Hello Ms *** did in fact contact us to terminate her service on 3/19/ We responded 3/20/acknowledge her email We informed her that the initial order, which is a "FREE TRIAL" had not shipped yet and was there something we could due to assist She responded same
day on 3/20/indicating she was concerned her order had not yet shipped We responded 3/20/that according to our policy, product information on the website, and details during the check out period - We are a subscription service and only ship orders on specific days of the month All new subscriptions may take up to days to ship Her order would ship within that time frameWe asked to confirm cancelling her subscription at that point because she expressed it was due to shipping Her order shipped 3/22/per our terms and regular ship days which are Wednesdays for new orders.Ms *** did not respond again until 3/31/ This was a week after she received the free trial order We notified her that our service is a subscription service with a month commitment If they cancel within days, no future charges would be incurred We informed her that our terms of service, located at www.mymelanine.com/terms.html states we may charge up to $(in this case) to terminate the service if it is cancelled BEFORE the free trial is received and evaluated, but after the order was processed We offer a FREE TRIAL not free product Receive the free trial AFTER the cancellation is a violation of our terms of agreement which she agreed to in making the purchase and subject to a termination fee up to the MSRP of the initial free order's value Which was $ In subsequent emails, Ms *** indicated that she had no intentions of continuing her order beyond the free trial personal and personal and financial reasons Our terms explicitly state that an order as a result of fraud or bad faith (as determined exclusively by Melanine) would not be subject to terminating their service early without paying the early termination fee Again in this case $ We do not ship free product We ship free trials Canceling before the trial has been received, but after processed, or in admitted bad faith, will result in the termination fee being charged to the card on file We notified her that as a result of her admitted intent to cancel due to "financial and personal reasons" even before purchasing, and confirmed by cancelling after the processing of the free trial and before it was received was a "Bad Faith" purchase as she had no intention of actually evaluating the product, just wanting something for free This violated our terms of agreement for a free trial.Melanine rarely enforces this termination fee except in cases of fraud or bad faith which we believe was clearly an intentional attempt to exploit Melanine for free product It is our belief that Ms *** made this Free Trial purchase in bad faith intentionally to defraud Melanine for free product.We offered Ms *** a options to resolve this issue which included: returning UNUSED the Trial products, which were received after she requested its cancellation, at our expense of shipping for a refund of the shipping on the free trial- $ or she may cancel now and we would continue with the charge already processed for $on her card Additional options included continuing with her commitment unchanged, or allowing her to continue one more month applying the fee toward that month and then cancelling before the 3rd month billed That would then give her product for the $instead of a fee.She declined all offers and demanded a full refund of all charges, including the shipping paid on the free trial she received, used, and refused to return for the refund.Despite all of this communication and her intentional bad faith purchase, we agreed to return her money to her on 4/1/and she was notified of such same day This was the same day we had numerous communications about her intentional bad faith purchase and options to resolve the issue Seeing as we gave her a full refund on 4/1/at 10:54am, her demands were met and there is no further actions we can take She has been made whole Our polices are in place to protect us specifically against people seeking free product and having no intention of honestly evaluating the service for determination of whether or not to continue beyond the free trial Her intentional bad faith purchase falls under this policy and is exactly what the policy was designed for She agreed to this policy at the time of purchase Although we were in full right to collect the $9.99, we refunded her money back, same day

Ms. [redacted] placed her initial order for our 10 item box on 2/9/2017.  After we informed her that the 10 item box was not eligible for the free trial, we offered for her to receive a discount of $9.99 for that purchase with the understanding that she would still be responsible for the remaining...

term as that item was not eligible for a free term.  By accepting the terms, in the check out process and confirmed via a phone conversation, Ms. [redacted] was aware that this was a 12 month subscription.  On 2/21/2017, Ms [redacted] contacted customer service expressing concern over the time it was ta[redacted] to ship.  It shipped shortly after.  But as a good faith offer, we credited her account $17.99 to cover the next months subscription at no cost (including covering shipping). Ms [redacted] received two packages, first on 3/1/2017 (discounted $9.99), and then the second one (free) on 3/24/2017.  Her next order became due for payment on 4/10/2107.  7 days later, on 4/17/2017, Ms [redacted] contacted customer service requesting to cancel her subscription.  This is more than 60 days after the initial purchase.  Further, she was aware that she was not eligible for a free trial purchasing her subscription of a 10 item box.  Only the 5 item box was eligible for the free trial.    She accepted such.When she contacted us on 4/17/2017, we informed Ms [redacted] that the subscription was for a 12 month commitment and that it could not be canceled without paying an early termination fee.  This fee is $60.00 plus any outstanding balance.  We informed Ms. [redacted] since the contract could not be cancelled, she could continue her subscription or pay the past due and early termination fee.  This total is approx. $78.00.  Ms. [redacted] was made aware, as she was during her purchase in the check out process, that it is clear in our terms and conditions, acknowledged during check out, in our FAQ, on multiple web pages on the main site, and in the product description that this is a 12 month subscription service with a minimum commitment of 12 months and then month to month after that.At this time, we will offer Ms. [redacted] the option to cancel the account for $30.00 to cover any fees and delinquent invoices.  As we have not been successful in charging her card sin the initial purchase 2/9/2017 and her card showing cancelled according to our merchant services, Ms. [redacted] is currently not "out" any money.  To the opposite, she has received $50.00 in free product for $8.99.  We believe we have been more than accommodating and generous in our willingness to satisfy her.  It currently remains unpaid and delinquent and per our policy will be referred to collections after 30 days of delinquency.
