We hired Murtaugh Restorations to refinish our wood floors in in a house in ***, NY while we were living in ***We came out for the refinishing*** did not do the job - he had guys do itOn the second day, they came at about noon because one was out too late the prior nightThey rushed the job and did not use all of the coats of finish and most rooms had large areas that had no finish at all - plus a lot of rooms now have gouged woodWe called *** - he came and started to redo the jobHe got three quarters done and said that he'd come back the next dayHe never didWe placed numerous calls to him to ask when he'd finish the job - did another no show and then stopped returning our callsWe had to pay someone else to clean up the jobThis guy IS NOT dependable

I have been through the file and all the picturesWe sent our employee over to check on what was going on with the mold and discovered that there was caulk around the tubWe don't use caulk for this reasonWe did all the tile work and used an apoxy grout and I did a final inspection upon
completion of the job with *** ***, so we are unaware of how the caulk got thereThere are some tiles there that the grout has come lose on the wall only that we don't mind fixingOur representative asked them to call our office so they could be put on our scheduleAt this time we have not received a phone callThey still owe a balance for the work that we were not looking to pursue that totaled $ They did not want to pay at the end of the job and we didn't want to dispute it in courtWe will forward all paper work to show everything and they still want me to warranty the work when they didn't want to pay the balance and we are still willing to go in and fix the item and stand behind our workWe did a lot of work for this customer starting with the roof and then we rebuilt their front porch and painted the houseThey had a leak in their house from the bathroom and filed an insurance claim with their home owners insurance and wanted us to do the job, the insurance company put them up in a hotel for the work to be done and we had to wait for *** *** to clear the job for us to begin our workThey then added work on for us to do which added time onto the jobAt this time we are sorry that they are unsatisfied when we tried very hard to make sure that they were and satisfiedWe also never pursued any money that was owedWe would like the opportunity to come in and fix the groutWe are not interested in a 3rd partyThey can call the office at *** and we will put them on the schedule to have the work fixed that we are more than qualified to do

I hired Murtaugh Restorations to replace a new wood-burning stove and all new pipes and ventsThe contractor arrived on time and preparedHe had the work done and legally inspected for me in one days work He was polite and took the extra time to explain safety precautions, maintenance, and any additional questions I had I was more delighted by the fact that he did not leave any work debris or trash from the job for this has happened to me in the passed by other companies I will contact them for hire again when I want my chimney restoredThanks again!

Home Headquarters hired Murtaugh Restorations to do said jobHome Headquarters stopped paying our company so, we stopped working on the job; we can not work for free When the customer asked us why we stopped working, we told her that Home Headquarters stopped paying us The customers
reply was that a shut off valve was not installed by the plumbing Company, which resulted in further damage to the property when a pipe leaked and there was no way to turn the water offThe Customer said that the Plumbing Company said that Murtaugh Restorations told Plumbing Company to not install the valve, so any damage caused there in was Murtaugh Restorations fault Murtaugh Restoration would have no reason to tell a Plumber how to do there jobIt is also highly unlikely that a Plumbing Cowould let a separate company who does not do plumbing to tell them how to do their job We are very sorry that this is happening to the customer We have nothing to do with this complaint Home Headquarters was the company responsible for lead, and we feel that the customer does not know who hold accountable so, came after us in desperation We would be more than happy to appease the customer if we were responsible, but we have nothing to do with the miscommunication between, Home Headquarters and their customer

