The patient is correct, per the signed agreement (see attachment, signed in 11/04/2010) we did require a 30-day written notice plus two months of services when cancelling an agreement at that time We accept cancellation notices in written form, submitted in person or via certified mail We do not have a cancellation on file for this patient, nor are there any notes about the patient mentioning submitting a cancellation prior to this complaint (years later) If it was mailed and they have a certified letter confirmation number then we could track when it should have been delivered and could honor the date it was mailed as the cancellation date.The patient was last scheduled for services in June of We do want to work with the patient and could honor the month of June as the last month for the cancellation We could then waive July, August, September, and October 2011, but the patient would still have a balance and would need to work out a payment plan with our collections agency Unfortunately since we did make several attempts to reach the patient via telephone, email, and mail from December until October regarding decline payments and the past due account, we are not able to remove the patient from collections

The patient signed a discounted 18 month commitment
agreement on October 18, 2012.  The
Patient did receive service through March 2013 (5 months out of 18 month
discounted agreement).  Starting November
2012, payments on the account began to be made late. ...

Payment arrangements were made for the past
due balance that accrued but those agreements were not kept.  We would be unable to waive the full balance
since payments have not been made for all of the services received.  A written cancellation was not received, but
we would be happy to negotiate a settlement with the patient.

Review: I have [redacted] and submitted documentation from my doctor to discontinue my treatment. The company continues to tell me they cannot find my paperwork and keep asking me to resubmit but continue to charge my card for services I have not recieved. I had to cancel my card and now they are sending me past due notification instead of processing my cancellation.Desired Settlement: I want them to cancel my contract and provide me my refund for the May and June 2013.

Doctor does not have any record of **. [redacted] submitting medical documentation

to be reviewed for a possible medical cancellation. Any medical documentation submitted when a

patient has a medical reason for leaving the program would be; scanned into our

electronic system, given to a My Weight Doctor physician for review, a

follow-up/exit appointment scheduled with the patient and then a decision would

be made as to whether the patient would be cancelled or if they could continue

but their treatment would change.

Afterwards the physical documentation would be placed in the patients

chart and the account would be notated by the Physician and Clinic Manager. We have been in contact with **. [redacted] this

week and she said she will have the documents faxed over to us. Once received, a My Weight Doctor physician will

review the documentation. At that time,

we will be able to provide you with more information.

Response:

Over the past several months there have been some

miscommunication and/or misunderstandings between the patient and the

company. After thoroughly reviewing the

patients account, notes, phone calls, and emails, we are going to honor the patients word

that a cancellation was submitted in April 2013. Though we do not have record of a

cancellation until October 2013, we will waive all charges after June 2013

(honoring the two month cancellation).

By waiving those charges, the patient will no longer have a balance and

will be removed from collections.

Review: I enrolled into a contract with My Weight Doctor. I had several issues with this service. I went to the ER with side effects. I had to leave my work. I called and spoke to the office staff and told them I needed to cancel. I informed her that my personal Physician had instructed me not to take anything that was not prescribed by her. My Weight Dr. overmedicated me. I had hypertension. I almost had a heart attack. The office staff at My Weight Dr. told me to come into the office. I told the girl at the front desk I had already seen an Emergency Room Dr. and my personal primary care Physician and I didn't need to see the My Weight Dr. Physician because of the instructions to not take any other medications prescribed by them. I asked [redacted] to cancel my contract that I did not want to be billed any further for My Weight Loss Dr. services. She said that they would not cancel this. I asked to place it on HOLD and they would not place it on hold either. I had to pay $600 for my ER visit and almost $500 for their contract. Not to mention my sick days at work and the severe suffering of the side effects in which I do not want to mention here b/c they are so embarrassing.

I was continually billed for an additional 2 months of the contract even though their contract states that the only way out of the contract legally was from a personal physician. My primary care Dr. had given me a letter with all the facts and details and My Weight Dr. still demanded to see my personal ER records even though this is a HIPPAA violation of personal health. I tried to resolve this issue with them for months and months and they would not offer me a full refund. I've called and called to speak with the Dr. at my Weight Dr. [redacted] but this company fields all of her calls.

Bottom line this company doesn't care if you live or die. They are only concerned with profit. Health is not their concern. Their contracts are bogus.Desired Settlement: I expect a moral and ethical company to refund a consumer that is not able to participate in a program. Character is how you treat someone when they have nothing to offer you. Integrity is missing as a backbone of this company they have no spine like a jellyfish. They literally steal your money like a common thief. I was robbed. There is no reason to continue to bill someone when they are not receiving their goods or services. Its the same as highway robbery.

