Nektar Wine Bar

Nektar as per Nektar's reservation policy, they take reservations for parties of 8 or more ppl, and thus $20 deposit per person. However, I called at 12:07pm August 24, 2019 and spoke to Justin (an employee) for 10 minutes in which he explained their policy (which is also clearly stated on their voicemail) and took my credit card information, subsequently charging my card $160.00. Not two minutes after that conversation, at 12:19 pm, I called back and told him our party has been reduced to 7 ppl and possibly even 6. He responded with, "Well, I already took the deposit so we'll keep the reservation." At that point he should have refunded me my deposit as it does not accord with their policy. Furthermore, the deposit he took was for 8 people when in fact, only 7 people were at that point coming. Nor did he explain to me that upon late arrival I'd lose my deposit. If he had, I'd never have made the reservation in the first place as I knew there was a possibility that we'd be running late from the destination from which we were coming. As per my understanding of what he explained, as long as we showed up, which we did, my deposit would be honored. However, they didn't follow their policy when it came to taking my deposit (since they took a deposit of $160.00 for 7 ppl and they take a $20.00 per person deposit only when the party is 8 or more people) , but then decided to follow their policy when it came to keeping my deposit because we showed up late. Those are not ethical business practices. The deposit should never have been taken. I'd have come with my party of 6 at whatever time we got there and written down our name on the list as per their policy and none of this would have happened.
