Complaint: ***I am rejecting this response because:
I understand the position that Nell's Quality Installations is taking because they have all the legal right on their side. Based on the installer's denial of causing the damage, the fact that I rested by knee on the front of the stove, and that I signed off on the installation before I had thoroughly inspected, they have a legal right to refuse any further investigation at this pointWhile legally, they may have no responsibility to do further investigation and have enough evidence to close the case no matter what our objection might be, they do have an obligation to their customers to get to the truth of the matter. The have stated in their letter that we have not substantiated our claim. But we are offering substantial physical evidence that we believe would prove our claim, and that is a cooktop with not only cracks but sharp punctures in the back of the range that was made by something hard and sharp.
In spite of their holding the installation sign-off, we will continue to maintain that their installer did the damage until Nell's or a third party actually view the damaged top. Their satisfactory completion form signed erroneously by me is actually disputed evidence; the condition of the cooktop and the damage that is still there as it was right after we discovered it is the real evidence
With Nell's number of years in this business, one would think they would care that a customer could be so upset and want to get to the truth of the matter. Also, I see that in the since May there have been customer reviews of Nells, of which are negative. While this isn't reflected on their Revdex.com Trends Chart, it should be, and it should be interpreted, then that they seem to be in decline of their "quali6ty" installation
It appears at this time that *** will be replacing the top, so the situation will be handled by them, after their receipt of a letter from the State Attorney General. This is no way means we are accepting the response made by Nell's because we will continue to maintain that Nell's installer is the one that damaged our cooktop

***Dear *** ***,We did install a dishwasher and microhood for Mr*** on 6/17/Upon arrival my installer Justin saw that the previous microhood was an old wall mounted unit and the new unit that was bought had to be mounted to either a cabinet or shelf above the unitMy installer Justin instructed Mr*** on the type of shelf neededMr*** then installed the shelf while the dishwasher was being installedIf there was a protective moving blanket covering the cooktop at this time I do not knowMr*** was the one working above cooktop at this time and it would have been his responsibility to protect the cooktop at that timeWhen my installer proceeded to install the microhood to the shelf the cooktop was covered with a very thick moving blanket folded to be extra thickThis is standard installation procedure and all my installers follow thisMy installer confirmed using the protective blanket.As stated in Mr***'s letter, Mrand Mrs*** were not in the room upon installationThey said they heard muttering and gruntingLifting a microhood into place takes effort and the something that bumped could have been the microhood bumping the wall or the shelfExpecting not to hear anything during the installation of built in appliance is ridiculousIf he had dropped the microhood on the range top then not only the cooktop would have been damaged but the microhood also would of shown damage.Upon completion of the job there are two forms that the customer signsThe *** completion form which I have attached and a Pre-lnstall/Post-lnstall Form that I have also attachedMr*** has signed both forms acknowledging satisfied completion and no damage doneSaying they just signed the forms and did not check the area does not change the fact that they did sign these formsThey signed off on the job as completed and satisfactory.These forms are prepared by attorneys and on the recommendation of our insurance companyThese forms are to protect us from the customers making such claims as the *** are makingThey did not see my installer damage anything and they signed off on the job.We have been in business for over yearsFifteen years with *** and the last years with ***We have top ratings with both companiesWe install approximately 10,appliances in a single year and are very good at what we doWe do take responsibility for our installations and our warrantiesMr*** is making a claim he cannot substantiateMy signed completion forms dismiss our responsibility in the damage to their cooktop*** has also closed the claim due to the customer signing off on the installation.We are not sending anyone out to view the damage or to check the rangeWe are not turning this over to our insurance company.RespectfullyNell's Quality Installation, Inc.Shelley A N***) Ownercc: *** ***
