unethical, inconsiderate and dishonestComplainants states in his complaint that work started in May 11, and constantly lied about completion dateFalse: The work for footing and foundation did not start till early July and not May 11, as stated by the complainantsThe township permit was approved on June 19, ( D-1) and I received the permit on June 22, All though I signed the contract in Nov 14, The Complainants advised me not to start construction till they have the construction financing in place which they ultimately received in late June While the home was under construction the complainants made numerous and major changes to the plan such as installation of a sub-panel in the garage after the permit was issued and electrical work done, radiant heat in the kitchen floor after all the kitchen cabinets were installed which consequently delayed the installation of granite top in the kitchen which further stopped the plumbers to complete the kitchen plumbing work and all other work required to be done in successionchanging prestained wood floors for a wider raw wood after delivery and after partially installedThe raw wood needs extra steps for completion which are time consuming such as sanding, staining, first and second coats of polyurethaneThese changes and other changes as listed herewith combined with harsh winter weather delayed the construction of home significantlyComplainants states that they lived without a home for days and unable to secure any type of rentalFalse: The Complainants were unable to get a rental because they have two big dogs and nobody would rent them a house with their dogsFeeling sorry for them, I allowed them to rent my recently build square feet home in *** *** area for days out of days they claim they were homeless(D-2)I regret now because the dogs destroyed my house and I spend considerable amount of money to fix itIt is necessary to point out that in April of when I just started sheetrocking the houseThe complainants asked if I can finish the house by July since they wanted to put their existing home in the market in April/ May They need their home sold in order to get the financing for the new houseHowever, they received an offer substantially more than their asking price and the complainants could not refuse and accepted it with the closing date of May without factoring in the availability of a short term rent with big dogsThe Complainants also stated that they moved into the incomplete home in October 8, False: The house was complete with some punchlist item yet to be completedThe Complainants had a walk through with their realtor on october 6, at around 7pm in the evening to prepare a punchlistI received the punchlist at around 3pmon Friday the 7th. On Saturday the 8th at about 10am while I was working on the list, the realtor came over and informed me that the complainants wants me to cease work and leave the house with my toolsEven though I begged them to allow me to complete the punchlist so that they can move on Sunday instead of Saturday, they refused and I left the home with the tools (letter from the realtor( ***)On the same day at around pm they were secretly negotiating with a contractor named *** who was seen inspecting the house to give estimates for the incomplete items (***On October 11, 2016, the Complainants, through their Attorney (D-5) informed me to complete the punchlist of about items and allowed hours to complete which was not possibleOn or about Oct 21, 2016, the complainants personally called me and requested that I complete the work which I readily agreedWe completed most of the items except about minor itemsDuring this time we also worked outside the house to complete all engineering items in order to get a temporary Certificate of Occupancy which we received on December 7, The Complainants stated that after refinancing with the bank/mortgage, MVN Homes (Builder) notified that he will not complete the punchlist and proceeded to file a lienFalse: The building contract(D-6) stipulates that the builder to be paid in full after the issuance of either a temporary or Permanent Certificate of occupancyAfter the issuance of a temporary certificate, I demanded to be paid, the Complainants stated they cannot pay me till they close on their mortgage loanOn December 9, 2016, the complainants informed the realtor and myself that their mortgage company refused to close on the loan(D-7) with a temporary certificate of occupancy but they require a Permanent certificate of occupancyOn January 9, 2016, the Permanent certificate was issuedOnce a permanent certificate is issued, the home is deemed complete by the townshipNormally, a mortgage company takes a couple of days to close on the loan after the issuance of a final permanent C.OAfter many unanswered calls, they complainant finally returned my call on January 24, and admitted that they closed their loan a few days back but they did not take enough loan and are unable to pay me but reluctantly accepted to pay me $ out of $ 72,they owedUnconvinced, a title search was ordered when it was uncovered that the Complainant lied about the requirement of a permanent certificate of occupancy for closingThey actually had closed on their property on December 9, with a Temporary certificate with Advisors Mortgage corporation borrowing $ 430,(D-8)The Contract price was only $360,out of which I only received $ 302,of $360,owed,It is inconceivable that while the complainant on December 9, were informing all concerned that they are unable to close, they were actually closing on their mortgage loan at the same timeFor 6(six) weeks, they lied that they had not closed on their mortgage loan and were unable to pay the money they owedIn the meantime I was tormented constantly by the subcontractors who wanted their money for their workThe next day,January 25, 2017, the complainants vide their email (D-9) changed their position about the $payment and were unwilling to pay this amount but demanded that I complete the original punchlist items including new items added per their revised list (D-9) while he gathers the remaining payment together in weeksLater, on January 27,2017, the complainant through their realtor sent me another list with punchlist items(D-10) to completeDiscouraged and disheartened with their constant lies and deceit and also to safeguard the subcontractors and to ensure they get paidI applied to the Court with the “ Notice of unpaid balance and right to file lien” and simultaneously filed with “American Arbitration Association” to confirm the right to file a lien“ AAA” issued a judgment in my favour for $ 56,428.00(D-11) for the written contract and did not arbitrate on the money owed for work completed against amendment to the contract and the extras work completed amounting to $ 16,302.00(D-12)Once, the complainants received the court filing of “Notice of Unpaid balance and right to file lien”, they threatened me through their Attorney that unless I drop the “ right to file lien” they will sue me in Court for damages, court cost and attorney fees etc(D-13,D-14)At the same time,I believe, being enraged, the complainants sent me an expanded fictitious punchlist items of now items and threatened me that unless I complete these items by march 12,2017(D-15), they will file a claim with NJ home warranty programThe complainants are not aware that if there is any money owed to the builder, NJ Home warranty will not entertain any claimIt is quite difficult to fathom that the complainants moved into the new home illegally on October 8, 2016, about six months ago, had the audacity to hold over $72,of my money and still using intimidation and threats to scare me so I will give my right and just fade away and thereby enriching themselves of more than $72,As soon as the complainants were notified about the judgement by the Arbitrator and the levy of lien on their home, the complainants through their lawyer offered to pay $ 53,only (D-16) but were silent on their obligation to pay $ 16,(D-12) against the amendment to the contract and the extra work done that were ordered by them and completedI replied with a counter offer with a 10% discount if they are willing to pay the full amount they owe(D-17)I have yet to hear from themThe Complainant further stated that the disputed amount is $ 15,FALSE: The complainant falsely declared that the disputed amount is $15,while they also stated that the contract price is $ 360,minus the amount disbursed $ 305,which amounts to $ 53,per their own accountingSo where did they get this number of $15,000? Maybe, this is the amount they conceived in their mind that will pay to get rid of meNow, judge for yourself who is the unethical, inconsiderate and dishonest party hereAn agency like Revdex.com has been set up to safeguard the interest of the consumer, but unfortunately, there is no safety net for builders to safeguard their interest from unscrupulous consumer such as this one that I have to constantly fight and defendSadly I am still left with unpaid bills from suppliers and subcontractors who are harassing me every day to get paidI will be filing the lawsuit next week with the *** County Superior CourtVery truly yours, MAli K*** ***
