This will acknowledge receipt of your recent Inquiry. Mutual of Enumclaw Insurance Company provides an insurance policy covering the residence of the complainant.

Mrs, [redacted] reported finding damage to her kitchen linoleum. We promptly inspected the residence and found evidence of a long term leak under the kitchen sink. The area under the sink showed various repairs had been made in the under sink area over the years, along with damage Indicative of long term leakage. We discussed the matter with Mrs. [redacted]'s plumber who confirmed the problem had been ongoing for a considerable time.

Unfortunately, the standard insurance policy does not cover all eventualities. The policy we write, which is fairly standard in the industry, is not intended as a home warranty. Our policy provides, in part,

However, we do not insure loss caused by constant or repeated seepage or leakage of water or steam over a period of weeks, Because of this wording in our contract we are unable to assist the complainant in this case, She was advised of our findings and conclusion at the time of the inspection and by a letter dated May 2.1 believe our position is correct. I am sorry that our policyholder's claim cannot be considered, but trust you understand that we must abide by the terms of the policy with all policyholders.

Dear Revdex.com,

I am a small business owner who was adversely affected by the wind storm that hit Spokane, Washington on November 16/17. I bought at building located at [redacted] in early October. I paid over $400 for a very thorough inspection of the building prior to purchase. (this inspection report was submitted along with my documents for your review.) My insurance company, Mutual of Enumclaw, did NOT. In fact they didn’t even come out to look at the building. They insured it sight unseen with no pre-existing exclusions. I was aware that the roof was noted that it should be inspected by a commercial roofer, but as were many other things on my inspection report. My inspector, who is licensed bonded and insured, did not note any pre-existing water damage or issue with the building what so ever. He inspected the attic of the building and the HVAC over the kitchen. Again, he did not note any pre-existing water damage or structural damage.

Our building sustained substantial damage from the storm which we immediately reported and mitigated on numerous occasions to the tune of nearly $2000. Our insurance company sent us an adjustor to assess the initial damage. He only wanted to repair a portion of the roof which was not an option for every roofer we called. Mutual of Enumclaw then recommended we get them multiple quotes from roofers explaining the cost and why they would not do a limited replacement/repair. We now have cycled through 3 adjusters and have no resolution. Mutual of Enumclaw threw about $5k at us to try to appease us but that amount does not even come close to fixing the nearly $25k in estimated damages. I informed them that I would not accept the 5k as a resolution as it will not cover the repairs. As we have been trying to obtain the 3 quotes we have done everything in our power to mitigate damage, but the damage now covers nearly 80% of the interior of the building. When the storm initially hit about 20% of the interior sustained some water damage as a part of the roof was ripped off. Now, ceiling tiles are falling out of the ceiling because they are so saturated with water as the temporary repairs have not been sufficient.

In their infinite wisdom Mutual of Enumclaw then decided to hire a structural engineering firm to inspect the building. They did this without discussing this with us and we only found out once the person from the firm contacted us to set up a visit. I found this to be unprofessional. I then met the person sent by the company who I found out was NOT a PE, in fact was only a ‘Roofing Specialist.’ He is no more qualified to inspect the roof than I am. Instead of spending money to help us make this right Mutual of Enumclaw is more interested in spending money on defending themselves from paying out on this claim. They went out of their way to send someone with NO credentials to our site and make a report that may or may not have any validity.

As we have reached a point of potential shut down from the health department because of the water falling into our kitchen and on top of our bar we pulled out of our personal accounts $12,000 to cover the full repair of the roof with a TPO material. The interior damage repair will start tomorrow and costs have grown exponentially as the water continued to infiltrate the building while we tried to mitigate damage and wait for a resolution from Mutual of Enumclaw.

The handling of our claim has been ABHORRENT! The broker agency, Payne West, insured this building for 2 years prior to us buying it. Again there were never any preclusions to policy and Mutual of Enumclaw did not do any DUE DILIGENCE by inspecting the building upon our purchase. Therefore, to tell us that we should have made extensive repairs to the roof upon purchase is unacceptable as they never saw the roof or did an inspection upon purchase like we did. The roof at the time of purchase was intact, not leaking, and did not show any evidence water damage to the interior.

We bought the building and paid our insurance premium thinking we would be covered in the event of a catastrophe like this, but instead have been faced with road blocks and a new person on our claim every couple weeks.

Our claim and concerns have been handled with neglect and disregard. We were told yet again this weekend to continue to ‘mitigate’ anything we could. I’m not quite sure what part of we already paid out several thousand waiting for a decision from Mutual of Enumclaw they don’t understand. We have been treated as a number, not as people and it is apparent our claim is not important.

Please help us resolve this. We are being taken advantage of and need assistance.

Mutual of Enumclaw has done nothing but DRAG their feet and pass us around from adjuster to adjuster. The service has been horrible. We performed as many emergency mitigating repairs as possible, only to sustain further damage while they wasted time. I want my claim resolved ASAP with no further delays. This is inexcusable and unacceptable.
