To whom this concerns,Since starting service at *** *** there have been a few issues but not to the degree that was reported to you I would like to respond to the issue he mentions We were accused of theft of a headphones / earbuds and possibly a jacket and were told they had
surveillance of this but then we were later told they don’t have cameras in those areas but “would soon be installing some there” The only thing they've shared with us surveillance wise is pictures of the cleaning lady showing up and then leaving, with time stamps on a night of a short clean, as well as her car in the parking lot timestamped leaving, along with pictures of the alarm log that day *** asked us for pictures of the cleaning crew so they would know what they look like to compare to surveillance which we also provided, along with the cleaning crews personal headphones that they bring with them to use while cleaning We do not tolerate theft and told *** that if they had proof of our crew stealing then we would report & press charges ourselves but he would not provide this proof he said he had He only seemed to want to “move on from it” once we told him how we would deal with it.In regards to his vandalism claim, the “unfinished & uncased” janitorial closet door which is located directly behind the bathroom door when you enter has only a deadbolt that *** had always left the key in *** admitted to us that one of their staff or tenants had broken the key off in the lock Our crew spoke with *** late that night via text and cell phone to tell him about the broken key and our crew stated that *** told them to break into the door or do whatever they needed to do to access the closet to get their equipment so that they could clean that evening Our crew said they didn't feel comfortable trying to break into the closet but they only did so because *** told them toLater, *** disagreed and said that he never told them to do that and he wanted us to repair the door which we agreed we would do We told *** to get it repaired and send us a copy of the invoice for repair and that EcoCare would take care of the bill but he never provided a bill for the repair.Regarding the times we did not clean their facility we gladly offered to give credit for those days and reduce their monthly bill accordingly which we have done We did not charge them for the days of not cleaning nor did they pay for them of those days were due to *** requesting us change the crew due to the janitorial closet door damage and it took days to find a replacement crew to service them at the under priced rate.In regards to the crew changes, *** called and wanted us to start service immediately We got them started with a temporary crew within hours but then put in a permanent crew (we normally have days) Then the incident with the janitorial closet door occured and *** asked us to change the crew which we did Once we had a new requested crew in place we did have to change them out one time due to the crew saying there was not enough money paid for what it actually takes to clean the facility We totally understood this because when bidding this account, it should be priced at $1,per month but *** / *** said they only have a $1,per month budget for cleaning which we agreed we would take them on at with the agreement that as *** grew and gained more “tenants / income” that we would adjust the monthly cleaning rate upwards *** has grown and seems almost full but has never offered to adjust the billing accordingly In the beginning *** was also complaining of things not getting done, such as exterior windows, etcwhich are not part of the contract specifications When *** ***, our sales manager asked him if he read the contract & specs *** told him no, I just called you and signed the contract fast because we were in need of a serviceRegarding the request to cancel services, we told *** that he needed to follow the steps in Section of the contract for early cancellationWhich is below Otherwise, if he did not want to do that another option would be to buyout of the contract for the remaining price of the contract but that was not a demand, that was only another option given to himThe term of this Agreement shall be for twelve (12) months beginning on the date services are to start , asindicated next to CLIENT’S signature below, and shall automatically renew for an additional twelve (12) monthperiod upon each anniversary date unless either party shall notify the other party in writing at least forty five days(45) before the anniversary date of its election not to renew for the additional twelve (12) month periodIf a partyto this Agreement fails to perform according to its obligations hereunder (“the non-performingparty”), the party claiming non-performance (“the claiming party”) may send the non-performingparty written notice by certified mail, addressed to such party at the address set forth in thisAgreement specifying and listing the precise manner of non-performanceSuch notice shallprovide that the non- performing party will have fifteen (15) days from receipt of the notice tocure or correct the items of non-performanceIf such notice of non-performance is delivered andthe items have not been corrected or cured within such fifteen (15) day period, the claiming partymay terminate this Agreement by sending the non-performing party a thirty (30) day notice oftermination in writing, via certified mail return receipt requested, and this Agreement shallterminate, subject to Section below, at the end of such thirty (30) day periodCLIENTacknowledges that certified mail must be used to deliver any notice of deficiencies and/orterminationNotification not in absolute compliance with the aforementioned method ofcommunication shall not be recognized as valid notification of deficiency or termination

I am rejecting this response because:The response is riddled with lies. EcoCare continues to hold us to a contract and will not release us from payment, even though their cleaning staff have damaged our facilities, stolen from our members, and have failed to perform.
