I started with Neil Construction doing a project at my former house When a deal came through and I moved from that location to my current one Neil was very understanding and matter fact did work for me at my old location bring some items up to code and minor fixes I was so impressed with his assistance and straight forward speak on the project that once I moved into my new location and sold my old house I signed him right up to put in a 24Xattached garage addition, roof entire house, reside entire hose and finishing my basement Neil has always been professional, information based, and easily contacted I worked with him through bad winter weather and rain My job got done I have never had any negative experience with his work or handling of our contract What I asked for and agreed to was delivered I would use Neil again for another project I appreciate what his company provided and how it was provided

Due to my mother’s age and health, we elected to procure a contractor to construct a new living area, bathroom, laundry room, closet and dining room addition, specifically for my mother, her furniture and belongings
On October 10, 2016, I provided a $36,first deposit to Neil W***, president & owner of Neil Construction Co., Inc., in accordance to an agreed contract totaling $94,for a foot by foot addition off our existing homeTwo additional payments were also provided; $30,on December 20, and $17,on January 26, Total payment made to Neil W*** is $83,Please note, however, that Neil W*** is NOT a contractor He is an inept, incompetent and an uncaring salesman!
November 28, the foundation was dug and by December 23, the concrete and block for my foundation was completed by *** *** ***, who did a terrific job However, as of May 24, 2017, *** *** was NEVER fully paid f

I am rejecting this response because: This response fails to address the majority of my concerns Over two weeks ago I forwarded Neil a list of (25) concerns that I have with the quality of the work his team has done at my property, and/or items that were promised in the contract but not provided Of those (25) items, Neil has agreed to satisfactorily address only (8) of them It has been (73) days since work on this project started and the following issues are still withstanding I have logs, written statements by building department officials, communications between Neil and I, videos, and photographs to support my claims Issues Neil has addressed and promised to take care of, but still need resolved: shutters were never ordered (he has agreed to a credit for the amount of the shutters), drywall throughout the house needs repaired and finished, soffit that was torn down and discarded for no reason needs replaced, no house wrap was installed on the bottom portion of the house, window seat needs to be finished and trimmed, basement window needs to be trimmed (when and if it ever gets installed properly), one screen on window seat has an apparent manufacturer's defect, and leftover materials are still sitting on my lawn.Issues Neil has failed to satisfactorily address: I want a deduction for the labor to remove the debris that Neil left on my lawn for (5) weeks, I want a deduction for the clean up around my property because Neil's guys did not pick up after themselves, the large window in the window seat is damaged, the inspector has yet to approve the work on the big basement window, the big basement window is crooked (perhaps due to a bent frame) and is not operating properly, (2) windows have damaged screens that don't appear to be manufacturer's defects, the low voltage cable that connects to the water meter has been cut and needs replaced, I want a deduction for the electrical work I had to complete myself, my front porch was damaged by the siding contractors, no house wrap was used on the North Wall (contract states entire house), no backer board was used on east, west, and south walls (contract calls for it on entire house)(Neil has agreed to deduct the price of the backer board, but this is not acceptable I hired Neil for the job because he promised R Value backer board on the entire house Failing to do that part of the job, then offering a tiny reduction for his failure to do so is not acceptable), R Value backer board was used on North wall (contract calls for R Value), large dead spots on my lawn from trash and materials being left there for months, no piano hinge window seat (we were advised that if we opted to forego the piano hinge that our new window could and would be tied in to the existing soffit We chose this option because we didn't want the window to require a separate roof We sent photos of how we wanted it to look and Neil agreed that it would look that way Instead, we got no piano hinged seat AND we have the separate roof that Neil promised us we wouldn't have), the inspector will not "pass" the window seat unless all of the drywall and siding is removed for a proper inspection, and some of the trim work that has been done thus far is not of acceptable quality.Neil and I have been in communication, and he has been agreeable with regards to most of the small stuff However, he continues to ignore my requests to address ALL of my issues I have asked him to provide responses in writing, but he refuses to do so He wants to communicate only verbally, but his verbal word has been unreliable to this point Thus, I want him to address my concerns in writing We no longer feel comfortable with Neil's ability to complete the job We would like to negotiate a price to call it good with Neil, have him walk away, and we can then hire a more caring and capable contractor to clean up his wreckage We feel that due to the many items that Neil promised in writing, but failed to provide, that he is in breach of our contract I would prefer to handle this outside of court, but we cannot in good conscience pay him the amount we originally agreed to when so many contractually obligated items have not been completed per the terms of the contract, and so many other issues remain unaddressed There is also the point of fact that this job is now on day (73), despite Neil's verbal promises to have it wrapped up in 2-weeks

