The statement of deposit accounts was submitted in accordance with the lease contract that was signed by the lessee Deposit shall be returned within days or a statement sent with an explanation of charges The Move/In checklist was used as a guide and pictures were taken of the condition of the apartment at move out If the apartment had been moved into in the condition that it was left in upon move-out, there would have been notations on the Move/In checklist The pictures clearly explain the charges and show a lack of cleaning at move-out The residents needed to break their lease and found someone to re-let their apartment before the lease term endedPossibly there wasn't time to thoroughly clean before moving out of state We have only billed for charges that are dueThe water heater leak was the hallway and the lessee was not charged for that The living room was heavily soiled/damagedWe did not charge for wear and tear, only items that were left unclean and above wear and tear

Complaint: [redacted] I am rejecting this response because:If the landlord thinks the apartment should be left "identical" as move/in, then no, it wasn'tWe don't believe anyone in the world has the ability to leave an apartment identical after living in it for two yearsWe understand they are running a businessWe understood that they would charge a reasonable fee if things were left uncleanHowever, charging as much as they did is absurdThe landlord wants us to pay for the apartment being reconditioned and ready for the next tenantThe landlord is trying to pass on their cost of doing business to us and even make a profitFor instance, we cleaned the shower door and shower tiles multiple times using towels, brushes, hot water and soapThe landlord charged us $for that; please show us pictures and the receipts of your cleaning cost on that to prove it's reasonableThe landlord charged $for "all vinyl floors"The only part that was not cleaned well was right at the entrance-about sqfeetFor the carpet, someone is being dishonest, because the original words of [redacted] were: "tell the office about the carpet when you move out and they won't charge you"We forgot to tell the office when we moved outWith [redacted] being busy taking care of the whole apartment complex, it's highly unlikely he remembered to remind the office not to charge usNow, since we are complaining to Revdex.com, the management claims that we were not charged for thatHow was that even possible? The water heater damage was mostly in the hallway but there was some in the living room tooPlease answer these questions: without the water heater damage, you wouldn't need to replace the carpet, so how much would it cost to professionally clean the living room carpet? As far as we know, it is possible to clean rooms for under $in the Fort Collins areaWhy would you charge us $123.66? Please show pictures to prove that the living room carpet really needed to be replaced and how old were the carpets? The whole time we lived there, there had been worms in our apartmentHonestly, the office did send pest control to take care of it in the beginningHowever, the worms kept coming back, and we just dealt with itWith so many dead worms underneath the carpet, how long do you expect the carpet to last? At this point, it's not even about the money, we feel like we were good tenants, always paying rent on timeIt's just wrong for the landlord to mistreat people and try to overcharge people for everythingRegards, [redacted] ***

[redacted] Hi Jay, Thank you for returning my phone call Per our conversation I have attached a letter that was sent to Ms [redacted] on December 2, and a copy of the receipt of mailing and a tracking of the receipt of the certified mailing at the address which it was mailed to If you have further questions, please do not hesitate to contact meRegards, [redacted] , ManagerNew Colony ApartmentsSShields StreetFort Collins, CO 80526P: [redacted] F: 970-224- December 1, J [redacted] *** [redacted] * [redacted] *** [redacted] Dear Ms***, We are responding to the request through the Revdex.comNew Colony was your landlord from October 13, until July 25, and we believe that we treated you fairly Upon giving a notice to vacate you received a cleaning guideYou were only charged for items that were left dirty or damagedI have included rceipts of the sub contractor costs that we incurredCleaning charges were only assessed if the cleaning was above and beyond wear and tearWe are providing these receipts so that you many understand that we are treating you fairly and that we have no further obligations and do not owe treble damages and wish to resolve this by payment that is due Please do not hesitate to contact us with any additional questions that you might have Sincerely, [redacted] New Colony/Manager

Dear Mrand Mrs***,Please accept our apologies for the misspelling of your name, it was certainly not intentional. We have been advised to discontinue our discussion with you because of the demeaning and condescending nature of the tone of your responses. We have taken care of our obligation to provide explanation of chargesOur employee’s hourly rate of pay, worker’s comp, health insurance, etc… are all factored into the cost of cleaning. Upon notice to vacate each resident is given a copy of the cleaning guide and charges that correspondWe wish you the very best

