Complaint: [redacted]
I am rejecting this response because:Re:  Concerning Lindy S[redacted] response to my Revdex.com complaint.I have two contracts that Lindy S[redacted] brought to us.  The first one on 5/2/2016 was for a 700 sq ft addition Extension of existing Dinning Room and new master bed and bathroom with a porch and additional sq ft on the garage including other detail that would be included concerning the work to be done.  This was for a price of $30,000.00.  Lindy states that before her work on the contract portion started that we did an electrical upgrade and added a combo unit for refrigerated air and forced heat. This had nothing to do with Lindy's contract and did not impact her work. This was to accommodate the additional sq ft that was to be added.  In fact Lindy was fully aware of this work as we ask her what was needed and her husband did the electrical upgrade and she brought us the HVAC contractor to install the new unit.  This was coordinated with Lindy so as to fit into the new construction.  We paid for this work directly to her husband and the HVAC contractor prior to any work being started on the addition.  Lindy was fully aware of these events as she brought and negotiated the price on the HVAC unit.   Lindy S[redacted] continually stated that she could get us a better deal on all phases of the work and repeated over and over that we were NOT allowed to talk to the sub-contractors.Any time we talked about the project or asked her about any work on the project we asked her what the cost would be.  Other than the following second contract we never approved any change in cost either by change order or verbal acknowledgment.  In fact we specifically repeated over and over that we needed to know and approve of any change in cost as we were on a very tight budget.A second contract was brought to us on 6/22/2017 as we added 102 sq ft to the family room and decided to upgrade the rest of the windows in the house at the same time as the addition to save money.  The second contract showed the sq ft as 802 sq ft addition with 140 sq ft porch and new existing windows for a total of $34,000.00.  Lindy also included a list of standard features and allowances for fixtures, tile etc.Her actions concerning the alleged voiding of the original contract are bogus as she continued the project all the way.  If she had quit it would have constituted an abandonment of the Contract.  Lindy S[redacted] did NOT show the full email exchange and the spreadsheet  that she showed is not the one that was sent to me.  The spreadsheet also contains inaccuracies. Lindy stated that she did not have contact with me after 11/10/2016 yet she also states that she helped get the final inspection and that did not happen until January 2017.  The only bill that I was asked by Lindy to negotiate through her was the original electrician that she did not pay.  The only reason that contractors refused to come to the job is because Lindy had not paid them.  The only time that I talked with the sub-contractors is when they did not show up to do the work and I wanted to know what was going on.  I have never called Lindy S[redacted] any names or yelled at any of the workers.  I have only demanded to know what was going on after many delays and no-shows.  The contractors never submitted invoice to me.  I submit that the contractors have told me very different stories that what Lindy alleges.  I can give you a list of the sub-contractors that I know about and they can be contacted for the truth. The liens that were placed on the house were early in the project when Lindy had full control over the work and payment.  The first one was for the concrete pad and foundation that I had already paid her for.  Lindy S[redacted] said that I agreed to pay them is not true as I did not even know who they were until the lien was placed on the house.  That work was completed and should have been paid for 6 or more months before the project was completed.  Why would I offer to pay the sub-contractors when I had already paid her for the work.  Hopefully after I had discussions with the concrete company this lien should be removed soon. The second was for the building materials contracted by Lindy S[redacted] to Mr [redacted] who bought the framing materials from [redacted] who threatened to sue Mr [redacted], Lindy S[redacted] and us for the balance owed.  Again, I did not know who these companies were until I received legal and lien notices.  Not knowing any better at the time and at the instance of Lindy and Mr [redacted] I gave them a portion of the amount owed ($4133.27) which legally I did not owe as I had already paid Lindy more than that on the project.  I have since found out that since I did not hire them or contract directly with them and that the liens are not legal and cannot be enforced although it is up to me to have them removed if the contractor (Lindy S[redacted]) does not pay them and have them removed.  I contacted the Attorney for [redacted] and the lien was eventually removed. The third lien was from Mr [redacted] and in discussions by me with [redacted] of Mr [redacted] it has now been removed. The wonderful gift that Lindy gave us is to misrepresent herself and the cost of the project.  If we had known the full cost we would not have done this project.  We now believe that she never intended to do the project for the contract amount.  Whenever we asked for documentation or paid invoice to contractors that came to our house stating that she had not paid them (contractors that she hired), we were met with threats and accusations from Lindy S[redacted], like the threat to cancel the contract.   We also believe that we are not the only one that she has scammed.  I believe that there is a $18,000 judgment on file against her and possible other legal actions.  Believe me she did NOT do it free of charge.  Lindy does not even show her real address on the documents that she attached.Unlike Lindy, I do not make these statements without having proof of what I have stated
Regards,

05/22/2017 Revdex.com, I often do pro bono work for residence of the Community of Rio Rancho and the Military. I have done dozens of contracts and work and have never had an issue and sadly now I understand why a lot of Companies are deterred from this type of work. I will not...