On 4/3/I contracted with Neil to complete a window project on my home I gave him $5,as a down payment, another $4,at the time the windows were delivered, and agreed to pay him $1,upon completion of the project At a later date I agreed to hire Neil to complete a siding project, and Neil gave me a contract that stated that payment wasn't due until days after completion of all projects Work started on 4/24/2017, and is yet to be completed Neil failed to pull the proper permits and allowed his subcontractors to install windows without proper headers They have reinstalled the window twice now, but it is still not up to local building code Additionally, there is still drywall work, window trim, and electrical work that needs completed Furthermore, the subcontractors damaged portions of my house as well as some of my new windows Neil has refused to stand by their work, and has even filed a lien against my property despite the fact that he hasn't completed t

My wife and I recently had Neil Construction build a new deck at our houseWe are very happy with the results! The crew were friendly, personable, and went above and beyond to make sure that we were satisfied customersI would highly recommend them if you need any larger home projects doneThe entire team from the top down did exceptional work and I wouldn't hesitate to use them again

We contracted with Neil Construction to build a small attached garage Our experience found that Neil Construction sub contracts work and does not supervise the work completed MrNeil W*** is difficult to reach and does not fix shoddy work in a timely manner Our contract was designed for the completion of the garage exterior before receiving a second payment There were many issues that needed corrected before 2nd payment could be made It did not pass building inspection Despite this, Neil Construction stopped the work and demanded second payment .After a series of threatening voice mails from MrW***, we contacted a lawyer In the end, we agreed to put the final payment in escrow if MrW*** completed the work as described He refused to do this and so we fired him from the jobDespite the fact that he had been paid for the all the work he performed, he filed a lien against our home We had to pay another contractor to tear down much of work that had been completed by Neil Construction and then pay them to the work and complete the job

My experience with Neil Construction was terrific! The gentleman was very on the ball with communication with me as I am about a hour drive away from the Stow area he was to work on It is an older home, and his contract and explanations were very helpful to me and he went out of his way to show us work nearby on homes he had completed He even offered to meet me halfway during our consultation about the work needed to be done While making my decision about who to hire for the job, Neil kept in constant contact with me which was a huge decision maker for me in my selection We are very pleased with his work and the cleanup afterward, and his contact with me since then saying if I had any questions or concerns to be sure and contact him I am happy to say I have had no complaints or questions Very dependable and professional work crew as well!

