On 2/8/2015 4:22am Myers Towing was dispatched to a fatality accident by the Tracy Police Department. As requested by the Tracy Police Department Myers Towing, INC responded to 1775 W. Lowell Avenue for an Evidence Tow Request and Impound by the Police Department. The Vehicle (2003 Honda Odyssey)...

had severe front end damage from major impact to a tree. Vehicle was facing the South Bound direction blocking the entire street that runs in the East/West direction. Vehicle was carefully loaded onto car carrier tow truck and secured while major debris and fluid cleanup ensued. Vehicle was delivered to the City of Tracy Corporation yard to undergo a fatality collision investigation. Towing vehicle and equipment was cleaned and placed into service ready condition. The service performed was completed at 7:22am. Total work hours for the initial services performed (3) hours, hourly rate for service is $200 per hour. On 2/11/2015 9:45am the Tracy Police Department contacted Myers Towing to retrieve the vehicle from the City of Tracy Corporation Yard to return to our storage facility. Myers Towing picked up the vehicle, and delivered it to our secure storage facility. The service performed was completed at 11:30am for a total of 1.75 hours, hourly rate for service is $200 per hour. The vehicle was placed into our storage facility on 2/11/2015. Our daily storage rate is $60 per calendar day. Total towing/recovery/cleanup/transport fee was 4.75 hours at $200 totaled $950. The registered owner of the vehicle came to our office 24494 S. MacArthur Drive Tracy CA 95376 on 2/13/2015. On that day the bill included (3) days of storage 3 x $60 =$180 and the towing/recovery/cleanup/transport fee of $950 totaling $1,130. The registered owner immediately requested a discount, and as a judgement call sympathizing with the situation decided to reduce the bill to $797.50 in lieu of the original amount of $1,130. The registered owner paid via discover card and requested that we release the vehicle to a charity auction. Myers Towing, INC has been in business since 1986 and over the past 29 years when a vehicle is paid for it is also picked up and removed from our storage facility. Failure to remove the vehicle immediately from the date of payment results in incurring additional storage charges per day as the vehicle is still left in our possession, care, custody, and control. In lieu of incurring additional storage charges, the owner has the ability to surrender the pink slip and sign over a bill of sale to Myers Towing, INC transferring ownership in the vehicle so we may dispose of the vehicle. The registered owner requested that the vehicle be donated to a Charity and again, an exception was made given the circumstances to hold the vehicle an additional day without charge for the charity to pickup the vehicle. The registered owner handed over the signed pink slip to give to the charity when they come to pickup the vehicle. I informed the registered the owner that our offices are closed on Saturdays when the auction was going to pickup the vehicle but again, were decided to waive the after hours release fee of $100, and additional storage of $60. On Saturday 2/14/2015 8:39 am our dispatch center was called stating that the auction company would be there within an hour to pickup the vehicle. I arrived at the Tracy location at 9:30am and waited until 10:30 am and the driver never showed up. I left the office and came back at 1:39pm to release another vehicle from our facility. I called the charity auction company to ask when the driver would arrive to pickup the vehicle and was told he already showed up and left. I explained to our dispatcher that our office was closed on the weekends and she was not aware that we were a business location. I told her that our offices will be open Monday-Friday and we can arrange a pickup then and she was going to contact to registered owner to get the correct paperwork needed to pickup the vehicle. Again, I offered to waive the daily storage rate of $60 to assist in getting the vehicle removed from our property. The vehicle was not picked that week or the following week and our office received no contact from the registered owner of the vehicle or the charity auction company. Storage was not charged to the registered owner of the vehicle from the dates of 2/14/2015 to 3/5/2015 a total of (20) days of $60 per day totaling another discount of $1,200. On 3/6/2015 Myers Towing, INC placed a California Lien Sale as allowed by Civil Code 3072 on the vehicle that was abandoned by the registered owner in our storage facility. We are only billing the registered owner from 3/9/2015 to 4/09/2015 when the vehicle will be disposed at a reduced rate of $30 per day in lieu of $60 per day, again offering another discount. Mr. [redacted] needs to pay the remaining balance in full up to the current day and remove the vehicle from our storage facility to prevent him from being sued by Myers Towing, INC. So far we have discounted the fees in excess of over $2,500 in towing, storage, and after hour fees. We feel that we have given Mr. [redacted] ample time and financial relief to arrange for pickup of his vehicle while waiving storage and other fees. Mr. [redacted] instead has called our offices and rudely insulted our staff and that will not be tolerated. If the vehicle is not paid for and removed from our property we will be obligated to sue Mr. [redacted] in small claims court and be liable for all towing, storage, cleanup, disposition, and court fees related to this vehicle.

