/20/ To Whom It May Concern:I am writing in response to the complaint that was assigned an ID of [redacted] .The customer used our website to opt in for a free consultation on 5–24–14, came in for his appointment, and joined our gym on 5-29-(the attached membership agreement shows membership dates of 6–29-through 6–29-because members receive the first month of training free, after a down payment)The down payment of $for his membership was processed on 5-30-The customer attended a few classes, and then stoppedcoming to the gym.On 6-14-I emailed the customer to check on his training, but he did not reply (please see attached)We do not have a phone record, but the customer later called the gym and asked to cancel due to injuryTo help with cancellation I referred the customer to the terms and conditions portion of his membership agreement, specifically numbers 7-(please see attached), and also explained that for minor injuries, the gym typically freezes memberships as long as a doctor's note is provided.The customer then became irate, claiming he never had a membership agreement, or that the gym forged his membership agreementI explained again that if he needed to cancel, he should just follow the cancellation procedures described on the agreement, or that if he wanted to freeze his membership we just needed a doctor's noteThe customer hung up at this point, so I emailed him a PDF of his membership agreement (please see attached)Since then we have not heard from the customer.Please see the attached membership agreement that was signed by the customer, and the agreement and release of liability that was initialed and signed by the customerThese documents describe our standard membership parameters in their entiretyThe basic membership information (numbers 1-on the agreement) was completed by the gym instructor, and then initialed and signed by the customerThe customer does not warrant a refund for the $down payment, and he still is required to make monthly payments of $unless he provides documentation to support cancellationThe customer has made no monthly payments, and has not provided any documentation for cancellation.Thank you for your time and consideration.Sincerely,Matthew S.Manager

I am rejecting this response because:
The gym's manager is lying because the "representative" I came in to see on the last week of May on the 29th never mentioned *** ***, and told me their gym doesn't require any contracts and can be cancelled at any timeThe initial down payment was for 369.00, and the gym membership could be cancelled within days of starting like it was advertised on their website; but, the next day I was charged When I ask their representative why the amount was different he tried to lie and say that the amount was never 369.00, but At that point I didn't want to argue with him about the price because I just wanted to start going to classes immediately so I then asked him for the training clothes, pads, and boxing gloves that I was promised but he then claimed that I have to pay extra money for the pads, and shorts from some third party company they are affiliated with; in the mean time, he just gave me a t-shirt and a pair of boxing glovesAt that point I was starting to question what I got myself into, but disregarded it because I just wanted to start going to classesOver the next few days I attended some classes, but eventually sprained my shoulder outside of the gym, and so couldn't attend their classesMy injury was bad enough that I couldn't do any physical activity for a few months so I decided to cancel the membership like was promisedI called their gym and spoke to their Manager Matt over the phone and explained what was going onHe then started to explain how their gym is on a contract basis and that there is no way to cancel the contract because it was already sent to *** ***When I heard this I was very angry about how I was lied to and proceeded to explain how their representative never said anything about *** *** to me on the day I signed up, he then emailed me forged paper work the following day, and I also received an email from *** *** indicating a contract was started under my nameThis happened on June 2014, and reading the fine print of the paper you can see that the membership can be cancelled within three business days by giving the business a written notice to cancel the membership.
I provided both *** ***, and the gym with a written notice and email two days before the contract was created, along with paperwork signed by my doctor proving I wasn't able to attend anymore classesThe gym's manager then refused to speak to me so I had to deal solely with *** *** at that pointWhen I called *** *** they also denied their contracts being able to be cancelled and offered to freeze the membership due to my injury so I froze the Membership in an attempt to find a way to get out of the contractI have since then only been able to report my *** credit card for fraud to avoid paying the monthly fees.
This gym does nothing but con people into joining their gymAs I said before there are multiple complaints on Revdex.com and as well as on *** and ***I shouldn't be responsible for the contract because it was forged and created without my consent or knowledge.

January 22, 2015To Whom It May Concern:I am writing in response to the complaint that was assigned an ID of 10245264. We recently received a second notice that the customer has additional concerns regarding this case. However, the customer continues to make false claims against the gym. All of our membership parameters are clearly outlined over the several pages that make up our membership agreement, and all of this information was reviewed with the customer before he decided the join the gym.The customer continues to claim that his membership agreement was forged, but this is simply not true - if you refer to the attached documents, a gym representative completed the basic membership information portion of the agreement, and the customer himself then signed and initialed in several places.The customer also claims that no mention was made of our billing company, Member Solutions, but the customer initialed his acknowledgement of Member Solutions on the sign-up checklist.The customer claims he emailed the gym to cancel his membership, but that is also not true. Our entire email history is attached to this letter. We spoke on the phone about his membership, I explained that if he needed to cancel or freeze his membership he just needed to follow the directions on his membership agreement and contact Member Solutions, but he became agitated on the phone and hung up. I later checked with Member Solutions about his account, and he apparently was belligerent on the phone with them as well, and never submitted any valid reason to cancel his membership.The customer willingly joined our gym on 5-29-14. We offer the first month of training free, which is why the membership agreement indicates 6-29-14 as the start date. We processed his downpayment that day. The customer took several classes, and then stopped coming to the gym. I emailed him on 6-14-14 to check in, and he did not reply. Our only phone conversation occurred on 6-19-14, after which I emailed him a copy of his membership agreement (he claimed he had never signed any agreement).Nak Muay Gymn continues to dispute the invalid claims made by the customer. Please see the attached membership information and emails. The agreement was clearly signed and initialed in several places, over several pages, by the customer, and was not forged. The customer agreed to a $247 down payment, followed by twelve monthly payments of $166, for an overall total of $2239.The customer was recently placed in collections by our billing company, Member Solutions, which holds and manages the membership agreement. If the customer had a valid reason to pause or cancel his membership, he simply needed to follow the directions on the agreement. However, the customer has no valid reason for cancellation, and is responsible for the full tuition,Thank you for your time and consideration.

