Subject: Revdex.com Complaint ID: [redacted] Importance: HighTo Whom It May Concern;In response to [redacted] complaint regarding his attempts to receive support on 8/10/ The National Booster Club Association does not, nor have we ever provided support or guidance to parents or supporters of booster clubs, members of the National Booster Club Association or not The association only provides support to officers, directors and school administrators who oversee our member clubs This has been the policy for decades and still to this day is the policy of the association, which [redacted] was very aware of While [redacted] was an officer of the [redacted] ***, a period of approximately year he was eligible for support and received ongoing support, including but not limited to:phone call consultations and supportSupportive club building documents provided, which ranged from sample articles, assistance with filing the organizations [redacted] and various club guides and resourcesAs is the policy, when [redacted] resigned as an officer of the [redacted] in October, he was no longer eligible for support from the association, thus his recent inquiries, which we cannot validate would not have resulted in the association providing any guidance or support.The association has been in ongoing contact with the current officers, directors and school administrators in helping provide guidance with regards to club activities, which are confidential to the [redacted] ***, their officers and school administrators A final clarification with regards to [redacted] complaint: [redacted] is not an officer, director or administrator overseeing the [redacted] and thus he does not qualify for support or guidance from the National Booster Club Association [redacted] are current, active members but at any time they elect to no longer remain members no additional support would be provided If [redacted] were to become elected as an officer or director of the [redacted] or any member club he would then become eligible and receive ongoing guidance and support with regards to booster club issues and matters [redacted] lists [redacted] as the salesperson associated with the National Booster Club Association, which is false [redacted] is the current booster club president for [redacted] and has no employment or representative affiliation with the National Booster Club Association

Complaint: [redacted] I am rejecting this response because: September 27, [redacted] Several emails were sent by a parent who had concerns regarding the E-Board and their actions as the E-Board were not following the By-Laws of the Boosters The parent had suggested your assistance in the matter to assist in the matter Below are the following emails that transpired A parent, a member from the [redacted] , sent [redacted] the following email on July 12, 2016: “Dear [redacted] how are you? I'm following up on a phone call I made to you yesterdayBasically the [redacted] Executive board unilaterally decided to extend their terms of office, from year to years, without putting it before a general membership voteAccording to our By-Laws, a change in our By-Laws must be voted upon by the general membership voteHowever, our current By-Laws indicated that the term of office ends every June Therefore, would you please tell me what your thoughts are on this at your earliest convenience? Thank you so much and I look forward to hearing from you soon.” On July 13, 2016, [redacted] responded with the following; “Thank you for the email Unfortunately given the vast number of booster club members we cannot provide direct support to general members of their booster clubs as it would require a support staff literally in the thousands Our support services are unlimited to both club officers and school administrators of member clubs With that said I still wanted to give a quick response to your email below as we have spoken with the booster club administrators of the [redacted] and they have sought our guidance with regards to making sure they are conducting themselves both in compliance with club documents as well as best practices Having spoken with them personally I can assure you that it is my belief that if anything was done in error that it is their intent to rectify all issues as well as moving the booster club in a direction that will be most beneficial to both the program, participants the school and all those involved I would like to encourage you to play a pro-active, support role in helping the organization move forward as having nearly years of personal experience in working with booster clubs has shown me one thing When an organization can bring together parents, alumni and community supporters with a positive focus and goal of working together to help provide a better opportunity for the kids participating in the program that the end result is always a better opportunity for our kids.” On July 13, 2016, the same parent/member of the Boosters organization, responded with the following to [redacted] email: “Good afternoon ***, thank you kindly for your quick response to my email, especially given that you probably have many constituents with whom to communicate I appreciate knowing your response and the guidance that you've given meThis helps to assure me that we will work on making the [redacted] boosters a better organization for our wrestlers.” On July 13, 2016, a parent/member of the Boosters organization, sent an additional email in regards to a serious concern regarding the former Executive Board of Directors committing an “Ultra Vires Act;” “Good evening [redacted] and [redacted] s Executive BoardI hope this email finds you well and in good health I thought I would share this article (please see the link below) to reinforce the importance of following the By-Laws of a nonprofit organization, such as [redacted] sTherefore, would you please read this article at your earliest convenience and let me know when we can rectify the mistake that was made to unilaterally extend the executive board members' terms of office to two years without a general membership vote to change the one-year term in our By-Laws? Therefore, it is incumbent that we have