Dear Ms***, Thank you for your letter dated May 26, 2016, notifying the company of Mr***’s complaintWe appreciate this opportunity to respond. An investigation into Mr***’s allegations proved the company committed no wrongdoingOn February 2, 2016, Mr*** borrowed $3,Thereafter, he never submitted a payment and had very limited communication with the companyDespite his contentions, the company’s efforts to reach him, while unsuccessful were not excessive, aggressive or harassing and complied with all state and federal lawsMoreover, the employee’s initial inadvertent mistake of typing his street name as ***, instead of ***, was immediately corrected and on April 4, 2016, the company mailed a Notice to Cure Default to Mr*** in accordance with the lawFinally, on May 26, 2016, after exhausting all available means of reaching Mr***, the company repossessed its collateral. Although the repossession company is an independent contractor and not an employee or agent of the company, the company is a customer-focused lender and for that reason conducts ongoing monitoring of its vendor relationships and takes all complaints seriously. With that said, the company contacted the owner of the repossession company, and he admittedly denies Mr***’s claimsFurthermore, the company has no knowledge of other complaints concerning this repossession companyClearly, the company is confronted with two very different stories and has no reason not to believe the repossession company’s statements. In closing, the company operates in strict compliance with state and federal laws and has committed no wrongdoingMr***’s account was nearly four months past due, a first payment default and efforts to reach him were unsuccessfulDespite Mr***’s contentions, the employees and independent contractor adamantly deny his allegations. Notwithstanding the above, the company is a customer focused business and is always willing to work with a customer rather than repossess or sell a vehicleWith that said, if Mr*** Page of 2 would like to discuss a mutually beneficial settlement arrangement, he should contact the company’s Assistant General Counsel at *** by June 8, 2016; otherwise, the company will proceed with selling the vehicle in accordance with the law. Dear Ms. [redacted], Thank you for your letter dated June 7, 2016, notifying the company of Mr. [redacted]’s additional correspondence. We appreciate this opportunity to respond. Again, the company operates in strict compliance with state and federal laws and has committed no wrongdoing. On February 2, 2016, Mr. [redacted] borrowed $3,140.00. He never submitted a payment and had very limited communication with the company. On May 26, 2016, when his account was nearly four months past due, the company repossessed its collateral. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  Their are multiple issues with the business response. First, the claim that I was not reachable and did nt...

communicate with the office is false, the company has a text program in place to which they have a record as well as I have a record of all text to me from the office directly. In addition to payment reminders, the manager communicated daily with me directly through this service. I have retained all these text for the purpose of the companies assumed denial. The text clearly lays out may inconsistences in the actions of this company including my request not to send any vendors to my home as violation of breach of peace, the manager communicated that my payoff was 1500 in text after I requested it, I spoke with the manager via this text the day of repossession again stating not to send anyone to my home, that I would come the next day by 10am. I have requested my ten day letter via text, as well as my personal inventory to which I have received neither. In regards to the RTC, I requested a new one to be sent  to my correct address certified to ensure delivery, this was not done and I didnt receive the claimed correct one. For proof of income the company asked for my wifes income but didnt ask for her to sign to justify the payment amount due to my unemployment, which at the time I had not received only a determination of possible benefits. In regards to the repossession agents claim of no wrong doing, pictures were taken by me of the damage after the incident to which I have in my possession. Of course, a third party vendor isnt goign to admit responsibliity however, the company contract thems and is thus responsible for their actions. The companies response is a typical reaction to valid claims. The property claim of being sold by 6/8 is unjustified as I still as of this date have not received my ten day letter. I do not feel they should skirt the boundries to be convienient to their needs. My resolution was included in the initial claim.