be doing anymore! I was approached by my Husband [redacted]) to help a member of the Elks Lodge [redacted] and [redacted] (we will call them the [redacted]). Originally this was a small 500SQ FT addition and they wanted to only spend 30,000. I offered my services for free and on several occasions told them that in-order to do this at my cost, that we could not add any additional SQ FT to the contracted amount. Well little did I know that would not be the case. Before my work commenced on the contract portion, they did an electrical upgrade, add a combo unit (refrigerated air and forced heat). They also added a full window package and an addition 200 SQ FT. I talked with my sub-contractors and we decided that we would move forward with the 700 SQ FT if nothing changed to the plan, and The [redacted] agreed. We added the windows to the Contracted and Moved forward. The plan then grew another 102 SQ Ft with an additional 140 SQ FT to the porch. I told the [redacted] that there were going to be added cost moving forward and they then also agreed. On November 10th, I told them that they could pay the subcontractors for the additional amount directly and we agreed. When the Contractors submitted the invoices to The [redacted], they tried to negotiate their bill, 1E You were only here X amount of time so I am only going to pay you Y amount of money and on several occasions, I help mediate the situate. I was not under contract, I did not have to pay the invoice, and I didn't negotiate it anything just helped to defuse the situation. The [redacted] made the situation so bad that a lot of the contractors walked away and refused to go back. The [redacted] were and are very aware of all of this. My subcontracts have not made any such statements to him at all. They work with me every day. In fact, will back me up with everything that I am writing you in this letter is indeed true and that the statements made by the [redacted] in the Attached is very much un-true. The full payment of the original contract has not been paid and that the [redacted] took over paying the sub-contractors on Nov 10th, 2016 (Please see attached e-mail correspondence to The [redacted]) where I told them that our original contract was null and void. I at that time attached a spread sheet of what it would cost for them to finish and told them that if [redacted] behaver did not stop then he would not only owe the sub contracts the additional amount but me 15,000 additional dollars (the cost I would have charged) At that point, he had upset everyone that had worked on his project. His response was yes, he wanted to continue so the sub-contractors proceed and I no longer had or have a contract with The [redacted]. He has liens on his house from the sub-contractors because he agreed to pay them and has not. He had a lien that was attached by [redacted] that he stated that he negotiated the removal of that lien and that is not at all what happen. Mr. [redacted] paid [redacted] off so his account would not be suspended and placed his own lien on The [redacted] residence. There were no negotiations done by The [redacted] that removed that Lien. Once again Mr. [redacted] is at this point the one that is out the Monies. The [redacted] are calling sub-contractor still yelling and screaming at them and demanding the liens be removed, but as you are aware they will not do that until they are paid in full. (FYI this is defamation of Character) In the end, I myself went for free and helped The [redacted] finish this project and get a Certificate of Occupancy. My feeling was still at that time all about helping them and FREE OF CHARGE! How does someone do such horrible things to someone that gave them such a wonderful gift! We all understand that The [redacted] got way in over their head and at one point I was going to try and absorbed some of the subcontractors cost to help them (yes, I am that good and honest of a person), but I am NOT going to do that now. In Conclusion, I have not had a contract with the [redacted] since November the 10TH, 2016 and have provided the documentation accordingly. Thank youLindy S[redacted]Mitchell Construction LLC
