First the facts concerning *** *** contract with My Personal Trainer Incwhich was fully executed on February 15, *** chose a year contract so she would receive lower monthly payments and why the total sales price was After a few months, she had "buyers remorse" and sent me emails stating she had moved to *** *** She then claimed she had moved to *** and even had her friend falsify informationIf any of her moving claims had been proven TRUE, she would have been released from her contract with only $early termination fee dueI am in possession of MANY emails sent by *** containing information that was not trueI have the ENTIRE thread if you require additional evidenceHer contract started 2/15/and expires 2/15/ I will be happy to mail you a copy.( My fax /scanner isn't working) After her many excuses trying to cancel her contract with us, I did her a FAVOR by cutting her payments In HALFfrom $to $68.69, but made it clear to her that she would still owe the entire balance due on her contract, even after it expiresShe accepted that offerAccording to the records in *** *** she has paid Plus late fees of 3.43 ( which belongs to ***)That leaves a balance due of$2053.47. I will be more than happy to cancel her contract, however she would need to pay her original monthly payments, that are due to date, plus $early termination fee as there IS a facility wimiles of her home to service her $ ( contract Total) -- Total Paid Balance Due Prior to subtracting amount for time she does NOT wish to participate. ---- Subtracting time *** choses NOT to use the facility that is available to her Plus $early termination fee TOTAL DUE: $1054.35WILL settle for EXACTLY what is due for ONLY the time she used Contract provision of prepaid entertainment contracts.B.(8) Provide that if the seller relocates the facility twenty-five miles or more from the buyer's residence or closes the facility and a substantially similar facility that would accept the seller's obligation under the contract is not within twenty-five miles of the buyer's residence, the contract shall be proportionally divided by all of the days in which the facility was made available to the buyer as part of the contract offering, and the buyer shall be liable for payments for only that portion of the contract that can be attributed to the period prior to the seller's actual relocation or closing of the facility, exclusive of any period of time in which the facility was made available to the buyer free of charge as part of the contract offering, and the seller shall return to the buyer the amount paid in excess of the proportional amount;Record of payments to *** ***:03/10/2017$3.43Payment ReceivedLate FeeY03/10/2017$3.43Payment ReceivedLate FeeY03/10/2017$3.43Payment ReceivedLate FeeY03/10/2017$3.43Payment ReceivedLate FeeY03/10/2017$68.69Payment ReceivedPayment Taken at ClubY03/10/2017$68.69Payment ReceivedPayment Taken at ClubY02/28/2017$3.43Payment ReceivedLate FeeY02/28/2017$68.69Payment ReceivedPayment Taken at ClubY02/16/2017$68.69Payment ReceivedPayment Taken at ClubY12/01/2016$68.69Payment ReceivedPayment Taken at ClubY11/08/2016$68.69Payment ReceivedPayment Taken at ClubY09/15/2016$68.69Payment ReceivedPayment Taken at ClubY08/20/2016$68.69Payment ReceivedPayment Taken at ClubY07/20/2016$282.23Refund$137.3903/29/2016Payment ReceivedDown PaymentY03/29/2016$137.39Payment ReceivedPayment Processed by eFitN02/28/2016$137.39Payment ReceivedPayment Processed by eFitN02/15/2016$272.64Payment ReceivedDown Payment

This is a reply to the complaint filed b[redacted] against the Canton studio which closed.   The law concerning pre-paid entertainment contracts, including fitness centers, dance studios, etc. do not require a refund or any payments to be stopped as long as there is a substantially...

similar facility with-in 25 miles of the customers. There is a current franchise location located at 3463 Massillon Rd. Uniontown, OH. 44685.  This is 11 miles from the Canton location, and 17 miles from [redacted] home.1345.42 Contract provision of prepaid entertainment contracts.B.(8) Provide that if the seller relocates the facility twenty-five miles or more from the buyer's residence or closes the facility and a substantially similar facility that would accept the seller's obligation under the contract is not within twenty-five miles of the buyer's residence, the contract shall be proportionally divided by all of the days in which the facility was made available to the buyer as part of the contract offering, and the buyer shall be liable for payments for only that portion of the contract that can be attributed to the period prior to the seller's actual relocation or closing of the facility, exclusive of any period of time in which the facility was made available to the buyer free of charge as part of the contract offering, and the seller shall return to the buyer the amount paid in excess of the proportional amount;I apologize to [redacted] and any other clients this may be inconvenienced.[redacted]/Client Services

This response is concerning complaint  [redacted]. For the protection of the client's privacy, as the complaints and our response may be placed online I  will refer to him as [redacted] enrolled December 1, 2015.  He signed a 2 year contract.   He was absolutely not coerced. The...

