I have revie*ed the response made by the business in reference to complaint ID ***, and have determined that this proposed action *ould not resolve my complaint. For your reference, details of the offer I revie*ed appear belo*.My *ife and I tried several times to get into contact *ith them regarding a *alk through and to discuss the counter top*e *anted to make sure *e had them to to see the damage and *anted to do a *alk throughIt is to claim *e made no attempt but becomes a hard point to prove *ithout phone recordsThe fact remains is that *e *ere not informed via *ritten documentation *ithin days of termination of the damages, as stated in ORC 5321.16, and no return of any security deposit *as grantedAccording to that ORC, *e should have been given days notice in *riting of *hat the damages *ere and a *ork order*e have since filed a small claims court compliant against the company and *ill explain this in court in more detailI *as also informed by MrC*** that the amount exceeded the security deposit, but *as then emailed by the o*ner that in fact it had not, that there *as a dollar balance that *as leftI still to this day have not yet received the balance of the dollars*ith the email provided, you *ill see that they still had not checked about the counter top after plus days and then the other email sho*s the to fix *ithout *anting to return the remaining I even offered to split the difference, and that is *hy even in the email referenced by MrC***, I *as even *ondering if they *ere going to even send me a deposit back because I had not heard anything and they refused to do a *alk through of the apartment after *e left*e *ere just told to leave the keys and unless *e "trashed the place" according to MrC***, *e *ould get something back*e in fact did not trash the place, accidentally damaged the counter, and *as *illing to replaceIt should be noted that I received a quote to replace a counter top like the one in the apartment and it came back in *ell under dollars to repairMrPace has since threatened to keep even the dollars left because I am upset and questioned his honestly on keeping my money.

To *hom It May Concern: This is a response to a complaint made against M*P Investments by [redacted] (JD [redacted]). Mr. [redacted] states that several calls *ere made to myself (apartment manager) to speak to me about the damaged countertop. That is absolutely false. In fact, NO call *as made to...

me! I found out about the ruined countertop *hen I performed a "*alk thru" in the apartment after Mr. [redacted] and his *ife moved out. I, in fact, have an email from Mr, [redacted] that basically confirms this. He states in his FIRST email (copy attached) to rue asking if the deposit had been mailed or "if *e are even going to be expecting one". He also asks in that same email if *e had assessed the apartment for any possible damages. Logic *ould tell you that if he "supposedly" had tried several times to tell me about this, I *ould have kno*n before I *alked into the apartment for the "*alk thru"! Logic *ould also tell you that if the damage *as so small, then *hy *ould he *onder if they *ere even going to get any deposit back. It did take some time to get back to him due to the fact that the *ork (replacing the ENTIRE countertop) had to be performed. During the interim time, I could not even sho* the apartment to perspective renters. This caused a loss of rental income! Mr. [redacted] also stated in one of his emails that he had talked to "a fe* residents" that told him not to expect a deposit back because Mr. Pace never returns deposits. First, I *ould ask, if you talked to a current tenant, they *ould not have been in the position of requesting a deposit back. And second, I can absolutely state that that is not true. *e have returned many deposits hack, In fact, that is more the "norm" than *ithholding one. A deposit is only *ithheld if a tenant breaks their lease or leaves damages that *e must repair! I am sorry that Mr. [redacted] feels the *ay he does, but he *as treated fairly and *ith consideration, regarding his deposit. The materials and labor involved in replacing the entire countertop surpassed the amount of his deposit. Sincerely, Rick C[redacted]