The public has made their decision, for over years with minor no to complaintsWe always go above and beyond to accommodate customers and their needsThis particular project/house definitely had its challengesHowever, Murtaugh Restorations had the talent to complete the project on time, on budget and to a homeowner’s satisfactionWe had a project manager and roofing foreman on the job site dailyThis was never sufficient for HomeownerThe owner of the company himself would spend days on the job site to comply with her wishesThose are not only titles, they are earned positions in a multi-million-dollar company. MrsHomeowner had multiple change orders above and beyond what she has listedShe also had verbally expressed that she had a budget to fit in to after the original contract was signedThere for Murtaugh Restorations had went above and beyond what her budget would allow and not charged her for the additional workEven still she would not pay anything more than what she has mentionedIt was agreed upon that we would return after the window sash had been delivered from the manufacture, again this was a manufacture defectWe would install the new window sash, fix the siding and fix the divot in the yardAgain Mrs*** had left town so we could not returnAgain we tried multiple times to reschedule and it was never a good time for herShe was concerned about the weather turning colder, however manufacture spec for the siding she had chosen had a minimum temperature installation point of degrees Fahrenheit was fall and the temperatures during the day were still in the 50’sTHE FOLLOWING IS IN RESPONSE TO IN ORDER OF HER ISSUES; 1.) The window sill on the garage window was a manufacture defect brought to her attention as soon as we noticed itShe chose to have $dollars deducted from the original contract vswaiting 3-weeks for a new window to be deliveredThe reason for this was it would have held the rest of the job upWe would have had to pull workers of the main house to remove siding, remove the damaged window, install the new window and reinstall the sidingThis is a situation outside of our controlWe would have accommodated her either way.2.) We had guys running up and down the roof every day because MrsHomeowner would create a check list with pictures every night of things she had concerns with before the job was completeIf she would have let Murtaugh Restorations do the job in the procedure that is followed on every project and brought her concerns to us without making us address them immediately whether or not the concern was validThe shingles wouldn’t have been compromised and the job would have been completed fasterAt no time did any of these concerns compromise the house or the new product that had been installed.3.) At no point was the roof left openEach section was dried in with synthetic felt and ice and water barrier per manufacture specAs stated in the last response, the owner of Murtaugh Restorations and field project manager had received a phone call and arrived around 3:a.m.-4:a.mto address her concernWhen they arrived, they found no damage from a leakThey did however find a small puddle by the tire of the car in the garage that was in the process of drying up as if it had come from the car itselfNow driving an hour at that time in the morning to address a concern isn’t going above and beyond we don’t know what is.4.) Storm window was fixedWhen the workers were approached about the situation they had said they have/had never thrown drinks on roofThis is against OSHA and company policyWe follow both very strictlyRegardless we had the window fixed at no cost to the home owner.5.) Cable line was not cutA nail punctured it when applying house wrap for siding installation. This happens from time to timeThe old cable line was on our check list to be removedHowever the homeowner took it upon herself to do itAgain something that would not have been left behind, we would have doneThere was no hurry to do this6.) During the day, we do our best to keep nails and other debris from accumulating in the yard/drivewayHowever this is a job siteThe contract states that at the end of the work day all nails will be picked upWe would magnet the ground and send workers around to pick up nails after running the magnet. We also use a leaf blower on all sidewalks and driveways to be sure that nothing is left behind.7.) 1st off you cannot tarp shrubs/bushes in the summerThey will die2nd off we carried all debris to the back of the house were our dump trailer wasThere were no shrubs/bushes thereWe did cover the sides of house with plywood to stop any possible scratching of brick.8.) We weren’t working on the side of the house when the air conditioner was not coveredWhen we were working on that section it was covered with plywood to prevent any damage.9.) Again, we cannot cover any plant life with tarp or plywoodThe tarps will bake the plants when it is degrees outAnd Plywood would have crushed themWe took very good care not to damage any of the plant lifeThis is the 1st we are hearing about PERENNIALS BEING DAMAGED.10.) Smoking on a job site or use of tobacco products is against company policyThe Project manager or roofing foreman would have terminated any employee doing soNo employee lost their job during that project.11.) Shingles weren’t crooked on front peakIt was an optical illusion from the ground looking up at the front peakWe did remove and replace shingles to look even from the ground at no additional cost to homeownerWhen a 12-pitch, a valley and a 4-pitch come to meet the look does not ever come out as expected because of the geometry of the roof coming into play.12.) Screen was fixedWe accepted fault without any issue.13.) There were no exposed nails on the completed EPDM roofIt was the framing of the house that created this lookThere was a flat roof meeting a pitched roofWhere these two points met created thisWe fixed this by removing barn board on the pitched roof and installed new plywoodAgain, free of charge.14.) The nails that where through the trim/fascia board where already thereWhen we removed the over lapping fascia board they became exposedWe had to remove the over lapping fascia board when she requested we straighten out her rake edgeAgain, no charge for straightening out her rake edgeWe told her that we could replace the fascia metal at an additional cost, which would then remove all exposed nails and holesOf course, she agreed to thisHowever, she would not pay once this was doneWe have decided to not pursue payment for this.15.) #water drains on the outside of the window because its outside#It drains that direction because of the design of the flat roofNOT OUR DESIGNWe had offered her a solution by installing guttersShe denied thisWe cannot change the original design of the flat roof without extensive cost for architect, labor and material. So, in retro spec, we feel as though we are owed the $dollars prior to any more work being completed on the projectWe feel as though we have gone well beyond the contractWe have received many compliments and job requests from neighbors of MrsHomeowner