Complaint: ***I am rejecting this response because:It is disappointing that the landlord does not seem to take this issue as seriously as it should be takenThere have been typos and errors in almost all of their responsesOur last name is "***", not "***", by the way. We raised many questions in our initial complaint and in our subsequent responsesThe landlord simply avoided answering our questions directly. We never claimed that we left the carpet in perfect conditionThe dispute about the carpet was always over the question "Without the damage caused by YOUR EMPLOYEE, would you have had to replace the carpet? Why did you charge us for your employee's fault?" The pictures and the carpet bills do not help at allThe statement from *** is completely irrelevant because it does not address who caused the damageIt is worth mentioning that the carpet cost $in and it cost $in It is very interesting that the landlord chose to charge us a portion of the higher amount. Let's say you paid a million dollars for an item years ago and the market changed, and now the same item is worth very littleIf someone damaged your item, would you ask for the original million dollars? The landlord's responses are meaningless if they do not address our questions directlyThe landlord should honor an employee's wordsAt this point, we request a letter from ***, with his signature, confirming that he told the management about the carpet damage caused by the water heater BEFORE the landlord sent us the first statement and that the management did not overcharge usWe trust ***'s integrity. The pictures sent to us by the landlord are meaninglessSome of the pictures show exactly the damage caused by the water heaterSome show things we never challenged in the first placeSome show damage that was there when we moved inThe real question is why did the landlord charge so muchFor example, the landlord charged $for cleaning the glass shower door, $for cleaning ceiling fixtures and $for cleaning the windowsThis is absurdIt would be cheaper to buy new light fixtures. What was the cleaner's rate? We would like to see the receipts for cleaning. Once we receive ***'s signed letter and the receipts for cleaning, we will pay.Regards,*** *** *** ***

We treat each resident with respect and follow fair housing guidelines. The claimant was not charged for wear and tear, but cleaning and painting and damages above and beyond wear and tear and pet fees per the signed "Pet Addendum"

I am rejecting this response because:If the landlord thinks the apartment should be left "identical" as move/in, then no, it wasn't. We don't believe anyone in the world has the ability to leave an apartment identical after living in it for two years. We understand they are running a business. We understood that they would charge a reasonable fee if things were left unclean. However, charging as much as they did is absurd. The landlord wants us to pay for the apartment being reconditioned and ready for the next tenant. The landlord is trying to pass on their cost of doing business to us and even make a profit. For instance, we cleaned the shower door and shower tiles multiple times using towels, brushes, hot water and soap. The landlord charged us $50 for that; please show us pictures and the receipts of your cleaning cost on that to prove it's reasonable. The landlord charged $60 for "all vinyl floors". The only part that was not cleaned well was right at the entrance-about 10 sq. feet. For the carpet, someone is being dishonest, because the original words of [redacted] were: "tell the office about the carpet when you move out and they won't charge you". We forgot to tell the office when we moved out. With [redacted] being busy taking care of the whole apartment complex, it's highly unlikely he remembered to remind the office not to charge us. Now, since we are complaining to Revdex.com, the management claims that we were not charged for that. How was that even possible? The water heater damage was mostly in the hallway but there was some in the living room too. Please answer these questions: without the water heater damage, you wouldn't need to replace the carpet, so how much would it cost to professionally clean the living room carpet? As far as we know, it is possible to clean 3 rooms for under $100 in the Fort Collins area. Why would you charge us $123.66? Please show pictures to prove that the living room carpet really needed to be replaced and how old were the carpets? The whole time we lived there, there had been worms in our apartment. Honestly, the office did send pest control to take care of it in the beginning. However, the worms kept coming back,  and we just dealt with it. With so many dead worms underneath the carpet, how long do you expect the carpet to last?  At this point, it's not even about the money, we feel like we were good tenants, always paying rent on time. It's just wrong for the landlord to mistreat people and try to overcharge people for everything. Regards,[redacted]

December 1, 2014 J[redacted]  [redacted]  [redacted]  [redacted] Dear Ms. [redacted], We are responding to the request through the Revdex.com. New Colony was your landlord from October 13, 2012 until July 25, 2014 and we believe that we treated you fairly.   Upon giving a notice to vacate you received a cleaning guide. You were only charged for items that were left dirty or damaged. I have included rceipts of the sub contractor costs that we incurred. Cleaning charges were only assessed if the cleaning was above and beyond normal wear and tear. We are providing these receipts so that you many understand that we are treating you fairly and that we have no further obligations and do not owe treble damages and wish to resolve this by payment that is due.
Please do not hesitate to contact us with any additional questions that you might have.
Sincerely, [redacted] New Colony/Manager