contract is not lengthy, and was signed by [redacted], in 3 places. [redacted] was making great progress, as shown by his public posts on social media. His monthly payments were lowered, approximately $20 per month. As far as his "results" are concerned, he was "very pleased" with his results, until he joined another facility totally against our direction. We produce awesome results with working out just 20 minutes twice per week. Our prices our incredible, as well, as we charge less per month, than some trainers charge per session. All of our programs that are not pre-paid are handled by [redacted] Financial. They do make phone calls, and or text, send emails, or use any legal means possible to collect when an account is delinquent. [redacted] was told, by the manager, at this location, that contracts are not cancelable, unless, of course client is disabled or have moved 25 miles or more from any location. I request this case be closed, as we have resolved it amicably with [redacted]. He told the manager that he will contact you to have this case closed.  If he doesn't follow through with contacting you, I will fax social media evidence supporting our case.Thank you,[redacted]ient Services

Dear [redacted],The manager of the Canton studio, Tina F[redacted], AND one of our trainers have assured me they were present when [redacted] stopped in the studio.  [redacted] is correct when she said it is not Tina's business where she works, and we apologize for asking. She, however, was aware of studio hours when she enrolled. I'm sorry she cannot find the time to work-out. If her residence has changed, she will need to request moving documents by [email protected] by email, or mail a request for moving documents to:My Personal Trainer, Inc. Suite #310, North Canton, Ohio, 44720-3333. I have no idea what [redacted] is referring to in "seeing results in 3 days. "This is preposterous! It takes hard work and dedication over a period of months, NOTDAYS!!  We are not a "quick fix, so I can attend a wedding then cancel" type of facility, which has occured in this instance. We do not now. nor ever, have guaranteed results, nor have offered cancellations, other than those mandated by the laws of the State of Ohio which include, death, moving 25 miles from ANYsimilar facility, or being rendered permanentlydisabled. [redacted] was fully aware of our hours when she enrolled. Our program was fully explained before she enrolled and she has full cancellation rights, but only as provided by the state of Ohio. She may wish to contact the Attorney General to submit a request to change the laws concerning Pre-Paid Entertainment Contracts, if she choses to do so.These laws have been in place for years and govern all gyms, martial arts, dance studios, palates, yoga studios and personal training studios, and other service businesses. We do not write the laws, only abide by them. All our trainers are extremely knowledgeable, caring and accommodating.  [redacted] may call the studio to make an appointment @ 330-492-6800 to continue her program until her request for cancellation is reviewed and all required documents are received. Any fees paid will be pro-rated to the date of her move.  She will be treated, as all our clients are, in a professional, helpful and friendly manner.Thank you,Sandy StoneClient Services

I will be having my attorney contract this company. It seems to me that it is still only about MONEY! Each time I reached out to the company I gave them a heads up of times I was planning on relocating due to my boyfriend getting calls for different [redacted] teams, in which never worked out for him which is why I stayed in Canton Ohio. Nor do I think it is their business for my reasonings of not being. So for her to say she did me a "favor" is so ridiculous. She is still trying to collect additional monies. I have NO ISSUE paying for my time I used the canton studio. A studio that is 25 miles away from my home which is about 25-30 mins, I will not be making that drive. I do not have any late fees because I paid the studio at the canton location on time every month. [redacted] who was the trainer took my payments. The studio was ALSO supposed to take money off of my contract due to referring someone and that NEVER happened. So again another LIE! Outside of May payment, I will not make any additional payments. I also have every communication from [redacted] and her husband [redacted] and their rude ways of communicating with people. Not to mention their son [redacted] who is a trainer at the green studio, so rude and calls customers the "B" word when things arent his way!

I am not sure why they insist that Tina was there when I went in to talk to someone about canceling- because she was not. If she was there when I stopped she would not have had any reason to CALL me. Another trainer was there yes- but not Tina and they could not answer my questions about canceling. If Tina was there then why did another trainer take my phone number down with a message to call me if Tina was there. I would like proof that proves Tina was there. Until then the dishonesty of this company speaks for itself and there is no way that I will return or stand by ideally if friends or family mentions becoming a member here. I cannot believe that you would still force someone to remain in contract after you have already lied about the whereabouts of your employees. And the 3 days that I was referring to was the cancellation policy that you can cancel in 3 days- but who is ever going to see results and know that they are happy with the gym in that short of time.  I will not be continuing my workouts here, as the whole company now has a very poor ethical standard impression on me, and I will be sure to tell all my friends and family about my terrible experience.

My apologies to Ki[redacted].  This was totally my fault.  I had her account mixed up with [redacted]  I will submit a refund request ASAP.  We would like to offer [redacted] one month free of charge for this aggravation.Thank you,[redacted]e/Client Services