This contractor was a nightmare. They will claim they did a great job when there are serious problems. Then they will charge you for mistakes they made. Also one of the works stole an item from my house. Owner did think it to be a problem. They will fight you tooth and nail to make a bunch of money and by low quality items. Very unprofessional.

Murtaugh Restorations,Inc. received a phone call, in May 2017 for a bathroom remodel. We sent a project manger out at that time ,the customer needed a handicap bathroom due to the fact she needed to move her Grandmother in and she only had 2 weeks for the work to be done, the Grandmother was in a...

wheelchair . Our project manager had suggested our vinyl plank flooring for the wheel hair and removing all carpets . She was advised by our project manager and the carpenter that the sub-flooring needed to be replaced and/or repaired due to being old and warped. The customer told us that she needed this done right away, did not have the time or money to have the sub-floor done so we moved ahead with the project and gave her samples of flooring to pick from. 2 weeks later we where at the end of project and needed to finish up some thing and requested to work Saturday to finish she asked for us to come Monday due to she needed to move her grandmother in Saturday . That Monday I received a text from the customer saying they where rushing the grandmother to the hospital, which postponed us going there that day . Then we herd from the customer that Thursday that the Grandmother passed away . We then made arrangements to finish the job and at our inspections the floor was not acceptable we sent 2 employees back and they took the floor apart and fixed everything they needed along with the other things we had on our list.  At that time I did explain to the customer how uneven the floors where and that she could put carpets back in sense she didn't need a smooth floor for a wheelchair, anymore . We did offer a $ 2000.00 dollar credit at that time to try to make her happy {face to face } and she said that's not good enough that she thinks she should not have to pay for the floor at all or get at least a $4,000 credit. As for the change order that again was a verbal agreement that the Special handicap toilet needed to be put in along with the safety grab bar. Yes, we should have had her sign it but she wanted it all done so quickly that we did not want to stop and wait for a signature. She did not via email or verbally ask to see the cost of the flooring. We even went ahead and fixed plumbing leaks she had in the basement that did not have anything to due with any work we did, free of charge to again make her happy. The entire time she was happy with everything that we did, until the end. Now she is bashing our company name all over Social Media sites and filed a complaint with you after multiple times of trying to resolve this with her . We, are incredibly sorry that her Grandmother passed away but there was nothing wrong with any work that was done UNTIL she passed and then all this came out. Bottom line is that since the job is done & she has no need for the bathroom she will not pay the final invoice for the work completed, even after we sent an invoice showing credit to her.

We tried both verbally to come to an agreement with her (taking $2,000 of final invoice) and also at a later time by sending her a corrected invoice that showed a $2,000 credit for the flooring and also a credit for the change order in the amount of $525 because she did not physically sign it, she only verbally consented to it. This would have brought the final invoice from original price of $5,214 down to $2,689.00 but she was not interested in making any deals other then having a $4,000 credit for the flooring and she did mention she was not going to pay for a change order that was not signed. She did state in her original complaint to you was submitted on 9/25/2017 that was assigned ID#[redacted] that her flooring was impossible to install due to the uneven nature of the floor in her older home, she knew that because our carpenter had advised her that the sub-flooring needed to be replaced, however now she is stating she was never advised of that. At this time an attorney has been retained and no further adjustments will be made without going through the attorney, his name is [redacted].

