Since opening in May of 2020, this business has advertised itself as a 24/7 access gym. I originally signed up for the gym in order to have access to a gym, as advertised, 24/7 due to my irregular hours and work schedule. The membership I have signed up for is a 24/7 access membership for $35 a month, I have paid this due in full each month from when I joined in June until present. Each week, I ask the staff and management when there will be 24 hour access at their facility. In June, the excuse was that due to COVID19 the gym was not able to receive their key fobs that they needed to issue out to patrons to use the key card reader outside the entrance. In July, the gym received the key fobs and stated that they were in the process of putting serial numbers on the fobs for accountability purposes prior to handing out to patrons. Later that month, they began saying they were transitioning to a new access system that would enable patrons to open the entrance via a digital app called ***. In September, the staff stated they could not activate the new scanner outside because of a lack of fiber optic cable running through the ceiling from the door to the staff desk. Throughout this time I have still been paying for a 24/7 membership. Not once have I had 24 hour access to the facility and the business' hours are not adequate to meet my schedule as they are often only open from 9am to 10pm. I have voiced this complaint weekly and there has always been a new, tragic excuse on why they cannot provide 24 hour access. After giving the gym June through September to address the issue, I informed them of my desire to cancel my membership. However, they stated I must pay a cancelation fee for the membership of approximately $70,or 25% of what I owe for the remainder of the year. This is unreasonable to pay a cancelation fee when I have never received the full service I've paid for June through present. The contract, website and all other advertisements reflect the business is 24/7 when it has never been.

Billing Adjustment Waive any and all cancelation fee and end my membership at the gym. I do not desire a refund for any of the months I have paid for, as it was my choice as the consumer to give the business the benefit of the doubt that they were actively working to solve the access issue. However, asking a patron to pay a cancelation fee for services that were never fully rendered is not reasonable.

This complaint has been resolved by the business after I told them I had put in a complaint to the Revdex.com. They have ended my subscription and waived the cancelation fee.
