Our law firm was retained on November 15, 2013 by TD Bank USA, N.A. to collect on a Target credit card account issued to Complainant. Complainant claims in her complaint that she does not know who is garnishing her and why she is being...

garnished, and that our firm is not returning her phone calls.
From the placement of this file in 2013 to the filing of the lawsuit and the garnishment, our office has made numerous attempts to contact Complainant to resolve this matter. Complainant was served with the Summons and Complaint, which explained that the suit was brought on behalf of TD Bank on Complainant's Target credit card account, and with the Earnings Garnishment. On Friday, October 9, 2015, Complainant's husband phoned our office to discuss the garnishment. A call agent answered all of his questions regarding the garnishment. During that call, Complainant's husband was placed on hold twice, for a total hold time of 1 minute and 42 seconds. He was not on hold for 15 minutes as alleged by Complainant. Following our telephone conversation with Complainant's husband on 10/9/2015, our firm phoned Complainant and left voice mail messages on her cell phone on 10/15, 10/16 and 10/20. The most recent phone call to Complainant was made after business hours. Our phone records do not show that Complainant has returned any of those voice mail messages. If Complainant would like to discuss this account further, she should contact our office between 8:00 AM and 5:00 PM. If she is unable to contact our office during those hours, she should leave a voice mail message and we will return her call between 5:00 PM and 6:00 PM.
