Complaint: ***
I am rejecting this response because it doesn't offer me anything. Not only that, Music Hut lied to the attorney, claiming that we never asked for a full size cello within
the period of time we were paying on the contractClearly he uses deceptive trade practices.

To whom it may concern:This letter is in response to The Music Hut's unsigned correspondence with the Revdex.com as a result of my complaint last month. Initial Business Response /* (1000, 5, 2015/07/08) */
The rental agreement terminated on Nov. 15, 2013 at which time the 3/4 size violin in possession by the renter became the property of the renter according to the terms of the rental agreement. At that time, our company was freed of any...

obligations under that agreement. There are no terms under the rental agreement for upgrading the size of the instrument. We upgrade sizes during the term of the agreement volunatarily, provided the instrument exchanged is in good condition and if we have the larger size in stock. We are under no legal obligation to honor this request. However, it is our policy to agree to exchange instruments after the term of the rental agreement has expired, provided that the instrument, case and bow are in good condition for a fee of $100.
Initial Consumer Rebuttal /* (3000, 7, 2015/07/15) */
(The consumer indicated he/she DID NOT accept the response from the business.)
We started asking for the upgrade in 2012, long before the rental agreement period was over. [redacted] told us that the full size violin was on back order and they'd let us know when it is in stock. We were never informed when they got them in stock despite many voice mails that we left for them. Now, they are saying they are out of the rental agreement and we cannot get an upgrade. From my point of view, it is a very shrewd business practice and bad customer service. :(
Final Business Response /* (4000, 16, 2015/08/20) */
I will be happy to provide the Revdex.com with a copy of the signed written contract if required.
Final Consumer Response /* (4200, 18, 2015/09/03) */
(The consumer indicated he/she DID NOT accept the response from the business.)
As I mentioned before, he told us that the violin was on back order during the contract period. Now that the contract period is over, he is saying we need to pay extra to get the replacement violin. If he is saying that he followed the contract, then his contract has a flaw since it didn't take the back order scenario into account. In a nut shell, we are taken advantage by this business which ultimately affected a young musician's interest in learning violin in a negative way.

Review: We rented from the Music Hut for 3 years for my daughters cello. The cello acquired a 3 inch scratch on it from normal wear and tear. This did not impact the sound of the instrument. We did show the scratch to the Music Hut but did not want my daughter to be without her cello so since it did not affect the sound we did not send it back to be fixed. We continued to rent and pay faithfully. At this point, we decided we wanted to buy an instrument for my daughter. We spoke with the Music hut Owner who have us quotes on cellos. We opted not to purchase from the Music Hut and turned the cello rental in August of 2014. We purchased an instrument from a private owner instead. After we told the Music Hut of our decision to not buy and to return the cello, we were given a bill of $187 for the repair of the scratch. When we called to inquire why this is not covered under the rental, we were told it was not normal wear and tear. This was clearly normal wear and tear that should be covered under rental. We refused to pay the bill based on the fact that it was normal wear and tear and that we faithfully payed 3 years of rentals amounting for more than $400. We just received a threatening letter in the mail stating that if we do not pay $408 then we the Music Hut will take the issue to the magistrate in 10 days.Desired Settlement: I would like the Music Hut to drop any claims that they might have stating we have not paid.

Dear Sirs,[redacted] received a 3/4 cello that was a full carved cello, an upgrade from a basic student cello, at the cost of regular cello rental. Total value of the entire outfit of the cello, wood bow, fiberglass case, and rosin was $3295.00. To the student taking lessons from a private teacher, a higher quality cello was given to enhance the sound and learning ability. The teacher commented how beautiful the instrument was. The instrument is in a hard $650.00 fiber glass case, limiting any flexibility when in there and protecting it from any damage. This 3/4 cello was brought in by [redacted] and her daughter. At that time, a crack was noted on the cello top. [redacted] insisted it was a just a scratch, even when shown the edges moved apart when pressed. Her daughter never spoke. When MUSIC HUT discussed this with the teacher, we were informed that a unit was installed on the bow to help teach proper finger placement and positioning. The unit was called a celloPhat. It was a large, decorative, semi hard, rubbery animal figure, easily held, and was attached to the bow, by the frog end, and was to be removed before closing the case. By forcing the case closed, the celloPhat, still on the bow, and placed improperly in the storage clips for the bow in the case top, (an area over the cello body), caused pressure on the top of the wood carved cello when closed, and a crack occurred...The teacher noted the child was very upset telling her about the crack. The cracked top decreases the value of the cello by 60%. A Scratch an in-strument is not an issue, cracks are.[redacted] continues to insist it was just a scratch. The estimated repair at a qualified strictly string repair shop was $380.00 + tax. We also paid $175. + tax to blend and feather in the color finish on top of the cello to make it presentable to rent.On 5/04/15, after receiving a letter from their representative, I called the teacher again, to verifiy the cracked top on the cello, and the cause. She again verified the CelloPhat unit was the cause of the crack on the wood carved cello.MUSIC HUT has been wrongfully accused of trying to collect for a minor scratch instead of a real crack, and the reason for the crack. Why would the child have been so upset ???? Customer has a problem with the truth. She doesn’t want to accept responsibility for the damage, and is not showing a good example to her daughter, who. knows.the,truth.Thank You,MUSIC HUT

Review: I have a disabled daughter who rented an instrument from Music Hut. My daughter no longer wanted to play said instrument. And I was informed to return it to the school and call Music Hut to make them aware it was to be picked up, which I did the first week of school in August. I was contacted on October 7 saying they didn't have current billing information and that the instrument was still not obtained by them because it was not placed in the office at school. I made a payment that day bc they said I owe from June of my recurring payment of 15$. I made a payment of 30$ that day and told them I did not agree that I should have to pay since August when it was returned to school bc they didn't notify me and I can not control the school if I'm not aware. I called the school the next day to make sure the instrument was placed in the office and returned a phone call to Music Hut so they knew it was there. I updated all of my information and the lady women in the office said she'd call me next month with my final bill information. On November 11 I was charged an amount of 51 dollars. I was never contacted. I was never sent a final bill. When I call that day I spoke w a man who agreed I should not have to pay from Oct 7 on bc I fixed the issue. He mentioned the instrument was not picked up from the school til November 10th and he would have sum1 call me because that woman I spoke to was not in. I received no call that day so I called back the following day. I spoke with Dorthy the owner. I explained to Dorthy my problem with the amount that was charged to my card Wo notifying me and she said the lady who deals with billing was out due to surgery. I explained I was suppose to recieve a call or bill from her and did not. Dorthy spoke to me with hostility the whole conversation. Even when I explained I could make payments but I couldn't make this large amount she declined and said she already has her money. She said I signed a contract and she can charge my acct any amount she pleases without contacting me especially if they is a late amount. This woman went on to say that I was a liar and the violin still was not in the office by October 20th and also that the gentleman I spoke to the day before never said I shouldn't have to pay from October 7th on atleast. After trying to discuss the issue and find a solution for a half hour Dorthy continued to interrupt me and made a statement that she'd refund 18 dollars for the last month of October it was put in the office and then hung up on me. I don't agree to these charges and I never got a bill or explained the nature of the charges. This business is highly inappropriate, disrespectful, and unprofessional.Desired Settlement: Known reputation of this business's actions and how they handle customer service problems. I've contacted my bank to dispute this charge and if it does not get settled through that if like a refund.
