The vehicle that was brought in February of 2017 was a 2006 Subaru Baja with 140,000 miles on it. At the time it was brought in, the vehicle was using oil. We determined that the majority of the oil leak was coming from the head gaskets. As the job progressed we also found there was noise in the...

engine and metal in the oil. We advised the customer the engine should be rebuilt. The customer approved the rebuild. We outsourced the engine rebuild to another shop. Within the “rebuild”, the seals and gaskets were replaced along with the bearings in the engine, which is what was causing the metal in the oil and the noise the engine was making. The piston rings were not replaced at this time as the engine rebuilder did not feel it was necessary. We reinstalled the engine at Nelson Auto Sales with new timing belt and components to ensure no problems would occur. The vehicle was then returned to the customer. The customer returned soon after concerned with smoke coming from the exhaust. We assumed that the rings were replaced in the original rebuild but they were not replaced as stated above. We took care of the customer on this occasion and had the engine rebuilt again with new rings and a couple of pistons at no cost to the customer. The vehicle was returned to the customer in good working order. The vehicle was towed in to us again 1700 miles from original repair. We inspected the vehicle and after some diagnostics we found that the engine was overheated severely. Because the vehicle was driven hot there was damage to the head gaskets and radiator. There was no way to tell if the vehicle was driven without coolant or what caused the overheating issue because when it got here there was no coolant in it. As the diagnostics continued we found that the block had been damaged from overheating. The short block of the engine needs to be replaced due to what has happened. We advised the customer of what needed to be done and that the total job would cost in the neighborhood of $4000. I attempted to work with the customer and offered to pay for everything but the short block which would cost him anywhere from $1500 to $2100 depending on which brand he went with. Both options are remanufactured engines, the more expensive option is from Subaru directly. I feel that we have been more than fair in trying to resolve this unfortunate situation.[redacted]

The consumer did not pay for anything he did not get. Yes, the engine was rebuilt, but the rebuild that was paid for did not include piston rings. It was “assumed” that they were replaced but they were not, as it did not seem necessary at the time. If we had them done, the rebuild would have cost even more money. We did not want to do anything unnecessary at the time so that it would save the customer money. The vehicle did not blow a head gasket when it was returned the second time. Again, the vehicle was repaired at no charge to the customer at this time. The only thing that should have been done the first time that was not done would be the piston rings being replaced. However, we replaced them very soon after the initial rebuild at no cost. They are not what caused the latest issue with the engine. On the most recent occasion the engine did not blow up. It overheated and blew the head gasket and the radiator. The customer requested the vehicle to be towed to his house at this time and yes the engine is not together. It is not usable and cannot be put back together. As I stated in my last response, I feel that I am being more than fair with the customer in trying to work with him. There is no other shop that would even go to the extent we are to help him. It has been almost a year since the original repair. I have already repaired the engine at no cost to him once and cannot do it again without replacing the short block and that is the only thing the customer needs to pay for. The engine work that we have done had nothing to do with the vehicle overheating, which is what caused the issue it has now. $1500 is less than half of what it is going to cost us to do the repair and that is all the customer would owe.
