I purchased a used vehicle from Network Auto Source INC on 01/06/2020. The vehicle was sold "as-is" with verbal assurance at the time of purchase that the vehicle had undergone inspection from their own mechanic and could be "trusted". Two family witnesses can provide testimony that the dealer stood behind the condition of the car. During my drive home with the vehicle, I noticed smoking from under the hood and managed to get it back home safely. The morning after (Tuesday 1/07) I noticed a large puddle of oil under the front passenger wheel well. The dealership is almost 40 miles from home, so I sought a local mechanic specializing in the model of car to ensure that it was safe to drive. I was able to get an inspection from the mechanic on Friday 1/10, where they found evidence of tampered components on the engine. A seal from the engine had failed and was essentially glued back in place which caused friction damage to another set of components and the oil leak. The mechanic noted that the condition of the seal looked like a fraudulent attempt to cover up a greater issue with the engine and make the car sellable. The issue with the tampered part is compounding and has resulted in considerable cost estimates for repair. I contacted the dealer over the phone to see how they would be able to help or come to some resolution, where the dealer admitted that they were aware of the oil leak and didn't believe it was serious enough to notify a potential buyer or warrant inspection and repair. At this time the dealer has been unwilling to work with me on a potential solution, and stands behind the sale of the vehicle being "as-is". I believe selling a vehicle "as-is" is not a defense for selling a knowingly faulty product and willingly putting a buyer at risk with their negligence. A vehicle sold as-is should be expected to run safely at time of sale.

Sorry for a late response. We did not have any knowledge of any sub standard repair. All vehicles are sold as is. AS/IS Buyer guides plainly state on the back of them a list of potential things that are associated with an used vehicle. Oil leaks are one of them. We offered to help the customer by having him bring it back to our shop. He declined the offer to bring it back to us for help and decided to have it fixed elsewhere. He just assumed that we would help him out financially.Mr. declined an Extended Warranty that was offered to him at the time of sale as well. I just wished that he had brought it back to our shop. It's a good idea to have a presale inspection done on any vehicle before you purchase it.Clayton J

I am rejecting this response because:

There was no offer extended for me to return the vehicle for the dealer's mechanic to service, or any expressed guarantee of assistance. I took the vehicle to a local specialist to prevent any further damage to the vehicle or myself if it was unfit to drive. As mentioned, the dealership is 40 miles away from my home, it's not reasonable to drive a potentially dangerous car that distance again in the event of significant issues. As it turns out, the vehicle was not safe to drive as outlined in the mechanic's notes.

The "extended warranty" that I declined is not a warranty at all, it's a service plan that covers a portion of the cost of future repairs. Warranty implies some guarantee of the product.

Further still, none of the dealer statements nor the AS-IS condition excuse the sale of a non-functioning vehicle. Just because it starts and runs does not mean that it's safe to drive, and the as-is condition for an automobile implies at least roadworthy capability.

Simply put this is a case of he said, he said. The fact is
that the vehicle was sold as-is with no warranty. We did not authorize any
outside work. We can’t legally pick and choose who we pay outside repairs to
when the vehicle is sold as-is, no warranty. That precedent would make us responsible for
repairs to everyone that ever bought a car from us in the past and to everyone
that buys a vehicle from us in the future. Resolution: Customer can
trade his vehicle back in for another vehicle on our lot. It is suggested that
a presale inspection be completed prior to purchase by a third party repair shop.
