Ms. [redacted] signed a Retail Installment Contract with Distance Learning Systems (DLSI) and Virtual Learning Program on October 22, 2014 and had three (3) business days to cancel (end of day October 27, 2014). After the rescission period ended, the contract was forwarded to Jena Mae Financing ...
now Ben Franklin Finance (BFF). Ms. [redacted] called Jena Mae on November 5, 2014 to notify us that she did not want Payroll Deduction and stated that she contacted DLSI to cancel the program but it may have been 4-5 days after signing. Ms. [redacted] did fax the Payroll Deduction form (see attached) with “Cancellation of program. No longer interested” written on it dated October 30, 2014. This was well beyond the cancellation period and Jena Mae (BFF) was/is not able to cancel the contract without DLSI’s authorization. Cancellation must be in writing and sent to DLSI per the contract agreement. DLSI never received written cancellation only mention of attempting to cancel in an email dated November 16, 2014 (see attached) to Aaron C[redacted] (DLSI Program Administrator) which was also well beyond the rescission period.
I have attached the signed Retail Installment Contract as well as the Notes from DLSI. You can see when Ms. [redacted] signed and that she contacted DLSI on October 28, 2014 to ask about her payments and Excelsior fees and classes. She confirmed that she understood everything. On October 30, 2014 Ms. [redacted] called DLSI again and stated that she as going to pay in full, then later that day she called stating she cancelled and also claiming that she never signed a contract. Ms. [redacted] then sent DLSI her transcripts from Midwestern State University on November 5, 2014.
I don’t know whether there is some miscommunication and misunderstanding, but you can review the notes to see that her story isn’t consistent. [redacted] is obligated to pay for the contracts that she signed whether or not she uses the products or services provided by DLSI.

Revdex.com:I have review all of the information and disagree with may things put into this e-mail. I never attended orientation for this program. I was told I would only be receiving information on the program. As soon as information for billing purposes was brought to my attention I immediately sent a cancellation request. I was in contact with multiple people at several different "business". Each time I was told that nothing had been received so I continued to send notice of cancellation. Again, I was in contact with the offices after sending the cancellation, I was trying to get confirmation of cancellation. I did ask about billing, strictly for information purposes, which I can see what not added into the notes. I have no control over what someone puts into their notes and what they chose to take out. I only have the facts, I never went to an orientation, I never received any money, I never signed any contract and I do have a proof of faxing cancellation. Everything beyond that is just their way of trying to bully someone into paying for something they never received anything for. The only inconsistencies in my story would come from the notes that were chosen not to be put in.