Chanukkah & Christmas Holidays
I did not have my file with me, and therefore, I wanted to wait until I returned home to "accurately" answer this Complaint
For my Response, please accept the following:
I have enclosed my "Menu", dated 9/2/
I have enclosed the "Contract", dated 9/21/
Neither the Menu or the Contract state anything
anything about a hot water tank, yet, the home-
owner continually demands that I purchase her a
hot water tank*** *** continually
contorts the "TRUE" nature of this issue to suit
her demands
Upon signing the "Contract", I stated that I may
be able to start her attic remodeling project
within 7-days, depending upon another project
scheduleHowever, at the very latest, it would
be no later than approxone (1) month
This "other" project came in first, & obtained
their financing; therefore, their project came
first, and this project started approxone
month laterThe project began just fine, with
all parties quite pleasedAt the very onset of
this project, Mr***, on three occasions,
requested that I DO NOT pull a permit for this
projectHe stated that he wanted to remodel his
first floor bathroom, which he did, and that he
was not going to pull a homeowners' permit
we had NOTHING to do with this first floor bath
Therefore, DO NOT pull a permit for my given
projectI have a witness to this discussion
My sub-contractor (carpenter) heard this request
& is quite willing to testify to this statement
It is NOT my usual practice to not pull a
permit; however, I wanted this project & was
under the opinion that I would not be given it
if I pulled said permitBelieve me, I regret
this rather "stupid" decisionI have the
insurance, and therefore, I could have pulled
a permit with no problemAs previously stated,
the project began with no problemI purchased
ALL of the wiring, insulation, drywall, &
plumbing pieces & parts, with no issue
When Mrs*** went to Home Depot, to order
her fixtures, the problems beganFirst, the
store delivered a shower base which was cracked
at one end, and the shipper, we believe,
attempted to "fix" it by caulking/glueing it
It was quite obvious! Not only did this incident
totally screw up our schedule, but, as stated,
we were involved on another project, where good
weather was important to finish the exterior of
said projectThen, Mrs*** ordered another
shower base, & this one was supposed to arrive
in town on Nov19, 2015, per the homeowner
When it arrived days earlier than expected, I
sent my men to the store to pick it up, and
accomodated her by giving her three (3) days of
service, to further her project along
PLEASE KEEP IN MIND THAT WAS A BUSY SEASON,
AND THAT THIS WAS A SURE SIGN THAT MY DOWNTURN
FOR THE PAST FIVE YEARS WAS CERTAINLY OVER!
Due to this upsurge in business, needless to
say, we were all scrambling to service every
jobInstead of waiting until Nov19th, I gave
the ***s days of service, accomodating them
on Nov11, 12, & 13thI answered a text from
Mrs***, stating that I would return on
Mon., Tues., & Wedbefore Thanksgiving, & that
she would be done before Turkey day, except for
the carpetingThe very next morning, she wrote
to the Revdex.com, The State of Ohio, & Home Advisor
Instead of appreciating my accomodations to her,
she began to cause trouble, and here is where
the true problems beganPlease note that this
date was still before Nov19, the date when she
stated that her shower base would arrive in
townI HAD TO RETURN TO FINISH ANOTHER ROOM
ADDITION PROJECT, DUE TO THE WEATHER CONDITIONS
NO ONE EVER EXPECTED NICE WEATHER IN DECEMBER
HAD WE KNOWN THE FORECAST IN ADVANCE, I COULD
HAVE REMAINED & COMPLETED THIS PROJECT
All throughout this project, I told the ***s
my schedule, and, this was fully accepted by
themAfter disparaging me to several media
outlets, Mrs*** then complained about not
having a permitHypocritically, she
participated in one of these three discussions
about not pulling said permitShe has NO