Review: This complaint is regarding my Honda Odyssey which was towed by Myers towing on February 8th due to my sons accident in which he passed away. On the 13th of February I went to Myers Tow and paid the amount of $795 for towing and storage and gave them all the paperwork to release the vehicle to Charity called Kars for kids. There office is closed on Saturday but [redacted] who I paid $795 told me to call ###-###-#### and somebody will be at the office to have the car picked. I was at my sons funeral. I still managed to call at least 5 times at there 1185 number. The tow truck driver was there to pick up the vehicle but no body was there at 11:00 AM to open the doors. This I come to know about a week after when Kars for Kids called me that there was nobody at the office so the cars was not picked up. I started calling Billy numerous times. He did not answer the phone. I called on weekends at 1185 number. Somebody named Rick picked up the phone every single time and it went nowhere. Then Last week Monday the March 2nd 2015, I went to there Tracy location where the car is actually stored and nobody was there during there business hours. So I called there Modesto location at ###-###-#### and spoke with a lady. I explained her the situation and asked her to have [redacted] give me a call regarding my vehicle. A week passed by and I never received any call from Billy. I can prove how many times I tried to get hold of [redacted] and not even once he returned my phone call. Today I received "Notice Of Pending Lien Sale For Vehicle Valued $400 Or Less". I called there office again and spoke with a person named "James". He refused to give me his last name. According him, besides all my explanations, "Legally the storage fee of $850 can not be waved. I kept explaining that you people never called me or even returned my numerous phone calls. Now how can you legally hold me responsible for this amount? I had given my phone number to [redacted]. He should have contacted me or returned my phone calls.Desired Settlement: I would like the storage fee of $850 which is incurred till today to be waived and the vehicle to be donated to "Kars for Kids" instead of these crooks. I don't need this vehicle but these people are running a very bad business.

Review: My car was towed to Myers Towing and while in there custody 2 amps and 2 12" speakers w/box was stolen from it. Myers refuses to give me any insurance information for me to file a claim on the stolen property. apon asking for the information I was cussed at and hung up on twice.Desired Settlement: The portion of equipment stolen is aprox. $1500.00. If Myers does not wish to turn this into insurance than it is up to them to cover the loss.

On January 12th 2014 the Ripon Police Department requested Myers Towing to pick up a 1999 Honda Civic and bring it back to our facility for storage. The registered owner came to our facility on January 15th 2014 to pickup his personal belongings out of the vehicle. The Vehicle was at our storage facility until February 1st 2014 when it was picked up by the registered owner. At that time, the owner of the vehicle informed Myers Towing that his speaker, box, and amplifier for his stereo was missing from his vehicle and that he wanted a full refund for the towing and storage services provided. The report given to us by the Police Department shows that the vehicle had a Radio in the vehicle when we took possession of it, but has no mention of a speaker box, amplifier, or other equipment related to the stereo system. After the owner of the vehicle left our property he called within a matter of a few days claiming that when his speaker, box, and amplifier was allegedly removed from his vehicle that it caused his radio/compact disk receiver to short circuit and now it does not work although that allegation was never proven. He demanded a monetary sum for the speaker, box, amplifier, and radio. We asked him the approximate value he claimed those items were worth and he said that his friend owned a stereo shop that he purchased the equipment from and said a few thousand dollars. We requested that he provide receipts for the equipment and he said he would have to call his friend and the stereo shop and that he was unaware if he could provide them or not. A few days later the registered owner came to our facility with two hand written receipts from a stereo shop for purchases dated back to 2010 in the amount of $2,200. The vehicle was originally valued by the Police Department between $301-$4,000 and his claim for $2,200 would deem appropriate to turn over to our company insurance carrier. We have requested his insurance information showing the value he had his vehicle stereo equipment insured for and he claimed that he did not have any insurance in his vehicle. At that time we told him we could not assist him after he has called and harassed our employees.

