Review: I cancelled my membership with Muscle Systems because unauthorized monies were taken from my account through my Debit card, totaling $662.27. Muscle Systems offers a five dollar monthly membership discount if customers agree to have the monthly dues electronically withdrawn from a credit card or debit card. I chose to use my debit card. My debit card was fraudulently accessed for Fitness Supplements that I did'nt purchase or receive. When I confronted the current owner ([redacted]) he told me he did'nt receive the money and that his Bank Account had been hacked. Other members accounts were also being hacked. [redacted] told me to give him the information I had on the fraudulent charges so he could turn it into his bank and I would be reimbursed. I reported this to [redacted] in mid November 2013. The Fraud transpired from July 2013 December of 2013. For five months I waited patiently for reimbursement. Every time I asked [redacted] about my money he told me the same thing (the bank is still investigating it, and they can't pay anybody back until the investigation is closed. I asked him if a police report had been filed he stated the bank said not to file a police report until they closed their investigation. I recently filed a police report with the West Sacramento police Dept. On March 17th I went to Muscle Systems and presented [redacted] with a Demand Letter requesting my money immediately and my resignation. The letter also stated that if he did'nt meet my demand I would take any legal actions needed to recover my losses. [redacted] became very hostile and told me to get the ---- out of his gym with my Idle Threats.I went to my locker to retrieve my belongings and left to avoid further conflict.Desired Settlement: I Would Like Muscle Systems to refund my money. I would also like this information to be posted on the(Revdex.com) Website in hopes that the public is aware of Muscle Systems unethical trade practices.

Response:

There was an issue where a few customers were charged on their credit cards, however the monies were not deposited into our account. We had informed customers to monitor their accounts and that if there were any suspicious charges, that they should bring it to our attention and we would help them resolve it as quickly as possible. The resolutions always were done through our members banks themselves, not ours. Since we did not receive the money into our account, there was no way for us to refund. We had informed everyone to have their banks contact us, we explained the situation and their banks in turn, refunded their money and we have not had any issues since. The complaint that is being brought forward is completely wrong. The consumer is stating that he was being charged from September thru December of 2013, however did not bring this to our attention until January of 2014. We requested copies of his bank information so that we may contact them and try to resolve the situation for him. His bank never responded. Mr. [redacted] is also disputing is monthly membership fees and products which he purchased during that time. We never told Mr. [redacted] that our bank would refund him his money. In fact, we told him that we would discuss and explain the situation with his bank so that we could tell them that we did not authorize those charges to his account and that they should be refunded. When Mr. [redacted] came into our business on March 17th, he was hostile from the start. He demanded that we give his money right then and there. He felt slighted because everyone else that had issues with their accounts received their money except for him. We told him that he’s been a really good member and that why would we make sure that everyone received their money but him. It was his bank, that did not respond to our calls. We even had our branch manager at our bank call and leave him two messages to explain the situation. Mr. [redacted] is stating that [redacted] became hostile with him, however we have signed witness statements that prove otherwise. We also have this whole conversation recorded on our security cameras that show Mr. [redacted] becoming very hostile with [redacted] and then calling him outside of the gym to get into a confrontation. [redacted] tried explaining the situation to Mr. [redacted], however he was not willing to listen. Mr. [redacted] was screaming profanities the whole way back to the locker room to pick up his belongings. There was never any profanities when telling Mr. [redacted] he needed to exit the building. It is evident as seen in the security footage that Mr. [redacted] was baiting [redacted] to try and stir up trouble. However, as business owners we know we have to keep calm and make sure that none of our other customers are in harms way when members become hostile. Please see attached witness statement from our employee who witnessed the whole incident from the moment Mr. [redacted] walked in the door.

Review: In February of 2014 I cancelled my auto pay membership with the gentlemen that works in the afternoon due to a health issue I was diagnosed with.He explained to me that he would process the cancellation and that I would be charged for the current month as usual as well as the following month since I didn't give the proper notification.So I was to be charged a total of $40.00 which I agreed too. When checking my bank account I noticed I was charged for February and March.When checking my account again the following month (April) I noticed I was charged another $20 by Muscle Systems I called immediately and spoke with the same gentleman he said he would contact the owner and let her know.I didn't hear anything back so I called again several times and spoke with the same gentleman as well as with the lady that works in the morning each time they told me they would relay the message.I never heard back from the owner. The following month (May) I noticed they had charged my account again.I called back spoke with both the gentleman and lady a few times before I finally heard from the owner.She said she would check it out and call me back. I didnt hear back from her for a few weeks after I had to call several times again. Finally she said they had changed banks and she was going to check to see if she could refund me through their new system if not she would write a check and I could pick it up at the gym or she could offer me 3 free months of membership at the gym.I did not hear back from her for several weeks again after I called several times speaking with both the gentleman and lady again. The last time I spoke with the owner said she now needs proof that they did charge me the total of $40.00 they were not supposed to when at first she knew they had and agreed to refund me.She said she was looking into it and would contact me. I have since called several times and left several messages with the same gentleman and lady who don't understand themselves why I haven't been refunded. Im still waiting.Desired Settlement: I would like to have my money refunded ASAP. I have wasted to much time on this matter that is their mistake.

Hi [redacted], this is [redacted] with muscle systems. I responded to the Revdex.com complaint and resubmitted it again today. As I had told you over the phone that if you were over charged that we need to see your bank statements in order to verify that the funds were taken via muscle systems. Once the credit card info is entered into our system we don't keep copies and therefore cannot see the names attached with the transactions. Also, you hadn't cancelled your membership correctly, however under the circumstances we had did a favor for you. Our policy is in order to cancel your membership it has to be written and signed by you which we never received. By blasting lies all over Facebook and yelp isn't going to help the situation. We told you what we needed in order to rectify the situation. If it is our error we will correct it immediately however we need proof. Please provide the statements as soon as possible so that we can take care of it if it is our error. Thanks again, [redacted]
