National Administrative Solutions Corp (NASC) is responsible for conducting the servicing needs of Mr. [redacted] cited contract under a service contract program called Car Guard.  His contract’s obligor is Autoguard Advantage Corporation (AAC) that is primarily liable to pay for any covered...

repairs whose obligations are insured in the event it does not timely pay eligible claims.  AAC contracted with NASC to fulfill AAC’s servicing duties as the administrator of the program.  This letter is in response to your inquiry received on September 1, 2015 directed to NASC who requested I review the facts reported for the cited claim and the terms, conditions and limitations of the service contract to determine if a proper adjustment of the claim was made. Since NASC almost exclusively conducts its business via phone conversations with repair facilities and contract holders, it has established procedures to immediately capture the contents of each conversation in order to (1) assure the most accurate data possible from each conversation is preserved and (2) allow any of its examiners to quickly respond to the continuing segments of a claim by easily referencing the data.  NASC’s data procedure is noted due to some of the entries being quoted in this response.   Mr. [redacted] claim was reported by the repair facility on July 29, 2015 at 12:03 PM and the portion related to his brake repair was authorized approximately an hour later and paid via credit card to the facility when NASC receipted the invoice on July 30, 2015.  Regarding the AC portion of his claim, it was initially denied due to the exclusionary language NASC’s representative found in the contract copy referenced from its data.  Due to Mr. [redacted] belief that gaskets coverage should have been covered, NASC had its supervisor confer with the producer who sold the contract and again reviewed the claim where an error was detected in the transmission of the contract’s data contents favoring Mr. [redacted] interpretation.  As a result, the repairs to the AC portion of his claim were approved on August 31, 2015 resulting in the authorization of benefits in the sum of $1,041.37.  Once NASC receives a signed invoice (required by his contract terms and our insurance regulators) from either the repair facility or Mr. Gavin, the benefits will be paid to whichever party presents the invoice.        NASC wishes to sincerely apologize to Mr. Gavin for the above error.  NASC also thanks him for calling it our attention to enable tracing what might have caused it.  If there are other facts that might cause NASC to further change its current opinion, please forward them immediately for our review and further consideration.  Page 2Sincerely,Peter K[redacted]Attorney