Review: My Vehicle was stolen, and it was found by the local sheriff and towed by Myers Towing On Sunday the 3rd of July 5:25pm. I have been been charged $345 for it being towed to their yard, which I was charged for three days of storage fees equaling $309.Vehicle was only stored there for two nights and one whole day(which was a legal holiday), was claimed by me with in one hour of there opening time. I do not believe I should pay the whole of the storage fees. Response:

Myers Towing, INC is responding to a complaint regarding the number of days charged for a vehicle that was dispatched by the Stanislaus County Sheriff's Department towed by our firm to our storage yard and stored for a period of three days. On July 3rd approximately 4:52pm Myers Towing received a request from the Stanislaus County Sheriff's Department to store a stolen vehicle that has been recovered. The Stanislaus County Sheriff's Department is responsible to notify the registered and or legal owner at the time of recovery that their vehicle may be picked up by them. If the registered or legal owner does not answer their call, is unable to respond within a reasonable time, or the vehicle is unable to be safely operated they request a towing company from a rotating list of approved firms. The Vehicle was stored at our [redacted] facility on July 3rd 2016 approximately 5:51pm. According to California Civil Code 3068.1(a): Every person has a lien dependent upon possession for the compensation to which the person is legally entitled for towing, storage, or labor associated with recovery or load salvage of any vehicle subject to registration that has been authorized to be removed by a public agency, a private property owner pursuant to Section 22658 of the Vehicle Code, or a lessee, operator, or registered owner of the vehicle. The lien is deemed to arise on the date of possession of the vehicle. Possession is deemed to arise when the vehicle is removed and is in transit, or when vehicle recovery operations or load salvage operations have begun. A person seeking to enforce a lien for the storage and safekeeping of a vehicle shall impose no charge exceeding that for one day of storage if, 24 hours or less after the vehicle is placed in storage, the vehicle is released. If the release is made more than 24 hours after the vehicle is placed in storage, charges may be imposed on a full-calendar-day basis for each day, or part thereof, that the vehicle is in storage. If a request to release the vehicle is made and the appropriate fees are tendered and documentation establishing that the person requesting release is entitled to possession of the vehicle, or is the owner's insurance representative, is presented within the initial 24 hours of storage, and the storage facility fails to comply with the request to release the vehicle or is not open for business during normal business hours, then only one day's charge may be required to be paid until after the first business day. A "business day" is any day in which the lienholder is open for business to the public for at least eight hours. If the request is made more than 24 hours after the vehicle is placed in storage, charges may be imposed on a full-calendar-day basis for each day, or part thereof, that the vehicle is in storage. The important aspect of the law states: A person seeking to enforce a lien for the storage and safekeeping of a vehicle shall impose no charge exceeding that for one day of storage if, 24 hours or less after the vehicle is placed in storage, the vehicle is released. If the release is made more than 24 hours after the vehicle is placed in storage, charges may be imposed on a full-calendar-day basis for each day, or part thereof, that the vehicle is in storage. Therefore, once the vehicle has been stored at our facility we charge one day ($103) of storage for the first 24 hours (Up to July 4th 2016 5:51pm) Following this 24 hour time, we charge a FULL-CALENDAR-DAY per day the vehicle is in our possession. The claimant did state that the vehicle was picked up on July 5th 2016 THREE CALENDAR DAYS later (starting at 12:00am each day) Although our business hours are Monday-Friday 8am-5pm excluding major Holidays (such as July 4th), our facilities are able to release vehicles upon full payment and including an additional "gate fee" within 30 minutes of request at our facility in order to reduce daily storage charges on weekends and holidays. The claimant chose to come to our office three days into the storage of the vehicle which was charged at our rate of $103 per day. July 3rd 2016 Tow Fee + Storage Day 1 July 4th 2016 Storage Day 2 July 5th 2016 Storage Day 3 The claimant was not charged as every other person who picks up a vehicle that has been stored over the weekend that chooses to claim their vehicle on our following opening day.Sent on: [redacted]
