Review: The New York City rental and hotel market is insane with rates that are 4-5x more expensive than you would typically find. MySuites.net defintely takes advantage of this and advertises hip boutique suites in the best parts of New York City at reasonable prices. I commute to the city on business weekly and was looking for a regular place to stay. I inquired about 2 – 2 week stints (separated by a weekend) 04/**/2013 & 04/**/2013. They responded that they had availability, but not in the same suite for the two weeks, which was fine because I wanted to find a quite I liked and schedule regular stays. I found them through AirBnb but they said due to the nature of my booking that AirBnb was not flexible enough to book the 2 week stay with the weekend in between. I should have recognized this red flag. They sent me an reservation agreement form that included both dates, prices and credit card authorization. They included a particularly thorough cancellation policy including clauses that claim that “in the event you should post a negative review or comment concerning mysuites, that for any reasons mysuites consider it a breach to these terms and conditions, mysuites shall exercise any remedies available to it to protect its reputation, including an action in defamation, if appropriate.”. I thought nothing of their policies, but now see that it’s clearly language of an organization with bad buisness practices that try to scare peopel inot taking action against them. After I submitted my reservation I asked for a confirmation number. They sent me a confirmation fo rthe first week and then said “we will have the confirmation for the second part of the stay by tomorrow sorry for teh delay”. The next day I inquired “Hi. I need to look for another spot if this is not confirmed soon. “. No answer. The third day I responded “Anything on this booking!?”. To which they responded “no [redacted], so sorry is confirmed that is not available after; if you don’t find anything we might be able to help you for a fe weights, just let me know”. They cancelled my second week and booked it with someone else. I thought this was unprofessional and was not someone I would want to stay with week after week so I requested to cancel the reservation. They proceeded to keep the deposit on the entire stay! First of all, the original agreement was for the entire 2 weeks. They cancelled the reservation on me. I did not cancel on them. Secondly, why would they keep the deposit on the entire stay??? Lastly, instead of trying to work it out with me, they just threatened with legal action.

Response:

[redacted] booked a valid reservation through our Bookings Department arriving on the [redacted] of April and departing on the [redacted] of April. [redacted] requested this break in his reservation for three night, and we accepted his request as a courtesy. A form was sent to him at which he filled out to confirm his reservation which also included a spilt reservation during the time of April [redacted]- April[redacted].

An email was sent to obtain confirmation for the second half of his stay. [redacted] replied,"Yes. Book next week for sure. I would like to both. You should have the paperwork on file."

When we were unable to confirm the second half of his stay, we received an email from his assistant requesting to cancel the reservation at which she was advised that that according to our terms and conditions the booking deposit was non refundable. We did not receive a reply to our email.

[redacted] proceeded to disputed this charge with American Express 3 times, and three disputes, were resolved in the merchants favor. We made it clear, as a courtesy, that we would not bill the balance due because the reservation was made less than 7 days of arrival. We advised [redacted] that regardless of the third dispute working in our favor or not, he would be billed the Administrative fees of $500.00 disclosed in our "terms and conditions" in case of a dispute. We didn't want to make such charge but we earned the right to do so.

In closing, the negative comments disclosed on our website that [redacted] refers to, is created intentionally to defend from such harassment by dishonest guests that try to breach their contract to obtain any form of refund at any cost. It's a detriment to small businesses, such as our selves, who suffering from fraudulent activity.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

There is clearly a reservation form that had both dates on there. That reservation had a single deposit reflecting for both stays. I confirmed the first stay in anticipation that they would confirm the other stay also. I repeatedly told them in the emails that they had sent you that "I would like both stays". Their process of sending me a reservation form with both stays, collecting a deposit, then only "confirming" one stay is deceptive and bad practice. Furthermore, they proceeded to keep the ENTIRE deposit that was submitted for the ENTIRE reservation - 2 stays.

They clearly have a history of deceptive practice:

And also threatening me with legal action in disputing the deposit amount and threatening legal action in posting a bad review is inappropriate.

Thank you for your quick reply [redacted].

Correct. At the time of the reservation, we confirmed for both legs of the stay. There is a single booking deposit reflecting one stay. This reflects our terms and conditions below which is located on your website. Technically, the booking deposit for two reservations would be $1,020.00, which is 30% of $3,400, yet we charge $460.00.

10. Payment, Booking, Fees and Security deposit and rate policy."B.1 Booking Deposit: up to 30% of your balance, or flat amount of $520 for online booking) is due upon submission of the credit card, by email, by phone or text message.”

MySuites, clearly ask [redacted] by email, “By now, I got the form. It seems that the stay [redacted] is booked, right now the suite is blocked, and I can’t unblock it until noon tomorrow. Do you want me to book the [redacted] to [redacted] for $1,060 before it will be gone? Please confirm asap.”

[redacted] response, “Yes. Book next week for syre. I’d like to book both. You should have the paperwork.”

Below, is a copy of the email thread received by [redacted] partner at [redacted].

“Before I escalate this to my attorney and the Internet (the Internet is my trade and I am an expert at search engine optimization and *will* ruin your reputation online). I advise you to reconsider. It will cost much more to repair your online reputation that to reimburse this fraudulent charge.”

In closing, [redacted] is mentioning a fraudulent charge that has been disputed three times to American Express and three times resolved in the merchants favor.

Credit card companies are well known for ving and resolving “minor frauds” perpetrated by clients without scrupulous usually in favor of their customers. It feel as though the fraudulent activity is being attempted by [redacted] by threatening to tarnish our reputation with the Revdex.com and the internet. MySuites maintains this valid charge as well as any rights to defend itself from any kind of threats made by [redacted] or his company [redacted]. The credit card company has proven that fraud didn’t take place and the charges are valid.