The issue was not resolved and the Gym lied about the agreement one of their employees spoke to me about the day I signed up. The agreement was for a down payment and month to month services that can be cancelled at any time. The employee who signed me up also wrote up the billing contract himself; it is in his own hand writing and he even spelled a lot of my information incorrectly. the gym Manager also lied about when I first came into the gym. In their response they stated I came in for a free consultation then came back to join the gym 5 days later. I came into the gym and they charged my credit card the next day for a completely different price than what they told me the day before. A few weeks later I called to get my refund like promised is when the gym sent the contract over to their billing company and started a lease under my name with their gym. below is a detailed explanation of what really happened. This business failed to honor the verbal and written agreement shown to me, the consumer, at the time of signing up which states that in order to sign up for their gym one would have to pay a start up fee followed by monthly payments that can be cancelled at any time. The owner of the gym proceeded to forge my signatures onto a contract for a one year lease to [redacted], a third party billing company, who processes their gym members payments; the owner of the gym forged my signature and forwarded all of the paper work to their billing company weeks after I had signed up because I injured my shoulder outside of the gym and was trying to cancel my membership within the 30 day trial period they promised me at the time I signed up. The gym also advised me I would be charged 369.00 as a start up fee which includes items needed in order to practice this martial art at their gym; all the items promised to me have a retail value of over 100.00. The next day when I went to the gym I was charged 247.00 dollars to my [redacted] credit card and was given a t-shirt, boxing gloves and wrist wraps which retail value is somewhere between 30.00 to 50.00 dollars; the owner of the gym then advised me that I would have to purchase the rest of the equipment needed myself through a company they are in partnership with in order to advance in ranks at the gym and to continue with their service. It was not until I tried to cancel the membership that an account with [redacted] was created under my name illegally. Proof that supports my claim is the paperwork filed for the [redacted] account; which I have never seen until it was emailed to me, and is written entirely in the owner's handwriting. The person who emailed me the paperwork was another associate at the gym and did not know that I was never shown the [redacted] paperwork so he emailed the paperwork under the impression that I had already looked at the contract and signed it myself. After I explained what really happened he proceeded to tell me there is nothing that can be done because he has never heard of the type of membership I was promoted to sign up for and that their business has always dealt solely with [redacted] since they have been opened their gym. I also feel the Nak Muay Gym should be reprimanded for conning customers into signing up for their gym and shut down for false advertisement and identity theft. Upon researching reviews for the Nak Muay gym I found other customers who went through the same situation and had to file lawsuits in order to have the contracts terminated. I am a full time student and cannot afford a lawyer so filing a law suit is not likely, but if that is my last resort then I will seek a lawyer.

Review: In order to gain new membership Nak Mauy Gym boasts a 60 day money back guarantee. However, the third party billing company they use has never honored this guarantee nor has Nak Mauy Gym ever refunded a customer their money because of the third party billing company they use to collect payment is responsible for such refunding after signup. So in essence, Nak Mauy Gym blames the billing company for not being able to get your money back and the billing company blames Nak Mauy Gym. It is a scam to cheat people out of their money should they not want to continue with their membership after the 60 days. I have no problem with companies that to not offer a refund but it should be expressed clearly when paper work is signed.Desired Settlement: I would like to be refunded my money from the time after my 60 day money back guarantee.

Review: I had an apt 7/10 and rescheduled it to 7/11. I called 7/11 in the morning to reschedule do to stomach flu. [redacted] refused to honor the 30 day free pass listed on their site because I rescheduled once. When I suggested if it would be better that I show up and throw up all over the class she replied no and offered to reschedule it but without honoring the offer. [redacted] could have at least told me about the policy the first time I rescheduled. Makes me worry what kind of school this is with rules like this and unwillingness to accommodate and illness.

I tried several times to talk to someone else with no luck. It appears [redacted] is the gatekeeper, so I hope someone else sees this and gives me a call.Desired Settlement: Honor the free 30 days as advertised.