credibility whatsoever!
Please read her DESIRED RESOLUTION comment
She states that, "she would like for the Company
to complete her project, or return the money."
From day one, I have constantly written & stated
that I would be willing to complete this
projectFor someone who is willing to complete
their duties, why would a homeowner who
possesses the least bit of credibility write to
the Revdex.com, the State of Ohio, HomeAdvisor, and
furthermore, attempt to have my insurance
company pay for her damages? Answer: Because
she has NO CREDIBILITY, whatsoever!!!
She has single-handedly turned a project with
accommodation into a nightmare!
Regarding the project itself: the Attic was
framed properlyThe wiring was done correctly
The plumbing was done correctly, we believe
I have a licensed plumber, who was a former
City Inspector for another city, who will
inspect said plumbingHowever, my carpenter
cut several floor joists where he placed the
plumbing trunk lines, which was a mistake on his
partThe good news, as an employer, is that my
sub-contractor is fully willing to CORRECT his
mistake, by fixing said floor joists, and
placing said trunk lines in a soffit, to be
built below the attic, in their garageThe
***s are aware of this plan, and they have
both approved of this plan
In late November, after Thxgiving, I met with
the BldgCommissioner of Macedonia, and
explained my situationHe gave me my
REGISTRATION for & (Enclosed!)
He stated that, upon the City inspecting the
attic, he would issue me a permit, based upon
drawings I submitted to City Hall, and be
allowed to continue said projectMrs*** is
fully aware that this "delay" is due to the City
and that, upon inspection, we will resume this
jobAs stated, I AM FULLY COMMITTED TO
COMPLETING THIS PROJECT TO THEIR SATISFACTION!
It is during this "lull", waiting for the City,
that Mrs*** is making hay, having fun, &
complaining to anyone that will listen
I cannot do anything until the City allows me to
proceed!
Did my carpenter make a mistake by cutting the
floor joists? Yes
Is that the only mistake that I am aware of?
Yes!
Do we clean up the area every day before
leaving? Yes!
Is my Contract quite thorough & explicit? Yes!
Has my Company ever made mistakes in the past?
***, yes!
To continue: Mrs*** spent much more than
the "stated" 1,"fixture, faucet, & floor
allowance" in the Contract! She is giving me
grief about this, as wellShe selected very
nice fixturesThis is why I always include an
"ALLOWANCE"! I cannot allow a client an open-
ended blank check to purchase whatever they
wantI include a certain dollar amount, based
on answers to my questions, and, above that, the
Customer is responsible for payingShe even
argued about this matter, even after signing my
Contract a month earlier
Furthermore, did she inform you that she
BOUNCED a $ 7,check to me? Of course,
NOT! (Enclosed!!!!!) Yet, I still agreed to
continue! She made the check good later that
day, by getting me an Official Check, but not
before yelling at me! (My men heard this!)
Additionally, she states, in her DESIRED RESOL-
UTION comment, that she wants me to complete her
projectI have told her, on several occasions,
that I will! Then, why did she retain counsel?
Can you see the lack of credibility here?
My carpenter stopped by the home, weeks ago,
when she initially BREACHED our Contract, and
she refused to return my carpenter's tools to
himFurthermore, she constantly is videotaping
& recording ALL of these calls/or visits, and, I
am told by counsel, that this action is illegal!
She is not informing us that we are being taped
or recorded whatsoever! Again, is this the
behavior of someone who desires to work with
their Contractor, to mutually fulfull their job?
I THINK NOT!
To Conclude: Aside from ALL of the threats of
legal action, Fox news, Revdex.com, State of Ohio,
Home Advisor, etc..., I AM FULLY READY, WILLING,
& ABLE TO COMPLETE THIS PROJECT

