At the suggestion of March of Dimes we are going to start refunding calendar pre-orders at the end of the month and notify everyone of when the new 15 month redesigned calendars are printed.  At that point calendars orders will be handled directly by March of Dimes so that 100% of all monies...

collected will go directly to them.

We thank you for the...

opportunity to respond to this complaint from our customer, [redacted].  We would like to thank her for her participation in the March of Dimes fundraiser that we did last year.  As she correctly stated, our fundraiser featured pictures of children as fairies.  Our sitting fee was deeply discounted to $25 for the session and included a free 8 x 10 image.  This is from our normal cost of $350 for a fairy session.  Also, one hundred percent of the sitting fees collected were donated to the March of Dimes.  We are in agreement that she did receive all three promotional 8 x 10s. Following the fairy portrait session [redacted] participated in a sales session where she chose an additional package of images, again the proceeds of which were to benefit the March of Dimes.  Our standard for hand retouched art portraits, which these were, are six to eight weeks.  We also have a no refund policy stated on the sales materials. When [redacted] then proceeded to dispute the sale with her credit card company, we fully cooperated with the investigation.  They determined that since there was a no refund policy, and [redacted]'s products had been ordered, she was not entitled to a reversal of charges.  We went through the same process a second time.  Each time the credit card company removed the monies from our account during the duration of the investigation.  Again, they came to the same conclusion.  By this time her finished products were in house. We have fully cooperated twice with credit card investigations that have upheld our position.  We have retouched all of the images, ordered and paid for the products and have made the donation of the proceeds to the March of Dimes, in conjunction with all other proceeds from sales of fairy portraits, totaling $18,651.  Despite these facts, we are offering to resolve this dispute by refunding [redacted]s payment, if she so chooses, within 90 days.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved.

Review: I placed an order for a photo package that cost $175 and was told I would receive in August 2015. It is now 10/**/15, I still have not received them. I have left voice messages, sent numerous emails, sent [redacted] private messages and today a public message. I have not gotten any return response. They have not provided an order number, tracking number or anything. They are always closed. These photos are gifts to family members and time is running out. I want what I paid for or a full refund.Desired Settlement: I want my pictures immediately or a full refund.

Review: On July *, 2015 I took my children to a charity photo shoot hosted by ND Pro Media. This was an event advertised by ND Pro Media called "March of Dimes Magical Faeries for Babies 2015 Charity Calendar". For a $50 sitting fee/child (as well as an 8x10 photo), children could get dressed up and have photos taken of them by the photographer, Nuby.

I paid the $100 sitting fee (for 2 children) and they had their photo session. Afterwards I looked the photos with the Account Manager, Joanne G[redacted], and decided to order an additional photo package, totally $219.92. I left the studio that day with 2 8x10 photos as advertised. I was informed by Joanne that my photo package would arrive in the mail about 4-6 weeks later.

On 7/**, I received an email with a link to the online album so that I may view photos of my children from the photo shoot.

On 8/**, I emailed Joanne inquiring about the status of my order (as it was now 8 weeks since the photo shoot). During the days prior, I had been calling the company and leaving voicemail messages. No one ever picked up the phone. On this date, I also posted on their [redacted] page regarding not receiving my photo package and asking them to respond.

On 9/* a generic email regarding Order Update and Online Voting (for the charity calendar) was received. Below is the email:

"Order Update

First I would like to apologize to those who have been trying to reach out to get an update. This fundraiser was designed to raise money for March of Dimes and create awareness about our company. We do not even come close to breaking even with the amount of staff hours required to run the fundraiser. We rely heavily on video sales to maintain our high overhead. When we first started back in April we had a second photographer, three digital artists, a receptionist, a video sales rep and a studio manager. We lost our second photographer and receptionist soon after but we still managed to keep up with the pace. Having had to take over all the faerie portraits from that point on I had to rely on the video sales rep to do their job to maintain our cash flow. Unfortunately that person ended up being a bad hire and caused us to fall into a financial crisis. I have had to let staff go in order to keep the business running while I concentrate on the only thing that can get the company out of crisis mode - video sales and production. I've also had to cut Joanne's hours significantly so there is nobody in the sales office to answer phones most of the time. Even though she had to take another job for the time being she is still doing her very best to help here when she can. It has been a challenge wearing multiple hats but we are nearly out of the woods. We should be caught up with all orders by next month. I hope you can understand the situation and thank you for being patient.

