wasnt until after,statement makes no sense,gave an estimate for job which include building a retaining wall for $1700,I didnt know until after&couldnt find on registrar,he was paid over $1000,over limit for unlicensed anyway.See receipt.It is my property.See photo of property pin.I never agreed to pay the $450,thats what he text me I owed after not building wall.Widening was just on side of driveway,statement about dirt being removed around trees is only true for tree,other trees are at back end driveway¬hing was to even be being done in that area,the wall was to end into the hill of rocks that was previously there before he took the rocks(see picture),nonnative soil or not,roots shouldnt be exposed.I was very unhappy w/the fact that my wall wasnt built,rocks were gone&that there was no rock runoff&that dirt had been removed&roots left exposed.I was happy w/how wide driveway was&that he had leveled down mounds in front yard.I also didnt know at this time that he lied.Recorded conversation will show how upset I was that wall wasnt there,rocks werent brought to the street side,I even had him add to the receipt that he would come back to fix if there was erosion to dirt hill(see receipt),he also told me my rocks were under dirt hill,which they are not.Email from Ray Lahaye & conversation w/him when he came to my house on 9/21/17,shows that he lied.Curtis Ward from Town of Payson also came out to discuss my property line.Property pin photo shows the wall would have been w/in my property.I should get refund to hire someone to do job correctly&money for stolen rocks.Thank You,Lynne O [redacted]

No rocks had been stolen and customer had asked us to remove them as seen in the before pictur s there would have been no way to widen drive at with rocks thereFurthermore as I mentioned prior she had asked if I knew anybody who wanted them before I took them to the landfillThere was no monetary gain from the rocks they were disposed of per customer request furthermore I was notified by Revdex.com that the case had been dropped due to Lynn's lack of responseI have been more the cordial and helped rectify anything the customer thought was wrongI will not be issuing a refund nor will I be paying for someone else to do the work she requests needs to be doneThe fact remains that it was not her property it is in fact the town of Payson's easementThis will be my last response to any of thisAlso as stated on the invoice the work she requested tot be done was done minus the retaining wallWhich is clearly shown in her pictures as well as mineI have several employees that were present when she stat d that she want d the "ugly"rocks goneThank you for your time

The homeowner had asked me to widen and build a retaining wall next to her house so her husband could park his tow truck, she had also been aware that we couldn't widen it with the river rock that had been placed and she agreed and actually stated she may know some people who would want it. When I...

began the job it occurred to me that the retaining wall would be over 4' feet which would require an engineered wall along with a permit, also part of the driveway she wanted extended was not on her property nor would have the retaining wall. So I didn't charge her for the retaining wall and actually took some extra time out to grade some dirt in her front yard that she wanted graded out eventually but didn't have the money. I am in fact licensed to do business in the town of payson and insured with limited liability insurance. I told her the realtaining wall could not be done because I'm not a licensed contractor and that would exceed the amount I'm allowed to make. Not to mention it wasn't even on her property. Initially she agreed but shorted me the discussed amount, with an outstanding balance of 150.00. As far as the trees go nonnative soil was removed from their resting place, in order to make the driveway as she wanted she understood and agreed dirt would have to be removed but again it wasn't native soil it was fill, so structurally it had no effect on the tree. I have pictures for documentation and our final conversation recorded where she said she was ok and happy with the end result and understood why we couldn't do the retaining wall nor dig anymore due to the fact that it was not on her property which initially she assured me was her property. The town did inform me that it was in fact their easement. So homeowner would be liable as she stated it was her property.
