I represent Unifund CCR, LLC (“Unifund”) and write in response to Ms***’s recent complaint with the Revdex.comWe appreciate the opportunity to address your concerns.In Ms***’s complaint, she indicates that Unifund is reporting her account as “open” and that your account was
discharged in bankruptcy.Without seeing a copy of that portion of her credit report to which she refers, it is somewhat difficult to address her concernsHowever, it appears that Unifund has been reporting this account to the consumer reporting agencies accuratelyThe only field in which we report “open” is the account typeUnifund reports in accordance with the Metro Guidelines (“Metro 2”) promulgated by the Consumer Data Industry Association, the trade association of the consumer reporting agenciesDebt buyers and third party collection agencies are required to report the portfolio type as “Open,” as seen in the Metro excerpt below:This does not mean that the account is “open” in the sense of being available for usageInstead, it is a type of account, distinguished from other types of accounts, such as revolving, mortgage, line of credit, etcUnder Metro 2, “open” is defined as follows:In addition to reporting Ms***’s account as “open,” Unifund has been reporting the field identified by Metro Guidelines as the Consumer Information Indicator to reflect that her account was discharged in bankruptcy
