To Whom It May Concern: Attached is a response letter from Debra R[redacted] regarding the complaint from [redacted]. Walk-throughs: I,
Debra R[redacted], did the 1st walk-through with the buyers, [redacted]...
and
[redacted] the night before closing.
The seller’s moving company was still there moving out the seller’s
belongings. The cleaning lady (a friend
of the sellers) was also there. There
was a few knicks at that time. The
next morning we went back over to the house and did a 2nd walk-through after signing. The seller
was still moving out items and the garage was fairly full. At this time we noticed lots more damages
done by movers. I spoke to the buyers
about this and [redacted], being a professional dry wall person, thought $200
would cover the damages on the walls.
The buyers stated they would be changing the laminate on the stairs to
carpet, so the damaged trim on the stairs would be no problem. I called and left a message for the other
agent, [redacted], and told him about the request for $200. Seller had not signed yet when I called. [redacted] called after they signed and said
seller was okay with $200. I informed
the title company to hold off the recording until we knew what the buyers
wanted to do. The title company called
around 3:42 pm and stated they could fund and record. I let [redacted]’ know that and gave them the
option of going forward and close that day or holding off on the funding and
recording. They said to go ahead. After
funding and recording, we went back through a 3rd time and the
seller was still there moving items out.
There was even more damages that we were visable then.Damages: Then
there were bids done on the damages.
These differentiated substantially.
On the laminate stairs, the laminate bid would have to be for total
replacement; since they could not replace just the trim pieces. The buyers kept telling me they were going to
put in carpet on the stairs and down the upstairs hall to match. The bid to do carpet on the stairs was
$488.84 versus over $2483.76 to replace the laminate. They wanted to replace all the carpet up the
stairs and down the upstairs hall to match at that time. Promised items: I
offered to help with various things, but the buyers changed their minds several
times as to what they wanted to do in regards to the damages. I also came back
numerous times after closing; even going above and beyond to the point of
paying to have trash, broken items, a dog house, hoses, cabinet, paint, and
more items picked up and removed from the property to help the buyer at my
cost. Carpet cleaning: We had
a discussion about having the carpet cleaned.
[redacted]’s response was that she had 3 children and several dogs and did
not seem concerned about it.Unavailable for buyer: I have
phone records that show 44 phone calls made to the [redacted]’ or received from just
the [redacted] during December 20th, 2016 to January 28th,
2017. I have not received my current
cell bill for tracking calls after January 28th. Along with all the phone calls, this does not
include texts and over 15 emails from December 26th, 2015 to
February 1st, 2017 between me and the [redacted]‘ (buyers). These phones calls, emails, and texts do not
include any of the communications that I had with [redacted] (the other Realtor),
the buyer’s father, the lending institution, the title company, and the contractors. Some of the times I called [redacted], I was
not able to leave a message because his voice mail was not set up on his
phone. Even up to the middle of
February, his voice mail was still not set up.
I was told not to contact [redacted] because she had fallen and broke her
leg and had, had surgery. I have
documentation to back up all the phone calls, emails, texts, and etc. This can
be produced upon request. I also
dropped by and brought in a meal for [redacted] after her surgery and release from
the hospital. Conclusion: I know
that I have been available and responded in a timely matter to all of the
issues that came up with the buyer’s new home.
The lines of communication were open.
I have relayed offers back and for the buyers. It has been difficult to resolve the issue,
because the buyers changed their mind several times throughout the process and
threatened to sue. At this time, the
buyers and sellers are working on
resolving the matter.
