filed,we offer this response.
We raise and breed Australian Shepherds, and have done so for well over thirty years. The breed standard is well established and as a part of that breed standard, Aussies are generally born without tails. Aussie come Ifour basic colors, with many variations within each of those color patterns (blue merle, red merle, black tri,and red tri).  With two genders (male and female) there are eight possible results in any given litter.  Litters can have anywhere from four to eight puppies, with the average being six. When a tail is requested, then the possibilities of any given gender/color result increases to one in sixteen. It is unreasonable to expect that a puppy will be born with a tail earlier rather than later. Puppies are in fact born with tails at times, but most are born without tails. Thus it is not unreasonable to expect to have to wait for the expected outcome. All of our puppy sales are sold only in accordance with our sales terms. Those terms are posted prominently on our sales documents and on our web site. When a payment is made online, the payer agrees to the terms upon selecting the payment link. The complainant was aware of these facts and terms, and yet repeatedly remained with her request for a puppy born with a tail, despite others without tails being available. When a puppy is pre-paid for, thus placing the purchaser on a waiting list, they then hold a picking position, which is in front of others that may come along later. As a result of being on a waiting list, other sales are more than likely lost due to the existence of persons on the list and in front of new buyers. Thus we have, and have had, a forfeiture clause in oursales terms making the buyer aware of a cancellation fee if they choose to cancel their purchase, due to their place in line on the waiting list, which place prevents others from getting puppies ahead of them, in accordance with their request.Over these many years, people have graciously waited for the exact puppy they wanted most. Sometimes the wait is  short, and sometimes the wait can be long, but in every case, and without exception, all buyers have received their chosen Australian Shepherd puppy. We also have a policy of blocking abusive or spam related communications. We have followed our policy which is more than reasonable and more than fair, with great care.

We did receive a letter complaint on 5-15-2016, dated 5-11-2016.  No internet link was provided within that letter.  That complaint was responded to on 5-18-2016, via return letter.