elections ASAP for next year's Executive board of officers for the [redacted] rsI think an email to the general members which allows about one week to nominate someone or themselves for an executive board position would work and then maybe about three or four days to vote on and electronic platform like last year's "Election Buddy" will resolve the problemWhat do you all think? Thank you so much and I look forward to hearing from you soon.” On August 16, 2016, [redacted] , authored and sent the following email from the [redacted] : Dear Wrestling Family, “I hope that you all had a great summer as it comes to a close and the school year is right around the cornerThe coaching staff and myself are excited to begin our pre-season training in preparation for the 2016-wrestling seasonThere are some changes we will be making in the assistance of the team in order for [redacted] to continue to progress The [redacted] will continue its financial efforts with the help and guidance of our [redacted] officeWhat this means is that we will no longer have a booster organizationAfter much discussion, I have decided to dissolve the group to focus on the development of the team rather than the financial aspect of itThe booster club was outstanding in providing another major resource for the wrestlers and coaching staffUnfortunately, overseeing a booster club has become a tremendous task for myselfI would like to use my energy to develop our student’s athletes for success in the classroom and on the matI would like to thank the booster directors and all parents involved that were extremely helpful in my first year as a head coach and made the year so prosperousThe group has its history from its original creation, as being effective in assisting the student athletes and coaches and for that we are grateful With this change, we will be able to direct our energy to giving our students athletes more tools to achieve their goals at [redacted] ***Communication will now come directly from my school email and text message app (remind)Please text [redacted] if you would like to receive those text message updatesOur district is changing the email address domain so please expect and email soon with that update as I will gather email info from your student the first week of school during wrestling class Thank you and I look forward to the upcoming season,” [redacted] High School [redacted] On August 16, 2016, the same parent/member of the Boosters sent the following email to [redacted] ***: “Hi [redacted] how are you? I received this email from [redacted] at [redacted] HSMy question is: Can a coach unilaterally dissolve the boosters? Thanks & I look forward to hearing from you soon.” Neither [redacted] nor anyone from his office returned any further emails or telephone calls to the parent after he asked for further advise on the serious misconduct that occurred and continues to occur [redacted] stated he made [redacted] aware of their services I have included in the email, as an attachment, a flyer explaining their servicesHowever, nowhere in the flyer, or any other materials provided by [redacted] is it explicitly stated that their services are exclusive to officers, executive board directors, and school administrators Included in the email as an attachment are receipts and emails where on September 17, I had inquired information on your nonprofit A flyer, entitled “NBCTC Membership Flyer”, created on 01/24/and authored by NBCTC, indicates the following on the first line: “Increasing Parent Support.” In addition, based on my thorough review of the flyer, there is no mention about exclusive service for board directors and school administrators as [redacted] had stated in his reply [redacted] has stated his services were included and I never received a detailed contract explaining the services being rendered This is one of my most serious concernsIn addition, when I asked for his company policy, he refused to provide any further information In closing, [redacted] stated I am not an involved as a director or administrator and I am not involved in overseeing the Boosters [redacted] you were made aware of the directors violating the By-Laws and making changes to the By-Laws without having formal general membership meetings and making unilateral decisions In addition, the parent made him aware of the violation of California non-profit Corporation laws Just for the record, after the directors were informed of the board of the lack of due process in making unilateral changes, they reverted to the original By-Laws As it stands currently, the only person who has any legal standing as a director is [redacted] as the Past President As for the rest of the board, their terms have expired and therefore their director’s positions remain open until new elections are conducted [redacted] my goal is having a remedy and a solution for an organization that was founded based on principles of integrity, including following rules and policies, and honesty directing the program When the directors and the coach conducted themselves in a manner that does not comply with the rules, they were other booster members and I informed them of their misconductNevertheless, the school administrators claimed numerous times that the decision to dissolve the boosters was as a result of your guidance, direction and your advice In fact, there are California Corporate Laws that govern such processes and they have been ignored I have contacted school administration via multiple emails to recommend reasonable resolutions to them I thought [redacted] had the best interests of the parents and the program because of his decades of knowledge and experience Unfortunately, you [redacted] and your firm decided to choose sides instead of pursuing everyone’s best interests In regards to your services, I again respectfully request a detailed membership history and services that you provided to [redacted] s as well as a copy of your By-Laws and Articles of Incorporation for the National Booster Club Association and the Washington State Booster Club Thank you [redacted] for your time and effort in understanding our concerns for our boosters and your services
