Dear Ms*** I am in receipt of your January 6, e-mail and attached letter regarding Mr*** ***Please consider this letter in response to your inquiry
Based on the documents Mr*** has provided NMA in support of
his application for a merchant account, NMA has no reason to believe his "I am not the owner" defenseThe facts available to NMA lead to the conclusion that Mr*** has switched credit card processors and is attempting to avoid the Early Termination Fee
The following documents are included with this letterThese documents were provided to NMA from Mr*** in support of his application for a merchant account
Account Set Up Form Merchant Application (SSN# is redacted) Drivers License Voided Check
The ETF is described on page of the Merchant Application which Mr*** signedIt states:
Early Termination Fee is calculated based on the greater of Two Hundred Fifty Dollars ($250) or *** average monthly volume derived from processing Merchant's transactions (based on an average of the highest three (3) months of processing volume during the previous or current term of the Agreement, whichever is greater, multiplied by .003, multiplied by the number of full and partial months remaining in the term of the Agreement
Mr***'s three largest months of processing volume are:
3rd highest 15,

Highest 16,
Average of the three highest months: 16,
months remaining on agreement:
EFT= 16,x x 29= 1,
Mr*** owes NMA $1,the mutually agreed to Early Termination FeeThis is not an insubstantial amount and NMA sees no reason why it need be waivedFurthermore, NMA ha invested time and money to reprogram Mr***'s Point of Sale System
Mr*** unequivocally claimed to be the owner of ***'s *** *** &*** as shown on page of the Merchant ApplicationNMA reasonably relied on his assertion and NMA has fulfilled its obligations under the agreement***'s *** *** &*** has been able to accept credit cards from its customers for payment for months now
Since receiving your letter, NMA reached out to Mr*** and attempted to convince him to continue to process NMANMA would much rather have his business than ETFFurthermore, NMA even offered to drop his ETF to $in exchange for rescinding his compliant, but he did not agree and claimed to be owed an additional $as a reimbursement
For argument sake, if Mr*** were not the owner of ***'s *** *** and***, NMA would be willing to transfer all of his obligations to the owner, if the owner agreed to accept the obligationsBut until such time, NMA will continue to seek remedies as it sees fit

(The consumer indicated he/she DID NOT accept the response from the business.)
For a several time I explain it to them that I'm not trying to get out of my obligation, all what I ask to do fair business for all and I'm not getting what I promise for and actually what they guarantee before I sign the contractThey misrepresent the condition and not willing to solve it
Ps: will open another case for not guarantee my satisfaction that they promised

Dear Ms*** I am in receipt of your February 5, letter re Case # XXXXXXXXPlease consider this letter in response to the consumer's comments
National Merchants Association (NMA) clearly outlined its position in the original response to the consumer's complaintWithout waiving any of its rights, in good faith it reached out to the consumer and offered a reasonable change to its positionBut the consumer rejected the offerConsequently, NMA's position (as described in the original response) regarding its rights under the agreement with the consumer remains unchanged

Terron and Dane were wonderful to work with. The process was really fast and easy and we are ecstatic that we will be able to accept credit card payments once again.
