[redacted] [redacted] came to our dealership on [redacted] to trade in a [redacted] [redacted] and purchase a new [redacted] We inspected [redacted] ’s trade in and offered him $*** for the trailer You will see this $ [redacted] reflected as a trade in on invoice # [redacted] As our sales rep was finalizing the trade/purchase he asked Mr Picket for the title to the trade in trailer At that point [redacted] informed the sales rep that he did not have the title and there was a lien on the trailer through [redacted] Our title department contacted [redacted] at that point and got the current and day pay-off amount At this point the sales rep requested that I review the documents With [redacted] , our sales rep and myself, sitting at the sales desk, we discussed voiding the invoiced transaction and redoing the paperwork to reflect the day payoff which would then change the dollar amount owed by [redacted] from $ [redacted] to $ [redacted] At this point [redacted] asked that we not void the invoice because the payment he had was a Cashier’s Check that was already made out for the amount of $ [redacted] [redacted] stated that he would provide a separate check for the [redacted] Payoff amount of $ [redacted] I approved this and let the sales rep and [redacted] close the sale with the understanding that [redacted] was providing an additional check for the [redacted] pay-off on the trade in trailer On [redacted] our Title department contacted me regarding [redacted] ’s [redacted] pay-off Upon further review, it was determined that [redacted] had either forgotten to leave the payoff check or had accidentally mixed it with his new trailer documentsThe sales rep and I tried, unsuccessfully to contact [redacted] for nearly a week On [redacted] I was able to contact [redacted] by calling him from my cell phone I politely went over the issue and explained to [redacted] that I cannot find the check for the Payoff on the used tratrailer, and we cannot move forward processing the new trailer documents until this is settled [redacted] apologized and said he does not have the funds to pay-off the trade in trailer as agreed We offered [redacted] the opportunity to return his new trailer and we would return his partial payment and trade in with no restocking fee [redacted] replied that he was already using the trailer and wanted to discuss his optionsWe agreed upon the amount of $ [redacted] per week for [redacted] weeksWe agreed that [redacted] come in on [redacted] to put this in writing and make the first payment This is the last time that we have been able to contact [redacted] as he is ignoring our calls [redacted] filed a complaint with the Texas Motor Vehicle Division and after discussing this with their representative, we concluded that this was a civil matter and we agreed to register his new trailer [redacted] ’s new trailer was registered on [redacted] and his trade in was paid in full on [redacted] by [redacted] , causing us the loss of over $ [redacted] Having been in the Hotshot industry for years, we understand that a small business has hard times We also like to see the best in people and believe that [redacted] will honor his word Thanks

payoff plan, which he agreed to and then reneged onAs stated earlier, we discussed this
with the TXDMV coming to the conclusion this was a civil matterWe have registered and PAID

like to resolve this matter out of court, but if *** wishes to take this to small claims court, so be it

Small claims because they made me lose 3month work
Which I figure is about [redacted] dollars
