the middle of April 2015, G & R was...

asked by my father-in-law to come check
out the floors at the [redacted] Corbett Salon and I proceeded to test the moisture
in the wood. At that time, my father-in-law was in talks with [redacted] about
possibly partnering with him once the renovated salon re-opened. [redacted], my
father-in-law and I all spoke and [redacted] let me know he was quoted $16,000 to
have his floors redone excluding the cost of the materials. I told him our cost
was roughly $50,000 excluding materials and I told him I would not charge him the
extra labor costs and the overall cost would be roughly $30,000. On April [redacted],
2015, we started to remove the existing floor due to the water damage. Upon
demo and removing the existing floor, the sub-floor was completely water
damaged as well in certain areas, particularly the back area by the color bar
and front entrance. After having many discussions with [redacted] and my
father-in-law, it was decided th at G & R would replace the entire
sub-floor due to the fact [redacted] and my father-in-law wanted to install 7"
wide planks which would not be possible if the sub-floor was not level. In a 2
ft section some areas were as different as 1 - 1 1/2". In order for the
7" wide planks to be installed the floor needs to be level or flat. [redacted]
was well aware of the decision to level the floor. Every day we worked, [redacted]
was sent a daily work report as well as pics of the progress. Our scope of work
also included: side staining of all the planks (4 men for 2 days), we
installed, glued and nailed down 7" wide planks (approx 1450 sq ft)
throughout salon with full spread glue and we built and installed one custom
saddle at the front entrance. We bought the masonite to protect the floors
while the lights were installed. We hired a garbage removal company to remove
the debris and we also cleaned the entire salon before the sanding and
finishing following the other contr actors working. We even applied an extra
sealant coat at the time of installation to avoid moisture due to the fact we
were unable to start sanding and finishing immediately. I had to contact [redacted]
to find out when we could get back in the salon following the lights being
finished. [redacted] and my father-in-law requested G & R to also buy and
restore the baseboards which we did as well. Regarding the sanding and finishing
of the floors, a commercial grade finish was never discussed and [redacted] was well
aware after doing the color sample with him that we would only be applying 1
coat dye, 1 coat stain, and 3 coats of oil-based polyurethane. At this point, I
believe [redacted] and my father-in-law had decided to go their separate ways. The
day we applied the stain the AC unit turned off that night. That being said,
when we went in the next day to apply the first coat of polyurethane it was too
humid and upon application the polyurethane picked up the stain and floor was
not right. W e notified [redacted] right away but unfortunately this can happen
sometimes on very hot summer days. The following day at G & R's cost we
immediately re-sanded the floors. We refinished the floors over the next few
days. [redacted] and I argued about his losing one week of his salon and we came to
an agreement that I would deduct $3,000 from the bill for the time lost.
However I am still owed $7,700 dollars for labor. We also notified [redacted] that
with freshly finished floors it looks dry but easily scratches on the first few
days following application. I also notified him to use felt tips for the bottom
of the furniture and to stay off the floors as long as he could. I have no
control over my father-in-laws actions. My partner and I reached out to [redacted]
numerous times and he would only get back to us days later.

[redacted] rejects the statements made by G&R.* G&R never submitted a proposal for $50,000, nor was such an amount agreed to.  G&R was informed of the other flooring contractor bids (2), the highest being $30,000 which included the cost of the flooring, sub-flooring, carting services for the debris and commercial grade polyurethane sealing, among other things.  [redacted] was assured that the cost of the entire project would be less due to the "friends and family discount" the father-in-law was providing [redacted] by using his son-in-law (Gabor G[redacted] of G&R).  Originally the cost of the flooring was to be paid by the father-in-law as part of his potential partnership with [redacted], however, since the partnership was not formally agreed to [redacted] paid the expense with the understanding that it would be considered a monetary investment in the business.  Since no partnership was ever agreed to G&R subsequently demanded $50,000.* It was always required that G&R would put down commercial grade polyurethane, [redacted] is a ground floor commercial space with high foot traffic.* G&R failed to remove debris costing [redacted] additional monies for their removal.* G&R has two (2) sets of keys they failed to return resulting in an additional expense to [redacted] of $200 to replace the locks.*  The floors were already level as this commercial space was fully renovated 4 years prior by the landlord, Peter Ting and [redacted].[redacted] paid $10,000 approximately for the flooring, G&R paid nothing.* The base boards installed by G&R were part of the original flooring agreement and the expense of G&R not [redacted].  The boards installed were of inferior quality and poorly installed (in some areas missing entirely) and will therefore have to be completely redone for an additional $1,500.* The sub-floor material expense was the responsibility of G&R as part of the flooring job.* All of the bottoms of the furniture in [redacted] have felt on them.* The mistake made by G&R when applying the first coat of sealant set [redacted] back by one (1) week and incurring over $5,000 in additional rent payments.* G&R destroyed a door and door frame leading to an outside storage area and it will cost [redacted] and additional $1,600 to replace the door and have it hung.[redacted] will have to have the floor resealed due to G&R not applying commercial grade polyurethane to the floors, this will cost approximately $3,500.[redacted] will have to close the business for at least one (1) week in order to reseal the floor costing [redacted] an additional $15,000 in lost income.[redacted] demands repayment for the additional rent payments, door replacement, base board replacement, resealing the floor and lost income.
