On June 25th we received the first call from Mr*** indicating he was looking for a gallon Catawba Crape Myrtle. He indicated that he wanted a fully mature and large tree with multiple trunks and nothing more specific. On that day I began my search for the specific
tree. I notified him that I had found the tree in Apopka, FL and I also informed him that the tree he was looking for was only a medium sized tree and would not satisfy what he was looking for. I had already spoke with the owner of the nursery and he recommended a "twilight" crape myrtle because it had the same deep purple color that Mr*** had been looking for and also would achieve the size that he was looking for. I informed him that the biggest tree I could find was a gallon and with that size I would not need to use any equipment to install the tree due to the weight difference. He expressed interest in going that route so I called and reserved the tree. Later that day he called back to change the tree to a "red rocket" crape myrtle with no more specific details than the multiple trunks. I canceled the first tree and began my search for the new tree. The red rocket is more common in the Appalachian region and is very difficult to find on short notice in such a large size here in Florida. At any rate I was able to locate one just south of here and on the 26th of June I arranged to pick the tree up on Monday July 1st and paid for the tree in full with my own money on good faith with no deposit required from Mr***. Mr*** asked me when I was going to install the tree and at that point I offered for him to set the time so that he would be available to examine the tree and show me the precise location he wanted the tree installed. He asked if I would wait until that evening so that he could be there and I agreed to this time. On Monday I loaded up my trailer, grabbed several bags of mushroom compost from the hardware store and headed south to pick up his tree. At this point I had already spent in excess of $of my own money with fuel, compost, and the tree. I left my home around noon anticipating rush hour traffic, selecting the tree (which I may remind you is not a very common type around here and the "pickings were slim") and leaving myself time for any mishaps that would possibly arise. I picked up his tree and headed back to Jacksonville, arriving at approximately o'clock. Having to wait a couple hours for the time that he had requested I went to a friend's house that was close to MrChamber's residence since his residence is nowhere near my home or nursery. I waited there in the driveway of that residence for hours alone until closer to 5. I picked up a colleague that I hired to help move and install the tree, it weighed over 200lbs and I was not able to move it alone. The two of us pulled up to Mr*** home just before and waited because Mr*** was running a little late. When he arrived at his home I already had the tree out of the trailer and my associate and I went over to introduce ourselves. He indicated where he wanted the tree to be planted so I offered to bring the still potted tree over to give a better indication of what exactly it would look like in the location. I first showed him the tree, which I selected based on his request of multiple trunks, gallon, and red rocket variety with a saturated beautiful bunch of fully bloomed flowers. He approved the tree and my associate and I moved the tree up the hill to where he indicated he wanted it planted. The three of us spent a few minutes moving the tree around until we agreed on a location, which was the site where an old oak tree had been removed leaving a tangled root structure in place. Only after he agreed to the tree and the location he wanted it did we begin to install the tree. We dug the hole, cut through the roots, and I put in some of the compost before we removed the tree from it's pot and placed it in the ground. We then dumped the rest of the compost in the hole and secured the tree in it's new location. I then instructed Mr*** on how to care for the tree while my colleague finished filling in the hole and cleaning up. I then used a root stimulant that I use on all my transplants at my nursery to aid the roots establishing themselves after the stress of being removed from the pot and transplanted in a new location. Mr*** seemed extremely satisfied and we stayed after for approximately minutes talking about the tree and how nice his yard looked. We then shook hands and he paid me the agreed upon sum in cash and I left. On Thursday July 2nd my wife called me around or in the evening to tell me that Mr*** was unhappy with the tree because it was leaning. I immediately thought that due to heavy wind, rain, and the old oak roots that the tree had been dislodged and was leaning. I had just finished an install not too far from Mr***' home so I immediately went to his house, not the next day as he has indicated in his complaint. Upon arrival I walked around the tree and did not see any difference in the tree from when we had installed it earlier in the week. It was still healthy, standing true, and not broken or damaged in any fashion. I then went to his front door and asked him to come out and explain his dissatisfaction. We spent some time walking around the tree in which time the only viable complaint he had was that he did not like the aesthetics of the tree. I flat asked him what would he like me to do and he gave no direct answer, but was visibly upset. I told him the entire purpose of me waiting until he got home was to get his approval before I installed the tree. Had he expressed any dissatisfaction before I installed the tree I would have returned to the nursery to swap the tree out for a new one. Since he did not express any dissatisfaction at that time and since the tree had already been installed there was little I could do, but I was willing to try and make this right by him. I informed him that the tree will grow up to feet in a year and that it could be trimmed or trained to achieve this new standard he had set days after the install. (I never suggested we dig it up and plant it at a different angle) He immediately objected to this idea and suggested that I should have known what he wanted. If I would have known he was this particular I would have suggested he go and pick out the tree on his own. He was irritated, but I told him due to the later hour of the evening there was nothing I could do that day and I would contact him during business hours the next day. I called as promised around noon on Friday the 3rd to inform him that since the tree had been planted already and been in the ground for several days the risk of shock was too great for a return. However, since I sincerely believe that I had acted in good faith up until this point and waited for his approval I do not think it was fair for me to spend my time digging up the tree, hiring someone to help me remove it, load it up, drive over an hour south, purchase a new tree, drive back and install it, all the while having to pay the 3rd party laborer for their time, take the risk that the tree could die from the shock, have to find a new buyer to recoup some money, and ultimately lose money on this job. I offered to pick up another tree at his expense, but at my wholesale price, deliver, and install it for free. At this point he was extremely upset and began to get vulgar with me on the phone. He then said he thought it was $@#* that he would have to pay for another tree, but then made an addendum to my offer in which I would purchase the tree, again with my own money, and bring it to him with no obligation to buy since now I knew what he wanted. I suggested he go himself and pick out a tree and I would pick it up and install the new tree, he was not receptive of this idea. I did not like this arrangement but agreed to it in order to try and satisfy my client and asked that due to the holiday weekend that he give me until Monday or Tuesday of the following week to follow through. He agreed and we ended the conversation. He then called our business line shortly after to confirm the date of the install, which I now understand was to file this complaint with your organization not giving me time to follow through on our arrangement, which I feel was more than fair and actually going above and beyond the industry standards. Since this incident I have spent hours on the computer sending emails to the lady I purchased the company from, whose information is still listed on the Revdex.com and caused the delay in my response to the complaint, and on the phone with other industry professionals. It has caused me sleepless nights since this is a new business and I do not want a blemish on our professional record, especially since I believe I have been more than cooperative and accommodating to Mr***. I think that when he filed this complaint without following through on our arrangement, which left us both at a loss, was in poor taste and very unprofessional
