warranty, and any warranty plants that are replaced will be charged an additional labor rate to replace and replant, which we did not charge you in April as a courtesy for being a part of the [redacted] ***k community.We will be more than happy to quote you a price to replace the existing trees and plant new treesSummer time is not the best time to plant trees unless you are able to water them twice daily for at least weeks straightSince the trees have died, it may be best to have a soil sample done so that we can figure out the root cause of the issue and plant new ones in fall when days past the date of installation, which was determined that the tree had suffered from a level of transplant shock due to insufficient watering after plantingWe spoke in the spring of and you stated that the tree had a few stalks starting to bloom and leaf outAs far as I know the tree is currently still alive and should eventually flush out once it is stabilizedWe have been searching for a replacement for the *** to plant this spring/summer per your request, however, the plant is not under any warranty and would be charged the full plant cost and labor to replaceWe have been unable to locate an exact replacement to date, however we are more than happy to replace the *** with a similar tree at your expenseNature by Design’s warranties and conditions (attached below) specify that all plant material that is not watered properly or cared for during the first days of planting are not coveredThis claim was also made after the day warranty window that is offered on plant material to customers without a valid maintenance plan and once again, the plant was not completely deadIf the plant material fell into the warranty terms timeline and was a candidate for replacement, we would provide the tree at no charge (you originally paid $250) and we would charge our hourly labor rate to remove the dead tree and replace with a new oneThe full warranty and terms are provided and will explain Nature by Design’s obligations ***

All material is guaranteed to be as specified, and the above work to be performed in accordance with the drawings and specifications submit[redacted]. It is the customer’s responsibility to locate, clearly identify, and notify Nature by Design of all underground conduits, wiring, pipes, septic systems, etc. Any damage to such underground conduits, wiring pipes, septic systems, etc. shall not be the responsibility of Nature by Design. The landscape contractor shall not be held responsible for concealed conditions such as, but not limi[redacted] to, rock, water, clay pan, asphalt or any other obstacles encountered which are not apparent at the time of estimating. Once material is delivered and installed, the responsibility for disappearance, theft, or vandalism shall be the customer’s. It will be the customer’s responsibility to clear the area to be landscaped of all debris, building materials and any other obstructions, unless Nature by Design is contrac[redacted] to do so. Purchased materials by Nature by Design that are returned to the supplier due to customer request or cancellation will carry a 30% re-stocking fee. All materials installed by Nature by Design will be true to name, and up to or beyond industry standards. Plants will be free from disease, insects, and in healthy condition when plan[redacted]. Proper watering, fertilizing, and pest control are necessary to maintain healthy plant growth.Before, during, or after installation, excessive storm damage may cause erosion of mulching and planting areas, dry streambeds and groundcover areas. Nature by Design will not be held responsible for any storm damage. We will restore the areas to their original condition after signing a work order to approve such restoration. Nature by Design reserves the right to impose a fuel surcharge to customers. Nature by Design and its advertising/marketing representatives retain the right to photograph the landscape work they have performed for the purpose of their website and/or company marketing materials, without remuneration or reimbursement to the client. No mention of name, address or otherwise personal information will be used in any publication of these photographs. Nature by Design reserves the right to place signage on the property during the construction period up to 30 days after the date of completion. All signage is property of Nature by Design, and if damaged or discarded prior to the deadline as mentioned, the property owner may be charged up to $100 in fees to cover the cost of the damaged or missing signage. A Service Charge of 5% per month will be added to all accounts 30 days or more past due. All payment is due upon receipt of the invoice unless otherwise agreed upon by Nature by Design. All plant material and construction warranties will be void after 30 days from date of invoice on past due accounts.All agreements are contingent upon strikes, accidents or delays beyond our control. Indemnification To the fullest extent permit[redacted] by law, Contractor, for itself and all parties acting under or through Contractor, shall indemnify and hold harmless Customer from and against all claims, damages, suits, losses and expenses of property, or bodily injury resulting from a negligent act on Contractor’s part. I found Lisa B., "Nature by Design" when I googled drought tolerant landscaping in my area. We bought a thirsty 2.3 acre property designed for horses that was carpeted in grass and non-native plants. Lisa is a devout lover of the earth and a genius in the field of native habitats, sustainable landscape and drought-tolerant design. I worked very closely with Lisa and her crew for over two months. I was worried that the "natives would look straggly, dead and dull, but instead it is blossoming into this lush and inviting landscape, displaying every color of the rainbow. The birds love it, the butterflies love it and we love it! Lisa is a master gardener and designer and in harmony with the natural landscape. Her crew is dedicated to "perfectionism". They are prompt, reliable, professional, conscientious, caring, with extremely good working ethics. They stayed on budget and were flexible with changes. Our project was designed, executed and finished in the most professional way. Make sure that you book Nature by Design at the first thought of landscaping your property...they are understandably very busy! Our yard design is the envy of our neighbors and a dream come true for us. It is absolutely stunning! We look forward to the redesign of our backyard.