Voting Is Now Live

All the contest entries are now up on the voting website. 100% of the voting proceeds go to March of Dimes. Last year we raised over $12,000 just in votes during this phase which helped March of Dimes reach their overall fundraising goal for the year. Voting will end September ** at 10:00 PM EST. Please Click Here to view the voting website. If there is an error with your child's name please let us know so we can correct it.

Thanks again."

On 9/* at 8:51am, I wrote to ND Pro Media that my child's name was spelled incorrectly on the voting page. Nuby Deleon replied to that email the same day, at 7:29pm (correcting the spelling of child's name).

On 9/**, ND Pro Media sent out an email about the end of online voting and a Latest Order Status. Excerpt is below:

Voting Ends Sept. ** at 10pm

We are down to the wire for the top 13 votes who will make it into the calendar. We have raised over $8,200 in votes already. Last year, in the last few days we jumped from about $8,000 to nearly $13,000 in votes. It would be amazing if we beat last year's number. Including the money raised during phase I we have raised nearly $14,000 for March of Dimes this year so far. Thank you to those who continue to support our cause despite the order delays.

Latest Order Status

We are happy to report that we will have all orders sent to the lab by Tuesday, Sept. **. We should receive products for delivery by the first week of October or sooner. Again, we apologize for the delay.

On 10/** @ 4:20pm I sent an email to ND Pro Media inquiring again as to the status of my pictures. At this point in time, the check for the original sitting fee had been cashed. No response recived.

On 10/**/30 @ 2:10 a final email was sent inquiring about the status of my product and requesting a response.

At this point, it is has been 4 months. No amount of phone calls, emails, posts is resolving this issue. I am now escalating this concern to the Revdex.com and will be working with my bank to try to reverse the charges.Desired Settlement: Ideally, I want the photos that I was promised and paid for on 7/*.

If that is not feasible, then I want the $219.92 refunded to me.

Business

Response:

The business has responded with the statement below:

When we were initially hired for the [redacted] Video job back in June 2013 we had an initial estimate to deliver the final edited product before the end of November. We were told by many of the parents that the videographer from previous years always delivered their products around November/December. Prior to us the videographer shot with one camera from the balcony which only required a trim of the beginning and the end of the video. This type of edit requires almost no work and should not take more than a month to deliver. Our production covered 5 days of rehearsals and 4 actual recitals that includes over 22 camera angles. There is a massive amount of footage to comb through in order to piece together a level of production never before done on a dance recital for the same price as a one camera/one day production charges.

Our initial estimates were based on having an in-house video editor to work on the project to finish it before we hit the busy season in the Fall. Unfortunately, we not only lost that editor due to life circumstances beyond their control, we also lost our studio manager who was instrumental in keeping regular communication with clients. Being a relatively new business we were forced to wear multiple hats to keep the work flow from getting out of control while finding people we can train to do the job properly. Until we find an affordable editor who is capable of doing such a massive project we have had to slice our time in order to balance jobs and cash flow so that we do not go out of business.

We can easily give the customers the same on camera edit where they can’t even see or recognize their kid’s faces but we would rather give them a product they will cherish and be proud of for generations. Most of the parents we have been in touch with are understanding of the situation and would prefer to have quality. Their only disappointment was that we had given them an inaccurate timeline. They said if they were told a more accurate timeline initially they would have understood the situation. We are doing the best we can to put the final touches on the video and deliver it before February *.

This company has been lying to me for almost 2 months & not returning my phone calls regarding this video. I have received a phone call from them a week ago stating I would receive the video within the week. I don't care about their excuses. If they had problems they should have contacted their customers regarding their finances. They have had everyone's money since 6/2013. Besides they did not video for the entire week because half the rehearsals where not on stage.

In order for the Revdex.com to appropriately process your response, you MUST answer the question above.

Sincerely,

Review: My daughters were photographed in the beginning of April 2015. I have paid ND Pro Media $500+ and have yet to receive my order! My emails have not been answered, phone calls/messages not returned, etc. I am extremely disappointed in this company's customer service and inability to produce what I ordered.Desired Settlement: I want a full refund for my order. No excuses from them. This is absolutely ridiculous.

Review: I have not yet received pictures ordered back in July and promised by August. I reached out and have not yet heard back. I've already paid for these pictures. I'm hoping the money the promised was going to March of Dimes charity actually went to there.Desired Settlement: Receive product, explanation of delay, refund of at least partial to make up for delay and evidence that money was donated to March of Dimes.