siding was paid for by an insurance claim filed by said homeowner, and therefore, he has the means to pay for said job.Homeowner is quite pleased with his vinyl siding portion of the job. However, 9 of 11 windows were installed to his satisfaction.It is true that my men originally installed one window without a proper header, and this is now corrected.The window seat is installed properly, but with some revisions from the original plan.  there is no window seat hinge, due to the fact that homeowner didn't want the window to stick out past his existing gutter line.I am in continual communication with said homeowner, and the two of us are striving to resolve ALL ISSUES.

came to my house the contract was already typed.He wrote in red ink gutter repair SO IT IS IN THE CONTRACT.We just did not specify what repair did not think we had to.WHAT a mistake.He also wrote in red ink 4 BOX VENTS ALSO IN CONTRACT.WILL send copy of contract to Revdex.com to put in my file.We agreed to fix corner section of gutter on driveway side.Neil told [redacted] Officer [redacted] that he would replace my gutters by Saturday 8/22/15.That has come and gone but he charged my card for a job that's finished.IF he would of subtracted his damage before he charged my card but read his texts.I will make it right but again who pays for a job thats not complete.I HAVE included telephone texts between me and Neil to the Revdex.com.IF NEED be I can come to Akron and let them see my telephone that me and Neil were texting back and forth.Neil should of minus the $40 for the vents and the $530 for the gutters these are his words read the texts.AGAIN BEFORE he went behind my back and charged my card.I never said he was not going to get paid just subtract your damage from the $3000 not charge my card for the total price of job when you acknowledge that you did not for fill the contract.HE never asked me to charge my card thats why I filed a dispute with my bank.IF he would of finished the job he would of got his money and not have to sign my card with fraud in mind.MY parents gutters are hanging because his workers pulled down one side and never returned.PLEASE NOTE GUTTERS ARE LISTED IN OUR CONTRACT HAND WRITTEN IN INK BY NEIL W[redacted].He said how bad of job his sub-contractor did that he would never hire them again PLEASE NOTE IN OUR TEXT MESSAGES HE AGREED TO FIX HIS WORKERS DAMAGE.THE TEXTS DON"T LIE.I will be sending a copy of the contract in the mail tonight.I SENT TEXT MESSAGES FROM MY TELEPHONE TO [redacted] E-MAIL PLEASE INCLUDE THEM TO MY FILE.If you do not receive the texts I will send a copy with the contract.

0- I have the contract if it was important to have the 4 box vent in the contract have your guys install them when they do their repairs
1- The box vents will take away from the ridgevent. It was my mistake [redacted]. Ask an inspector.
2- You got the job saying I need 4 box vents so .I will tell the inspector that your crew will be installing 4 vents and he need to be there when they install them.
3- [redacted], I earned the job for many more reasons than box vents. Having two different types of vents in one elevation is NOT good or necessary. I would rather refund you the 10 each that was charged. Like I said, that remark was my mistake. Please don't tell me how to do my job. Box vents are for areas that have NO ridge.
4- I ain't telling how to do your job just what we agreed for the roof. You said we need 4 more vents and that's what I want.
5- U need to come and look at those joist they are on the opposite side of the driveway they had nothing to do with the gutters getting bent.The gutters got bent from the front. Yes they do need a 1x6 board no great cost.Now the gutters are one long piece in the front not pieced together and I will not accept them trying to piece together 2 pieces of gutters. So once they fix there gutters and clean the siding and put the siding back up ,also the siding piece by the condenser is damage We can go thru the walk thru
6- [redacted], I WILL order new seamless gutters with fascia for the FRONT only. Ed will be back tomorrow to clean. Cannot replace the siding. Sorry for this crew, [redacted]. They will not do any more work for me. Neil
7- [redacted], A terrible mistake/misunderstanding has occured. I told you that I will absorb the cost for front gutters & fascia only. (Approx. 530.00) I also stated that I would charge the balance owing me, since I was paying for said gutters. I'm sorry you either didn't hear that, or that you believed I would commit a crime. I'm not like that at all. I called my gutter guy. By Saturday, you should be ALL DONE! NEIL
8- You never mention charging my card because the job was never finished. Who pays for a job that is not finished.
9- Ed heard me. So did my girlfriend. When you called me a [redacted], I said I'd see you in court. The next day, you called to apologize, mentioned the facia board was indeed rotten, & I said I'd supply the gutters. That's when I said I wanted to get paid, since I was trying to satisfy you [redacted]. I will NEVER commit theft! Ever! At 60 years old, I won't start doing that now. Please believe me! Neil
10- You can say what you want now but nobody pay until the job is complete. You not going to pay somebody if the job is not finished. And by the way I didn't call you a [redacted]
11- You did [redacted]. Ed & [redacted] heard it loud & clear. You should remember what you say when you're mad. No need to fight. I am taking care of you. In an earlier text, I apologized for hiring Ed. Big mistake! This is not the result I wanted. I wanted your satisfaction!