We have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve our complaint. We need some more time to formulate responses to all of the numerous points made in Murtaugh's response to our complaint. You will receive a detailed reply from us by Tuesday, November 25.

1.  We sent our employee over to check on what was going on with the mold and discovered that there was caulk around the tub. We don't use caulk for this reason. We did all the tile work and used an apoxy grout and I did a final inspection upon completion of the job with [redacted], so we are unaware of how the caulk got there.
We certainly did not apply any caulk to our brand-new bathroom.  A Murtaugh employee installed the caulk around the shower dial and around the tub surround after we used the shower for the first time and watched water seep through the shower surround and lip of the tub.  The caulk was on a verbal punch list that Murtaugh took care of before the job was completed.  Amber [redacted]-Walton asked the Murtaugh employee how often we should remove and reapply the caulk and the employee said about every 12 months.
The problem of the wide-spread black mold has still not been addressed.
Also, our names are [redacted]; nobody is named [redacted].  Mr. Murtaugh is confused.
2. There are some tiles there that the grout has come lose on the wall only that we don't mind fixing.
Yes, there are loose tiles on the shower wall that do need to be fixed, but the mold is the larger problem.  But there is also deterioration to the grout on the bathroom floor.  Mr. Murtaugh did not address this damage that is still under warranty.
3. Our representative asked them to call our office so they could be put on our schedule. At this time we have not received a phone call.
As we stated in our complaint, the last contact we had from Murtaugh Restorations, Inc. was on 9/18/14 when two (2) of their employees came to take photos of the bathroom.  We never received any kind of follow-up phone call from their representative, nor did anyone verbally ask us to call their office to be put on their schedule.
4. They still owe a balance for the work that we were not looking to pursue that totaled $ 2203.95. They did not want to pay at the end of the job and we didn't want to dispute it in court. We will forward all paper work to show everything and they still want me to warranty the work when they didn't want to pay the balance and we are still willing to go in and fix the item and stand behind our work. We did a lot of work for this customer starting with the roof and then we rebuilt their front porch and painted the house. They had a leak in their house from the bathroom and filed an insurance claim with their home owners insurance and wanted us to do the job, the insurance company put them up in a hotel for the work to be done and we had to wait for Serve Pro to clear the job for us to begin our work. They then added work on for us to do which added time onto the job. At this time we are sorry that they are unsatisfied when we tried very hard to make sure that they were and satisfied. We also never pursued any money that was owed.
Please see the email below, it is a copy of the email that we sent to Murtaugh Restorations on 12/6/13.  Mr. Murtaugh verbally agreed to this detailed email and completed the punch-list items the next day.  The check that we wrote for the total amount due, check #1189, was cleared from our checking account on 12/19/13.  We do not owe a balance for any work that Murtaugh Restorations performed on our property.  It is insulting that Mr. Murtaugh would now state that we owe his company money as a result of our raising concerns about the work that is still under warranty.
5. We would like the opportunity to come in and fix the grout. We are not interested in a 3rd party. They can call the office at 315-432-5600 and we will put them on the schedule to have the work fixed that we are more than qualified to do.
Mr. Murtaugh still has not addressed the copious amounts of black mold that has appeared around the bath tub and shower walls.  We had a third party assess the damage, and they told us that the glass block window was not properly installed, causing water to seep in from the outside.  Murtaugh’s two (2) employees did not assess this damage when they came to take photos on 9/18/14.  Mr. Murtaugh’s lack of response to the black mold problem indicates that he still doesn’t understand the seriousness of their poor workmanship.  We have zero faith that Murtaugh Restortaions will be able to sufficiently fix their mistakes.
It is precisely for these reasons that we seek a third party to complete the repairs.  Thus, we do not accept Murtaugh’s desired settlement according to the Revdex.com complaint website.
With respect, [redacted]

we have addressed all the problem and said for customer to call office to be put on the schedule for us to come fix any problem there is we dont have a problem doing this we are not in agreement to have a third party come do our work our office hours are 8 am to 430 pm monday thru friday the number is [redacted]