Review: I had photographs of my daughters taken as part of the fairie experience on June **. I paid over $400 for pictures (my check was cashed three days later) and was told my pictures would be shipped to me in 2-3 weeks. When I hadn't received the pictures in 3 weeks, I called and was told that they would take just a little longer and should arrive 4-6 weeks after I purchased them. The pictures didn't arrive even after 6 weeks. After the 6 weeks I called, e-mailed, and sent [redacted] messages, and have yet to receive a phone call or email in return. I even drove the 30 minutes from my house to their studio and couldn't get anyone to answer the door (I went during business hours). We are approaching 12 weeks since the pictures were taken and I still do not have my pictures, nor do I have a refund, or any form of communication from them.Desired Settlement: ND ProMedia has a responsibility to give me the product I paid for in the time frame in which it was promised. It's been almost 3 months.

We have been in touch with [redacted] to update her on her order status. An email was sent to all customers who were affected by a recent financial crisis that caused some orders to get delayed. For the most part it was well received but some customers are just impossible to satisfy no matter what we try. We are on track to catch up with every single order this month including [redacted].

Review: It started out as a donation to march of dimes, $25.00 per child to get pictures taken as fairies, I sent the check for $75.00 for 3 of my grandchildren, had an appt for the photos, then there was a catch To this(I should have known), I sat there and chose a package of photos for $608.47. Was told that they have to edit and it could take up to 2 to 4 weeks, so when two months went by tried calling several times and heard they were moving. I then called my credit card. Company to reverse the transaction and they disputed the charges and then dropped it stating that the company said I received what I paid for. I reopened the dispute a day after my cc company put the money back into ndpromedias [redacted] acct, I women that works there called me and asked if I would like a check from them? I said yes and that was two months ago still no check and my cc company closed the dispute again stating that ndpromedias gave me my photos, I told them the only photos I got were the 3 I paid $25.00 each for and it totaled $75.00.Desired Settlement: I would like for ND promedia to refund my money

Review: My daughter participated in a contest that the company was working in conjunction with to raise money for a charit - the March of Dimes. The nature of the contest was to have a professional image taken, which could then be used to raise money in the form of "votes" that would go towards the charity. Winners of the contest were promised to be a month in the 2016 calendar, which would be for sale to also raise money for the charity.

My daughters images were taken August *, 2015. We paid the $50 sitting fee for the session, as well as purchased over $500 in packages for additiona images which were promised to be ready in 4-6 weeks. In October, I started asking about the status of the images, as I was hoping to distribute as Christmas gifts. Fast forward to December, and still no images. FINALLY, after the owner created a [redacted] page to keep us updated (and failed to do so adequately), the images were available to pick up about a week before Christmas.

Within all this time frame, the contest for people to vote on images for the calendar to raise money in votes ($1 per vote) occurred on September. My daughter raised the most money, securing first place -- meaning she would be the cover of the calendar, free calendars, and a lifetime of free photography sessions. It was not easy raising the money, and we were happy that it was going to a great cause. Many of my family members were obviously interested in purchasing a calendar, since our sweet girl was the cover - and many of them preordered a calendar.

It is now the middle of Marxh. The owner, back in December, claimed the calendars were "at the printer". These calendars were also intended to be Christmas gifts, as well as thank-you gifts for donating so much money on my daughter's behalf. I didn't get my images in time to give as gifts, and there's still no word about calendars even being printed. There's rumors of him even wanted to create a 15 month calendar to make up for the months of the sweet children who will never even have their month displayed...meaning they're not even sent to print.

I took it upon myself to contact the March of Dimes myself to make sure that we weren't scammed. I was assured that their partnership was legitimate, and although they had problems working with ND Pro Media last year, they did In fact get their donation. My contact person worked very hard to encourage the business owner to get us our images, as promised. After all, we had paid in advance. She asked for the "donation" prior to the start of the new year so that they could crunch their numbers appropriately, and that never happened. At this time, we are being told that the money is in a community foundation as he deals with several allegations and/or lawsuits.

With the exception of some of the calendar sales, all of the products were paid for in advance. As a group, (I am in contact with several contest participants) we believe money intended as donations was used inappropriately.

I have contacted the owner through is [redacted] page to ask for refunds for the people who have preordered calendars. It's not fair that it is now March, and no work on if the charity will ever actually see the donation. My beautiful daughter will simply be overlooked as the cover id a calendar were to actually be used. While I HAVE received the goods I purchased, albeit in an UNREASONABLE amount of time, there are several people that I know have not. I am embarrassed to have participated in this event, and would like money to be returned where applicable.

I took itDesired Settlement: A refund for everyone who preorder a calendar and delivery of product (calendar), as I would still like one since my daughters image is being used.
