In November of 2016; *** Surveying was approached by Real Estate Agent Claudia *** to perform a property survey in the Cuyama areaSince the property lies in a remote area and survey activity had not been performed for several years, Ms*** and Mr *** agreed that we should research
available records for sufficient survey controlThe amount of $was paid by Mr***. On January 10, 2017; Mr*** and *** Surveying; Incentered into a contract of an estimated amount of $10,for surveying services of his property by both signature and a retainer of $2,Shortly thereafter a field crew was dispatched to begin the work and continued until March 16, During that period several invoices which totaled the remaining $7,were sent to Mr*** in which he did not express any objection and was agreeableHowever, no funds were received. From May through July, numerous letters were sent along with phone calls requesting payment only to be ignoredSince it appeared that Mr*** may not pay the balance of the contract, we assigned the matter over to a collection agencyOur Company has been more than accommodating to Mr*** in keeping him fully aware of the status of the surveyFurther, we are more than willing to provide him a report of our survey; however, Mr*** to this point has ignored our numerous requests for payment as outlined in the contractTherefore, we did not feel it prudent to provide this report until payment has been provided. In regards to permission from ad-joining owners, California Civil Code and Penal Code grants the Licensed Land Surveyor the right of entry on or to real property without the provision of prior notice thus exempt from trespassIn the interest of surveying Mr***'s property we exercised these laws and entered the ad-joining properties without permission to perform our servicesDuring our visit we were able to contact several owners in the area who witnessed our presence. We feel we fulfilled our portion of the contract and are owed the amount requestedIf you have any questions do not hesitate to contact me

Re: *** Surveying correspondence Mr*** had agreed during past telephone conversations, US Mail and emails to: Provide visual proof of his firms accomplishments in surveying my property The names and contact information of the adjacent land owners he had contact with Defer my payment until the property closed escrow I have not received from Mr *** visual or photographic evidence of his firm's accomplishmentsI have not received from Mr *** the contact information for the adjacent land ownersThis property is still listed for sale with a licensed real estate agent The original surveying estimate was $10,and that was too lowIf I had known *** Surveying would far exceed this estimate I would not have agreed to do business with Mr ***. *** Surveying has stopped work on my property and left the job unfinished To summarize: I do not have evidence of what, if anything, was accomplished by *** Surveying on my property Mr *** continues to refuse to provide the names and contact information of the adjacent land owners Escrow has not closed I do not feel I should pay for goods and services that I have no confirmation of receiving If this information is readily available from *** Surveying why does he refuse to share it?