The public has made their decision, for over 20 years with minor no to complaints. We always go above and beyond to accommodate customers and their needs. This particular project/house definitely had its challenges. However, Murtaugh Restorations had the talent to complete the project on time, on budget and to a normal homeowner’s satisfaction. We had a project manager and roofing foreman on the job site daily. This was never sufficient for Homeowner. The owner of the company himself would spend days on the job site to comply with her wishes. Those are not only titles, they are earned positions in a multi-million-dollar company.  Mrs. Homeowner had multiple change orders above and beyond what she has listed. She also had verbally expressed that she had a budget to fit in to after the original contract was signed. There for Murtaugh Restorations had went above and beyond what her budget would allow and not charged her for the additional work. Even still she would not pay anything more than what she has mentioned. It was agreed upon that we would return after the window sash had been delivered from the manufacture, again this was a manufacture defect. We would install the new window sash, fix the siding and fix the divot in the yard. Again Mrs. [redacted] had left town so we could not return. Again we tried multiple times to reschedule and it was never a good time for her. She was concerned about the weather turning colder, however manufacture spec for the siding she had chosen had a minimum temperature installation point of 37 degrees Fahrenheit was fall and the temperatures during the day were still in the 50’s. THE FOLLOWING IS IN RESPONSE TO IN ORDER OF HER ISSUES; 1.)     The window sill on the garage window was a manufacture defect brought to her attention as soon as we noticed it. She chose to have $100 dollars deducted from the original contract vs. waiting 3-4 weeks for a new window to be delivered. The reason for this was it would have held the rest of the job up. We would have had to pull workers of the main house to remove siding, remove the damaged window, install the new window and reinstall the siding. This is a situation outside of our control. We would have accommodated her either way.
2.)    We had guys running up and down the roof every day because Mrs. Homeowner would create a check list with pictures every night of things she had concerns with before the job was complete. If she would have let Murtaugh Restorations do the job in the procedure that is followed on every project and brought her concerns to us without making us address them immediately whether or not the concern was valid. The shingles wouldn’t have been compromised and the job would have been completed faster. At no time did any of these concerns compromise the house or the new product that had been installed.
3.)    At no point was the roof left open. Each section was dried in with synthetic felt and ice and water barrier per manufacture spec. As stated in the last response, the owner of Murtaugh Restorations and field project manager had received a phone call and arrived around 3:30 a.m.-4:00 a.m. to address her concern. When they arrived, they found no damage from a leak. They did however find a small puddle by the tire of the car in the garage that was in the process of drying up as if it had come from the car itself. Now driving an hour at that time in the morning to address a concern isn’t going above and beyond we don’t know what is.
4.)    Storm window was fixed. When the workers were approached about the situation they had said they have/had never thrown drinks on roof. This is against OSHA and company policy. We follow both very strictly. Regardless we had the window fixed at no cost to the home owner.
5.)    Cable line was not cut. A nail punctured it when applying house wrap for siding installation.  This happens from time to time. The old cable line was on our check list to be removed. However the homeowner took it upon herself to do it. Again something that would not have been left behind, we would have done. There was no hurry to do this.
6.)    During the day, we do our best to keep nails and other debris from accumulating in the yard/driveway. However this is  a job site. The contract states that at the end of the work day all nails will be picked up. We would magnet the ground and send 2 workers around to pick up nails after running the magnet.  We also use a leaf blower on all sidewalks and driveways to be sure that nothing is left behind.
7.)    1st off you cannot tarp shrubs/bushes in the summer. They will die. 2nd off we carried all debris to the back of the house were our dump trailer was. There were no shrubs/bushes there. We did cover the sides of house with plywood to stop any possible scratching of brick.
8.)    We weren’t working on the side of the house when the air conditioner was not covered. When we were working on that section it was covered with plywood to prevent any damage.
9.)    Again, we cannot cover any plant life with tarp or plywood. The tarps will bake the plants when it is 95 degrees out. And Plywood would have crushed them. We took very good care not to damage any of the plant life. This is the 1st we are hearing about PERENNIALS BEING DAMAGED.
10.) Smoking on a job site or use of tobacco products is against company policy. The Project manager or roofing foreman would have terminated any employee doing so. No employee lost their job during that project.
11.) Shingles weren’t crooked on front peak. It was an optical illusion from the ground looking up at the front peak. We did remove and replace shingles to look even from the ground at no additional cost to homeowner. When a 12-12 pitch, a valley and a 4-12 pitch come to meet the look does not ever come out as expected because of the geometry of the roof coming into play.
12.) Screen was fixed. We accepted fault without any issue.
13.) There were no exposed nails on the completed EPDM roof. It was the framing of the house that created this look. There was a flat roof meeting a pitched roof. Where these two points met created this. We fixed this by removing barn board on the pitched roof and installed new plywood. Again, free of charge.
14.) The nails that where through the trim/fascia board where already there. When we removed the over lapping fascia board they became exposed. We had to remove the over lapping fascia board when she requested we straighten out her rake edge. Again, no charge for straightening out her rake edge. We told her that we could replace the fascia metal at an additional cost, which would then remove all exposed nails and holes. Of course, she agreed to this. However, she would not pay once this was done. We have decided to not pursue payment for this.
15.) #1 water drains on the outside of the window because its outside. #2 It drains that direction because of the design of the flat roof. NOT OUR DESIGN. We had offered her a solution by installing gutters. She denied this. We cannot change the original design of the flat roof without extensive cost for architect, labor and material.

