Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.I absolutely believe that the actions of [redacted] are completely legal but not morally or ethically what one should expect from their realtor I never was given a clear explanation that the 5% was not just his fee but also was to cover the buyers fees If you see the attached document, at no time did [redacted] offer to negotiate on my behalf a lowering or sharing of any of these costs and by the time I began to question these I was threatened with a breach of contract with the buyer as the final amts you can see were just days before the close This home had been on the market for just over one month in what has been a "sellers" market in California The fact that the work sheet that [redacted] continues to refer to was an "example" sent me Feb 10, days after my mom's death(Feb1) and prior to any agreed listing or determination of the selling price of the home is very suspect in itself since this is exactly the price he had me believe was the "best" offer on this home months later [Provide details of why you are not satisfied with this resolutionPlease respond in this space ONLY] Regards, [redacted]

To whom it may concern,Firstly, page of the Residential Listing Agreement number titled: "DISPUTE RESOLUTION," section A ütled• "N'IEDIATION," explains, mediation is the first avenue to pursue.Because J wish for this matter to be behind us I will explain to you what I have attempted to explain to ***.On February IOth *** emailed me asking, " what would be your fees if we were to enlist you as the agent" my response was, "The real estate commission would be 5% of thesales price, 2.5% to my office and 2.5% to the buyer's office." This is the first Gme informed*** of the realtor fees I then went on in the email offering to tun a market analysis and net sheet of the property which she replied, " would be great " So that was sent to her later that afternoon on the 20"' of FebruaryThe estimated cost sheet that was requested by *** states on page under "Real Estate Fees" the 5% is split 0/to the buyer's agent and 2.5% tothe seller's agentThis is the second instance where the realtor fees and how they are broken up was presented to ***On April *** signed the Residential Listing Agreement that stated on page l, number 3, section "A" the Realtor fees would be 5% of the sales price andthat 2.5% would go to the seller's sideOn July I *** received a copy ofthe Instrucdons to pay commission that spelled out the break down that was to be paid to each office that she signed and returnedLastly on August I st *** signed the estimated sellers closingstatement that listed the commissions paid to both offices along with all other expensesTheseare five separate instances that described the seller (***) is responsible for the realtor fees and what they are, so as I have told her several time I do not see where any confusion as to who pays the fees could have occurred.In one of our email exchanges during the transaction *** presented an article by realtor.com and tried to make the point that the realtor fees are not paid by the seller but fis is absolutely not true, the article itself has a clear section titled: "Who pays the Realtor fee?" thebeginning of paragraph two reads as follows, "The Realtor fee is typically paid by the seller to the listing broker who, in tum, shares part of it with the Realtor who brings a buyer to the(http://www.realtor.com/aclvice/financehealtor-fegs-closing-costs/)She misinterpretedtable..the arGcle she sent me, I tried my best to explain to her she was mistaken but after severalattempts she still stood firmly to her beliefthat she was correctIn addition, her suspicion that the buyers were charged 2.5% on top of her 5% charge is completely all charges are clearly and accurately listed in the final settlement statement.The $4,mentioned by *** was paid as part of the closing cost credit that was presented from the buyers in their offer to purchase the house that *** signedThe $4,sellers closing credit was also listed in the Estimated Closing statement that was signed by *** on the I st of August.***'s possible source of confusion as to her thinking she was "overcharged" is coming from the $11,down payment the buyer's made, that by some quirk of fate was also the exact amount of commission paid to each realtor*** paid the agreed upon fee of $23,(5%) that was split $11,(2.5%) to the buyer's agent and $11,(2.5%) to the seller's agent.The legality of this transaction is sound and in crderThe implications for something like this to occur would mean that the escrow company, the buyer's agent, and the seller's agent would all have to be "in on it" in order for it to be possible to charge an additional 2.5% whichAug 10:40a
***6194211188p.4would mean *** paid 7.5% in cornmissionThere was never any double talk, I did my best to answer and explain ***'s questions as seen in the emails attached.There is no compensation to be paid for my "poor representation" because these acüons are truant, ***'s misunderstanding of the down payment made by the buyer's was the likely source of confusion,Note: Most of the documents mentioned thrmjghout are privileged and cannot be disclosed by me, if you can kindly ask *** for a signed right to release information I will be more than happy to provide emails as well as the seller's net sheet and anything else that is can then be releasedAlso, please have *** release to you the listing agreement: escrow instructions and listing agreement that all show she was charged what was agreed on
