I am responding to the letter that I received from you in regards to the complaint submitted on 2/10/The assigned ID listed is [redacted] .First of all, this is the first complaint that we have received from the Revdex.comTo address the issues listed in the complaint, we are a martial arts school and we do tell parents and the students that we teach life skills,which includes discipline, following directions, focusingThese are just few of the things that we let the parents know that each student will receive, along doing some fun thingsI will stress that we are not aplayground or a baby sitting service.We do not force anyone or compel them to attend classes if they are not satisfiedWe are not for everyone and we have students who quit for number of reasons and many stay on for the same as I listed above, thatincludes from what we hear from the parents.As far as the refund, actually, we made a mistake of doing a double refund, one refund made on 1/21/and a duplicate refund was made on 1/24/The amount of $was refunded each time, so we are actuallyowed $from the customerThe monies were refunded to the credit card that was used to make the payment on 1/5/I am not sure how long her credit card company takes to post to her account.As far as her son being singled out, from what the instructor told me is that he was pulled to the side and was talked to, not yelled atAlso, the instructor spoke to the student and the parent in the office and tried toconvey what the intention was for her to pull the child to the side and talkIf they felt, that her son was singled out, I am sorry, because not everything is objective and sometimes it is subjective and it depends onthe situations.Again, I will close and say, that all students are treated equally while they are in class and we treat each student with respect and dignityIf you need feedback to show how we are, I can have one parent or all theparents write letters to you to show the integrity of our school.I appreciate your time and please let me know if you need anything else from us.Thanks, [redacted]

Please find attached copies of the contract Ms [redacted] signed in March of and the contract that she signed in March of Nowhere on either of these contracts does it state that the contract can be cancelled with proof of move As noted earlier in this dialog it is our practice to cancel if a student moves more than miles as we consider this reasonableThe attachment also includes our records of Ms [redacted] ’s calls and our attempts to return themIt also includes records of the numerous times over the past four years that we have worked with Ms [redacted] , amending the contract dated due to missed payments, and reinstating her program with a new contract after the contract dated became seriously past due (see letter dated October 30, 2015)We hoped that [redacted] could continue in karate despite a poor payment history on Ms [redacted] ’s partThe report detailing all the monies received from Ms [redacted] since January of shows her $payment towards the late and past due amounts on the old contract (dated March 2012) to cancel that program and her four $payments on the new contract (dated March 2016)The belt promotion fees of $are listed on both contractsMs [redacted] has paid these in the past when [redacted] promoted to a new beltWe still have outstanding belt promotion fees from 2014-of $70, but contrary to Ms [redacted] ’s statement we have made no attempt to collect themWe did advise her that she still owed them, however, we intended to write them off as we considered them uncollectible due to her move

I am rejecting this response because:
The contract clearly states that it could be canceled if moved away I moved over miles away and contacted them several times leaving messages with employees who couldn't help meAfter several times I finally received a call back stating that I had to physically bring in my driver's license to verify that I moved I then left a message with the employee to have her call me asap Three weeks later after I had been calling, she finally answered and said that I would not get my previous month's money back because I didn't get my ID to her in time I had just been billed the day before after waiting and calling for weeksI have a copy of my contract where it states the move and how it can be canceled I also have proof of my move date, my phone calls, and statements of when I was charged

The attachment also includes our records of Ms. [redacted]’s calls and our attempts to return them. It also includes records of the numerous times over the past four years that we have worked with Ms. [redacted], amending the contract dated 2013 due to missed payments, and reinstating her program with a new contract after the contract dated 2013 became seriously past due (see letter dated October 30, 2015). We hoped that [redacted] could continue in karate despite a poor payment history on Ms. [redacted]’s part. The report detailing all the monies received from Ms. [redacted] since January of 2016 shows her $100 payment towards the late and past due amounts on the old contract (dated March 2012) to cancel that program and her four $30 payments on the new contract (dated March 2016). The belt promotion fees of $35 are listed on both contracts. Ms. [redacted] has paid these in the past when [redacted] promoted to a new belt. We still have outstanding belt promotion fees from 2014-15 of $70, but contrary to Ms. [redacted]’s statement we have made no attempt to collect them. We did advise her that she still owed them, however, we intended to write them off as we considered them uncollectible due to her move.

Ms. [redacted]’s initial contract with this office was in November of 2013. She failed to pay for the contract citing financial concerns. We rewrote the contract on March 2, of 2016. Her payment amount was a reduced price of $30. When she failed to make payments on this contract we contacted her. She...

stated that she had moved. Although the contract does not specifically say we will cancel on proof of move that is our standard business practice. We received proof of her move on June 6, 2016 as documented in our office. We ran the payment for the period from May 15 through June 15 and then cancelled the contract. We would be within our legal rights to pursue collection for the frequent periods of non-payment from June of 2014 through June of 2016. We wrote off the $70 in promotion fees she owed us due to the difficulty of collecting from this client. She contacted us and threatened a lawsuit if we did not refund the entire amount of the new contract. We would be within our rights to collect the entire amount from all the previous periods from June of 2014 through June of 2016 that she has failed to pay her contractual obligation. We do not wish to pursue this as we do not feel that we would be successful, and we do not wish to harass this client. I would be happy to provide copies of the contracts, our records of her phone calls and our timely responses, and our documentation upon receiving proof of move.