So, in retro spec, we feel as though we are owed the $1000 dollars prior to any more work being completed on the project. We feel as though we have gone well beyond the contract. We have received many compliments and job requests from neighbors of Mrs. Homeowner.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
I wanted to respond to Murtaugh's response but it only allowed me to respond that I did not agree with their response. Here is my response:With
this response I leave it up to the public to decide whether or not to
hire Murtaugh Restorations because there are two sides to every story.
My conclusion is that if you have an older house and you are looking for
"Restoration" work, they are not the master craftsmen they profess to
be. Plus, get everything that is agreed upon written into the contract.
They over promise and under deliver.  If there was a Project Foreman, it was in title only.I
paid extra for 3 change orders. 1). A solar fan = $715 2). Foam
insulation and 2 X 4's for flat roof = $475 3). Front cream trim = $200.It
was at my dining room table that Mr. Murtaugh and I both agreed to hold
back $1,000 as an incentive to return because they had packed up and
left with the extra vinyl siding and shingles; the window panes were
crooked and needed to be replaced; they installed some dented siding;
and there was a hole in the yard that needed to be filled. Here is a list of things that happened on this job:1). Dented the window sill on garage window. I could either wait 2 weeks for a replacement or deduct $100 from the cost.2).
Shingles had to be continually replaced because instead of pulling the
guys off the job when it became hot, they continued to run up and down
the new roof damaging the shingles they just put on. 3). They left
my roof open knowing that a big RAINSTORM was coming through that night.
The water poured in from the attic, down my second story bedroom wall
where I had original artwork hanging, all the way to the first floor
garage ceiling onto the parked car below. Mr. Murtaugh's response was,
"I've seen worse".4). Broke a storm window by throwing drinks up on
the roof from the ground. It was implied that they did not do it. Fixed
the window.5). Cut the TV cable line prepping for vinyl siding. I had to call TWC to replace it on a Saturday. Murtaugh said they would remove the old cable but they did not, I did.6).
They say they pick up the nails daily but this does not happen.
Repeatedly I would find nails in the driveway for the car to run over.7). Did not cover shrubs/landscaping from falling debris.8). Forgot to cover the air conditioner to protect it from nails and debris.9). Trampled the perennials.10). Spit chew and disposed of cigarette butts in the yard.11). Crooked shingles on the front peak. Needed to be re-done.12). Ripped the screen on a new window. Fixed.13). Nails were popping through the newly installed rubber roof. Fixed.14).
While installing new drip edge around the entire perimeter of the roof,
the nails went through my cream trim. The best they could do to fix
this was to remove the nails. I am still left with holes in the trim.15).
The new picture window installation has left me with water draining
down it which requires constant cleaning. In the winter, the water
freezes to it. Incorrect installation? Because this never happened with
the old picture window. With 15 "mishaps" that I can think of
listed above on this job; the constant stress of having to check on the
job daily; and Murtaugh Restorations not returning to finish the job;
led me to write this Revdex.com complaint. The rest is up to the public to
decide.Honestly, I couldn't make this stuff up if I tried.[redacted]

