I am in receipt of your letter of October 14, regarding ID number [redacted] There are two relevant facts that need to be considered in regards to this complaintThe first is that the complaining party states "No ad, promotion information, or other correspondence suggested the deposit was nonrefundableThe second is that the party who filed the Complaint states the product ordered is an " [redacted] Rifle" and that "Gun delivery was due in January 2017..." To respond to those two central claims:RESPONSE TO CLAIM "No AD, PROMOTION INFORMATION OR OTHER CORRESPONDENCE SUGGESTED THE DEPOSIT WASNON-REFUNDABLE: Enclosed as "Attachment A" is a copy of the complaining party's order form, which was generated from the website www[redacted] .com The only way to generate that form was for the complaining party to scroll down to the "Exhibition Model" section and click the "RESERVE YOURRIFLE" icon, which takes you to the order form page where the complaining party was required to fill out the form on-lineEnclosed as "Attachment B” is a copy of the page showing the form, which have filled out with a [redacted] ***' for the purposes of demonstrationOnce the form is filled out, the Complaining party then clicked the "Submit" icon, as evidenced by what I have provided you in Attachment A, Clicking the "Submit" icon automatically brought the complaining party to the deposit page, a copy of which is enclosed as "Attachment C"In paragraph four of that page, the following is stated:This model rifle will begin delivery in January, All rifles will be delivered no later than May 1, By making this deposit, the buyer understands the deposit is to hold the order on this limited rifle, the deposit is non-refundable and that the balance due on the rifle must be paid within five (5) business days of written notifiction the rifle they ordered is ready to shipBuyer understand s that failure to pay the balance due on the rifle witin five (5) business days of written notifications of their rifle being ready to ship will result in their forfeiture of their deposit, in fullOnly non-delivery of your rifle by May 1, qualifies the buyer for a refund of their deposit.Enclosed as "Attachment D" is a copy of the ' [redacted] ***' confirmation email, which is identical to that shown in Attachment AI invite you to replicate this process to Confirm this factAs further confirmation of the process, I will gladly send you a copy of the confirmation email receive as wellIn summary, the complaining party was advised of the terms and conditions of their order, and depositRESPONSE TO CLAIM THE PRODUCT ORDERED WAS"COMMEMORATIVE BBCWEXHIBITION CENTENNIAL RIFLE AND THAT THE GUNDELIVERY WAS DUE IN JANUARY 2017: On this subject, we are in agreement with the statement the product ordered was, in fact, an Commemorative BBCW Exhibition Centennial RifleIt was not for the purchase of a marker plate, but a rifle, periodOn the subject of when the rifle was due for delivery direct you to Attachment C, which states the dates in which these rifles will be deliveredThe Complaining party's own statement makes it clear that rifles are to be delivered beginning in January of 2017, a full six months after his stating he contacted us for cancellation, July of Qur external Communication that we have demonstrated the complaining party received clearly states the time frames in which the rifles would be delivered, and the terms and conditions of which the deposit was provided.In sum, the complaining party states in the "Customer's Statement of the Problem" page for the Revdex.com his reason for wanting to cancel his order was due to "the Company's nonperformance" and that "No ad, promotion information, or other correspondence suggested the deposit was non-refundable." The above summary and attachments document conclusively this is not the case.The guns in question are being sold on behalf of the [redacted] to raise money for them and to commemorate their 100" year of operationThese rifles are all hand-engraved and hand finished, at tremendous expense, which is why we require a deposit for the riflesTo-date, we have taken over orders for rifles with deposits, with no other attempts at cancellation for the reason in which the complaining party statesWe have had cancellations for other reasons, with no other Customer requesting a refund of their deposit, Those deposits will be donated to the [redacted] at the conclusion of this program for themWe are willing to complete this transaction with the Complaining party if they so choose, if the complaining party chooses to not complete the transaction, per the clear terms of the transaction, we will not provide a refund of the deposit and, like the other cancelled orders referenced above, will donate that deposit as well.Respectfully, NAVY ARMS,LLCVal F [redacted] President

I invite you to replicate this process to Confirm this fact. As further confirmation of the process, I will gladly send you a copy of the confirmation email receive as well. In summary, the complaining party was advised of the terms and conditions of their order, and deposit.2. We are willing to complete this transaction with the Complaining party if they so choose, if the complaining party chooses to not complete the transaction, per the clear terms of the transaction, we will not provide a refund of the deposit and, like the other cancelled orders referenced above, will donate that deposit as well.Respectfully, NAVY ARMS,LLCVal F[redacted] President
