We extend our sincerest apologies to *** *** for her
experience with our companyThis is definitely the antithesis of the service
we strive to provideIn studying this situation more closely we have found the
following:
On 3/9/*** *** initiated a monthly
retirement
contribution of $using our Salary Reduction Agreement (SRA) form.
NBS filed this SRA with Ms*** employer on 3/11/2015. On 4/7/and
4/24/NBS received change SRA forms both requesting a reduction of
contributions from $to $These changes were appropriately reflected
in the May and June contributions
In July and August contributions in the amount of
$(instead of $50.00) were erroneously sent, processed, and deposited into
Ms*** retirement account at the funding company. This increased
amount was not initiated by NBSOnce
the error was found the contribution was reduced back to $and has been at
that amount to this day
The contributions in error totaling $from July and
August are what need to be returned to Ms***.
On 9/14/Ms*** contacted NBS to report an error
related to her Salary Reduction Agreement (SRA). NBS confirmed this error,
but did not yet pass the request on to the funding company to return the assets
On 9/22/Ms*** again contacted NBS for a status
update. NBS did not have an update at that time.
On 10/8/NBS
formally requested a correction by sending and faxing a letter to the funding
company requesting that $be withdrawn from Ms***’ account and
returned to NBS in order for us to send the funds on to her employer
On 10/19/NBS received $from the
funding company. These funds were overnighted
to Ms***’ employer on 10/20/
A correction of this nature requires the funds to flow
through Ms***’ paycheck. For this reason the funds were returned to
the employer; whereupon, they will appropriately taxed and included on her
paycheck
Though NBS did not initiate the change in contribution
amounts, and was quick to react once the funds were returned by the funding
company, we do recognize that we were slow in requesting the funds back from
the funding company to be returned to Ms***’ employerWe are aware that
there is a deficiency in our system in regards to response time. We have increased staff and are enhancing our
electronic capabilities in order to ensure that delayed response times such as
this will not happen in the future

NBS is a third-party administrator of flexible spending accounts (FSA). As such, we are contracted by employers to administer their benefit plan. Determinations about claim reimbursement are made according to rules established by the employer and in accordance with IRS regulations. In no case does...

NBS ever retain FSA election amounts that are forfeited by an employee. All forfeited amounts are returned to the employer and are utilized by the employer in funding the benefit plan. everyone in the plan was charged when the plan was terminated, and a market value adjustment as a result of the liquidation of assets resulting from a plan termination.
