In August of 2012, I as Power of Attorney for my step-mother *** of Herbert,SK had a load of furniture picked up at her residence in Herbert by Neufeld Auctions to take to their business for sale or auction. I made periodic contact with Neufeld Auctions to check on the status of the furniture sales etc., and was advised that the furniture had not yet been sold. Fast Forward to the end of 2018, my step-mom passed away on Dec.30/18 in a senior's care home. Being the executor of my step-mom's estate, I contacted Neufeld Auctions to see what had happened to the furniture that was picked up in the summer of 2012, and had heard nothing other than it still hadn't sold, and had not received any funds for the sale of same. The response I received from *** (owner) was that he did not know if he could even find out what happened to this furniture or the proceeds of sale, if indeed the furniture sold, as he only keeps records for 5 years. Below, please find a copy of the last email sent to ***.

I have not heard back from you in quite some time now. I am still looking for information from you about what happened to the load of furniture that was picked up at my step-mother, ***'s home in Herbert in the summer of 2012? Have you found any answers in your investigation of this matter? Surely the furniture, or the proceeds of the sale of this furniture wouldn't simply vanish without a trace? As the executor of her estate, I really need to bring this matter to a conclusion.

Finish the job Surely the furniture, or the proceeds of the sale of this furniture wouldn't simply vanish without a trace? Is keeping records for only 5 years an acceptable or even legal business practice? I realize that from the time this furniture was picked up until the time of my inquiry as executor of my step-mom's estate was about 6.5 years, surely this simply cannot be passed off as not being able to find any record of the furniture or its sale. This requires a satisfactory resolution for the client.

I had responded to Mr. twice in regards to the said items. Perhaps I did not make myself clear. If I have no record of sales then the items would have been unable to sell. As Mr. has written we were contacted on more than one occasion as to the status of the said items. If memory serves me correct the said items were in good condition but very dated. Normally these items would not be accepted for sale but in an effort to help I told him we would try our best to get rid of them. Obviously we were unable to do so. Now I believe items in question consisted of a sofa and chair coffee table set swivel chair and appliances(later picked up by *** Our policy is to offer these items that are unsellable to a local charity and if they are not accepted we dispose of them. Being that said items were delivered over 6 years ago I am giving Mr. the benefit of the doubt that they were donated and not disposed of. In the case of disposal there is a $ 20 fee per item. My sales are all computerized and have been since the mid 90's. If the items had been sold by auction there would be a record. I have spent considerable time checking and rechecking and have found no record of sales. I will e mail Mr. and repeat what is contained in this letter.

It was only after I contacted the Revdex.com that I received information from Neufeld Auctions that the said furniture items likely had never sold, and were probably offered to a charity or disposed of. Up until that time, the information that I received was only that the items still hadn't sold. In an email from *** dated Jan.11/19 he writes "I am checking the status of those items. I have no paperwork on file so I'm assuming payment was issued. I only keep non-GST records for 5 years, so we may not succeed in finding out." Now that I have involved the Revdex.com the information has changed somewhat, and I am now informed that these furniture items were likely never sold and were possibly offered to charity or disposed of. I am frankly surprised and disappointed that Neufeld Auctions would choose to go this route without any consultation with their client what-so-ever or even communicate the results of how the furniture was disposed of, at the time it took place. Had that information been communicated to the client (owner of the furniture) in real time, all of my calls to them inquiring about the status of the furniture, and now my contacting the Revdex.com to get some answers, would not have been necessary.
