his video taken on his cell phone, accused of lying, and I would like to review where he is claiming that he received an email where he was mocked. I did not send an email so it would have needed to be another individual in our office and I would be more than willing to apologize if this is true. The reason we decided to not accept responsibility for this claim is, after speaking with the individual and reviewing the cell phone video we were unable to see where we had liability for his claim. First the truck that he videoed was pulling a trailer which was empty and had not been hauling rocks, gravel, dirt but was a trailer to move equipment. We were unable to see in the video any rock coming from our vehicle as he claimed, in fact from our observation it appeared that where are multiple rock chips in the window as per the video footage. I had to ask myself how a truck that was not hauling gravel could loose that many rock all at one time off an empty trailer. Also if I was driving behind a truck that was loosing gravel, my reaction would be to back off so I didn't continue to be pelted with rocks rather than pulling up along the side of the truck and video the truck as rocks were coming at me. Our Company also has a policy (rule) that after the driver unloads his trailer that he inspects and sweeps the trailer to make sure that any loose items are removed or secured before they leave the site where they unloaded. We had other personnel at the location that he unloaded and was asked if they noticed if the driver had cleaned and swept the trailer after unloading. The report was that he did, in fact, one of the personal at the site said he helped him sweep the trailer.I feel this individuals pain regarding have a rock come of the road and damaging his window. I have had it happen to me more than once. State law states, that when an object comes up of the road from another vehicle and damages the vehicle next to them or behind them that it is considered a road hazard based that the vehicle is not neglectful in securing his load or vehicle is breaking the law by not maintaining the vehicle in a safe condition.