The job did take longer than we had anticipated. One reason was due to the severe heat at the time we did the job. Second reason was the extra work that was unforeseen that need to be done -rotted framing, rotted decking, insulation work, extra work for new siding to go on. This and a few other...

things were all change order work in which the customer was aware of and agreed needed to be done. The extra work was agreed upon in front of project manager, project foreman and owner of company, she refuses to pay for any change orders. We are not interested in taking this situation to small claims court. Due to the heat some shingles did get compromised. We did replace the shingles with no questions asked. We did install new windows and on one of the windows the grids in the window are not level and straight due to manufacture defect.  We did order the new window sash that needs to be replaced. We have correspondence via emails from the customer and us that state at the time when we came out to replace the sash the window would need to be paid for, hence we held back the money for that window. Her email states that she wants to hold the money in a contingency fund for 1 year, that is not part of our contract. In our contract it states that she would need to pay for rotted decking, framing and refuses to pay for any extra work that was done. Murtaugh Restorations, inc. paid for the materials and the labor. We also put her on our schedule to return to install the new window sash and she got back to us and said that would not work for her, she stated she would not be home. We rescheduled multiple times to complete the work. Each time she was out of town. We don't mind installing the window sash or giving her the window sash but the window would need to be paid for before the release of the sash. She is not willing to pay for any thing and we can't just keep giving materials and labor away. We have provided her with a full manufacturers warranty and a 10 year workmanship warranty. Therefore the siding is covered, however once again, she is not available for us to come and repair it. The divot in the yard was created when the shingles and other materials where delivered to the job site. The supply company asked permission to drive a fork lift on the lawn, she gave her consent. She later told us that there had been a tree cut down and that where the stump was. So the weight of the forklift had create this divot. We told her once the work was completed we would re-soil and seed the area. She decided to take it upon herself to repair the area before the work was done. During the project she was complaining about mortar falling out of block joints do to the roof going in. These are uncontrollable do the roof construction. The house was built pre 1950. There were many imperfection in the framing and roof line that we corrected via her request. We will not be getting paid for these repairs. She had called us on a night a rain storm had come through, told us the roof was leaking. We sent two guys out there at 3 a.m., she refused to show us the leak and tell us were the water was leaking. The next day, upon her request to, we tore off the back main section of the roof, found no wet decking or insulation. We re-sheathed and  re-shingled the entire back main of the roof. Did not charge her. The amount of the change orders exceeded $7,500, we are not asking for that, we are asking for the final $1,000 to make the contract complete.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.  This response from the business contains some untruths.  I never said I needed the job done in two weeks, I said I needed it done as soon as possible, and I went with this particular contractor because they were able to start the soonest. The visit for the estimate was made on May 5th, with the work starting on May 22nd. That time line alone tells the truth of the "two week" lie. My grandmother did not move in until June 3rd, after the work was completed, though because of the various things that needed to be fixed, the work went beyond her move in date and after her death on June 7th. I have photos of the toilet not installed to code date stamped June 12th, meaning it was wrong before she moved in. I have a photo of the toilet drain leak that is dated June 19th. This is dated so late because once they moved the toilet so that it was to code, the toilet drain had a leak and had to be rerun again. In fact I didn't received the final invoice for the job until July 21st because the job went so long beyond the May 22nd start date because of all the things that needed to be fixed, they weren't