Patient [redacted] signed a Discount Service Agreement on February 23, 2013 for our Maintenance Weight Loss Plan at $224.99 per month. At that same time, patient [redacted] put in a written notice that she only wished to be on the program for three months (2/23/13 – 5/23/13). On February 23rd, patient [redacted] received two weeks of medications and an injection. Returned to her scheduled appointment on March 8, 2013 to meet with the physician and receive two weeks of medications. On March 13, 2013 Patient contacted My Weight Doctor Manager [redacted] stating that she was unsure about that the medications were working for her. [redacted] instructed patient [redacted] to schedule an appointment with a My Weight Doctor physician as soon as possible to make sure she is ok and rule out any issues. Patient [redacted] refused and stated that she was at work and would call back. My Weight Doctor did not hear back from patient [redacted] until April 22nd, at this time the patient asked about discontinuing her plan and inquired about the billing. [redacted] responded to the email the same day, sending the patient a copy of her initial paperwork when she signed up for three months(See attached) and reminded her of the three charge dates (2/23, 3/23 & 4/23 and plan expire date of 5/23/13). In May My Weight Doctor received chargeback requests for the March and April payments totaling $449.98, these requests were reversed in My Weight Doctor’s honor. There was no response from patient [redacted] herself until June 26th. When we heard from the patient in June, she requested two months of medications or a refund. Since it was after the plan expires date (plan benefit period ended) receiving medications was not an option, not to mention the patient had concerns about the medications just three months prior. In accordance with out ‘non-use of services clause’ (See DSA attached), the patient would not be entitled to a refund or services. The patient was however offered; B-12 and/or lipotropic injections in the amount of her request, a credit towards a future plan or a liposonix treatment, or a $200 settlement check. Patient [redacted] did not wish to receive any of these options.

July 5th was the first patient [redacted] mentioned a doctor’s note regarding her discontinuing services in March. We have not received this documentation. July 7th patient [redacted] mentioned having ER documentation. Patient refused to provide a copy to My Weight Doctor. Since the patient did not come back into the office in March and refused to provide medical documentation regarding a medical issue, we were unable to look into an immediate medical cancellation. Had the patient returned in March, provided proper documentation and/or our physician had reason to believe our program was not a good fit, patient [redacted] may have been placed on hold or immediately cancelled without further charges. On July 25th during the last email correspondences between My Weight Doctor and patient Griffin, the patient was asked if she was able to send over copies of any of her medical documentation (either the doctor’s note or ER paperwork that was mentioned) so that we could re-open the request and see if there was more we could do for her. Again, the patient refused and stated that her attorney would contact us.

I am rejecting this response because:

1) Non-use clause in contract-- Please see the contract it does NOT apply when your personal physician does NOT allow you to take the medicines as prescribed by my weight Dr.

My primary care Physician instructed My Weight Dr that I was not to take any other medicines! So did the ER Dr. I had my Primary Care Physician fax the information and they conveniently never "received" it.

Review: On the My Weight Doctor website it states: “The My Weight Doctor® program has been researched since 1990 and involves the use of FDA approved medications. These are fully endorsed medications. Most people have little or no side effects. They are not amphetamines and are generally non-addictive. They actually enhance the body's natural inclination to be thin and healthy…”

A few weeks ago, I set out to find a method to prevent any potential weight gain from quitting smoking. I read statements on the My Weight Doctor website (such as the one above) that led me to believe I was receiving a natural weight prevention/loss plan. However, I later learned that I was prescribed a medication, Phentermine, that contradicts what My Weight Loss Doctor has on its website and did not fall in-line with my request to find a healthy way to prevent weight gain. Phentermine is a classified as a Schedule IV controlled substance under the Controlled Substances Act….and is an amphetamine that has addictive potential. I am now left to question the credentials of any doctor or practice willing to prescribe this pill to a patient that does not meet the qualifications of the FDA and the drug manufacturer. Not only was my health put at risk, but it was against my request of healthy weight loss methods.

The prescription manufacturer and the FDA recommend: “Prescription diet pills are intended for use by people whose BMI exceeds 30 and are therefore classed as obese. People that have a BMI of 27 or greater and that also suffer from associated risk factors such as hypertension, diabetes or hyperlipidemia are also often deemed suitable candidates for phentermine.”

It is true that prescription diet pills, like all other medications can cause side effects, however when someone is prescribed a diet pill such as phentermine it is because the doctor feels that the benefits of losing weight to reach a healthy BMI outweigh the possible side effects. I took the medication unaware of its side effects as it was not described properly by your facility. I developed heart palpitations. My health was put at risk due to your doctor not being able to follow FDA guidelines or controlled substance laws set by the ** Medical Board. I AM AT A HEALTHY BMI. I AM A 125 POUND FEMALE THAT STANDS AT 5’5!!! I SHOULD NEVER HAVE BEEN PRESCRIBED THE MEDICATION PHENTERMINE.

I asked for a refund of the monthly program fee that has already been paid for the fraudulent services I received.
