RE: Case #[redacted] First off I'd like to say thank you Revdex.com for contacting me on a customer complaint that you received. You are very accurate on there are two sides to every story. My response to the complaint is as follows;

received notice from [redacted] ex-wife that she was/has gone through a divorce and wanted to list their home for sale ([redacted] Family). She made it very clear that Mr. [redacted] was not fully on board and wanted to seek out other options on paying the wife (olga) share off by a possible refinance/mortgage,
Before Mr. [redacted] signed the listing agreement there was a few emails back and forth in which I provided information on sales in the area as well as listing agreement. I discussed with both [redacted] and [redacted] the estimated value was around 165,000.00 although we can start at 169,900.00 and take it from there as to what type of response we will receive. This estimate is also based on not viewing the property and can be subject to change. They were made very well aware that the listing price isn't a guarantee a buyer is willing to pay. It simply is a price we our marketing to sell. On October 12, 2015 I was asked to go ahead and prepare a new listing agreement on their property and he was ready to get the home on the market to sell. Once I received listing agreement from Mr. [redacted] r placed property on market on 11/11/15.
I received keys personally from his cx-wife on 11/12/15. Once receiving keys I made a trip to their home for the very first time. What I found was the home was a bit neglected. It had very strong urine scent and feces stains on all three bedrooms. There were items stilt in the home that were personal belongings. I immediately reached out to [redacted] and Mr. [redacted] to recommend minimum a carpet shampooing. This might improve desirability of the home. I was denied that request by Mr. [redacted]. I therefore still had home listed and being market for sale with lots of calls and showings.
On November 17, 2015 which is 17 Days after the listing contract. I received a full price offer from Buyer Mr. [redacted] and Mrs. [redacted] whom were being represented by [redacted].
immediately presented offer via email to Mr, [redacted]. I was shot down stating he was not interested in their offer. (Not exact verbiage but summed up). According to [redacted] was interested in waiting longer to see if "better" offers came through. She also commented to me on several occasions Mr. [redacted] was still trying to convince her to let him buy her out to pay her share off so he can retain the home.
So, therefore ! related message to selling agent of those buyers (listed above). She (selling agent) in return stated her clients were first time home buyers and wanted to explore other homes. So nothing came of the full price offer Mr. [redacted] so well desired. (Which in complaint states he never received) Per our listing contract. Please be aware I also emailed Mr. [redacted] scenarios if we countered offer at 172,000.00 so we wouldn't lose buyers. He denied my recommendations.
Well, the home sat for quite some time. I still had lots of interest and showings and no offers. I took it upon myself to notify [redacted] if it would okay if I [redacted] pay for a shampooing out of pocket to spruce up home to possibly make it more desirable(with no intentions on reimbursement). I was given the okay so I hired a company to clean carpets.
At, this time our listing contract is going to come due on April 12, 2016. I have had a total of 5 offers on their home. Please note one was presented on 03/24 in which Mr. [redacted] wanted me to relate to potential buyers to resubmit at listing price, As of 04/04 we received an offer from same potential buyers at listing price (per Mr. [redacted] request). As of last night I received email from Mr. [redacted] stating "great news please provide sellers net sheet". Today 04/05 I prepared net sheet and have emailed to Mr. [redacted] and [redacted] for review.
To sum up all this to say this, yes I did notify [redacted] the ex-wife that to please be aware I was going to give [redacted] an invoice for my work such as time and investment etc. Also you cannot list a home and have no intentions on selling, I am a commissioned based Real Estate Broker. I make my commission on selling. I did my due diligence in this entire transaction to bring a willing a ready buyer. Even at a full price offer which was denied. If my only concern was to make my commission as [redacted] claims I would have tried to persuade him on every offer that came in. I would have never made him aware of my recommendations to counter these people back at a higher price. Also, the time, investment on advertising, open houses sellers' net sheet for ever offer that came in, calls emails. That's what my invoice would consist of.
He's showed little interest on trying to be flexible or open minded on our ever changing Real Estate market. I have also notified him when other comparable became available.
I recommended sales price to be reduced to 165,000.00 because we were not receiving good feedback and new comparable came in at a lower price. I got the approval from [redacted] to reduce because [redacted] was out of town.
We received an offer at that full price of 165,000.00 also which [redacted] requested net sheet. He in return said let's go ahead. I related news to selling agent but unfortunately buyers backed out. This can happen at this time in the countering process. This was back in February 2016. He also requested me to "not submit any offers to him that are not full price". That is ILLEGAL- to discriminate against anyone. Also, all offers are to be presented to seller.
Mr. [redacted] didn't seem very happy and requested in Return to raise Listing price back to listing agreement price which is $169,900.00. So I immediately did.
Now like I mentioned we currently have a full price offer as [redacted] requested as of today 04/05.1 am waiting on a response.
My conclusion:
Consumers Original Complaint is False. He stated that I have not presented any offers at listing agreement. FALSE I presented offer of full price on 11/17/XX XXX,000. He stated I was trying to "bait" him. I have no control over the Real Estate Market and changes. If seller/[redacted] felt "Pressured" as he stated the property wouldn't be on its 5 month listed for sale with 5 total offers. I also would have not went out of my way to make home presentable so [redacted] can market home at a top market value.
The exterior of the home has declined in appearance significantly since Contract was signed to market for sale. [redacted] was and has been made aware since the beginning that appearance of home is an important selling factor. He has done nothing but the opposite of my recommendations.