wrapping up everything until into July. I was absolutely never told that the sub-flooring needed to be replaced and/or repaired due to being old and warped. Mr. Murtaugh came out to the house several times to see the flooring after it was installed, some visits were before my grandmother moved in and others were after she had passed away. He sent his wife and son one time because he was ill, and they were all puzzled by the issues they were seeing and said it was not satisfactory. He said they use that flooring all the time and have never had this problem. He wondered if it was a bad batch of flooring from the manufacturer. He even contacted the company which makes the flooring to see if they would warranty the flooring given the installation issues. I am sure this could be confirmed with the manufacturer, that this request was made. I don't think any of this would have transpired if they knew ahead of time it wouldn't work because of the sub-floor needing to be replaced etc. They fulling expected the flooring to work, and when it didn't Mr. Murtaugh admitted to me it wasn't the right flooring for my house. At this time, before my grandmother moved in he did have his two guys reinstall some of the flooring because some pieces were cut too short and the gaps at the walls were too large to caulk, and there was one board that was totally popping because it was too tight. I have photos of both of these things. The changes they made did not fix the main issue with the flooring, leaving me unsatisfied with the flooring work even after my grandmother moved in. At the time that verbal offer for a $2000 credit was made, I asked to see a break down of the cost of the flooring. Because the project in it's total included many parts, the flooring only being one, I felt it was impossible to negotiate a fair credit for the flooring not knowing what part of the the total bill applied to the flooring. I was told I could not have that information. He is absolutely lying when he says I did not ask for this, we were standing in my front entry way when I asked, his son was standing there as well, I wonder if his son would be willing to lie? I did not ask for a $4000 credit until later via email after Mr. Murtaugh said he was willing to settle with me and asked me via email what I thought was fair. He never responded to that request for a credit. It is absolutely untrue that there was nothing wrong with the work that was done until after my Grandmother passed away. My grandmother was alive and well and had a toilet that was not to code, a sagging shower curtain rod, an off center light fixture, unstained trim, flooring with gaps and raised edges all over the place, and as it turned out a leaking toilet supply line in the basement. What exactly were they coming back to do the week my grandma died if not fix these things that were unsatisfactory? You can't say you got it done quickly and I was happy, and then say I cancelled you coming back to do more work because my grandma had gone to the hospital. The work they were coming back to do in week three of the project was fix the issues!  During the period of time Murtaugh Restorations was working on our house we had three plumbing leaks in the basement. Two were clearly related to new plumbing work they did, and I have photos of those. The third was on a line they altered, though the leak was not at the particular place where they made the changes. They fixed this leak in addition to the two they clearly caused, but claimed they did not cause it. It seems likely stress put on the feed pipes due to changes in the bathroom they were feeding caused the joint to leak, but it was a small thing, and they fixed it. I don't know how the one ambiguous leak translates into them fixing leaks free of charge like they did me a favor. Mr. Murtaugh's son himself came back to fix the toilet drain that was leaking after the toilet had to be moved to meet code. I am not bashing the company all over social media, I am leaving reviews explaining our experience, which is backed up with photos and emails. I have now been threatened twice with attorneys and also with a mechanic's lien. I don't appreciate the threats. Mr. Murtaugh claims they have tried to work with me on this but there is no proof of that. I have several invoices with no credit applied, and only since leaving reviews online and filing this complaint have they have finally sent me an invoice with a credit applied, which is only the credit they offered me initially that I did not accept without knowing the cost of the flooring. All of this is dated and time stamped.   Regards, [redacted]
