In reviewing the matter, the member's last name was inadvertently changedWe are unsure at this time how that happened although human error is the likely causeWe have had no other reported incidents of this nature, so this is an isolated caseWe have reviewed the member's credit report and the
credit card she previously possessed is reporting correctly on her credit reportThere are no signs of identity theft that we could detectWhen the complaintant notified us originally of the problem we had immediately cancelled the card with the wrong nameWe Subsequently ordered her a new card with the correct name on March 24, We have contacted the member and spoke with them and they indicated they are satisfied with what has been done.Donald V.President

I went to check on my grandson's money in his account (he is an eight year old disabled boy of whom I have guardianship of legally) and saw that the account was frozen. I called the bank and talked to Tya from the Collections department and was told the account was frozen due to a non-payment on a credit card in my name. Said credit card no longer is open and I have a debt consolidator working to consolidate my debt. My disabled grandson's account has my name on it only as a representative since he is only eight years old. Tya was very rude and said since the credit card, that I no longer have, was through the same bank and both accounts have my name on them; they were holding his money to collect a payment. I informed Tya that I am currently working with a debt consolidator to lower my payments on all my debt, including my credit cards. Tya became verbally abusive to me, even saying that his money wouldn't be frozen if I could pay my bills. I hung up with her and called the branch manager who told me that she was not Tya's boss and couldn't take a formal complaint against her, but would try to figure out the situation and give me a call me back. In the mean time I called my debt consolidator and gave them Tya's number for their legal team to handle the holding of my disabled grandson's money. After and only after the legal team and consolidator talked to the bank and Tya was I told that my grandson's money would not be frozen but his debit card would be cancelled. Which means I know have to enter the bank personally to withdraw his money. Throughout the entire ordeal Tya was extremely rude and abusive with her language. I will be closing all accounts with New Cumberland Federal Credit Union as of this week due to the rudeness I encountered today.

Review: As a result of a non work injury, I was on medical leave for the summer, 5/19/2014 - 9/9/2014 to have a procedure done, i.e microdisectomy. Suffice to say, I fell 6 weeks behind in my car loan, totaling no more than $500.00. On 9/4/2014, after my vehicle was repossessed, I went to the credit union to discuss paying off the past due debt. And also explained to the collection's manager Kirby T[redacted], that my direct deposits will begin to start back up ASAP. Mr. Kirby T[redacted] disregarded what I said, and in fact decided to threatened me in front of co-worker, [redacted], and it was like, "IF I DO NOT HAVE MY SUPERVISOR CONTACT HIM BY 9/9/2014, TO VERIFY EMPLOYMENT STATUS, THAT HE WILL REPOSSESS MY VEHICLE AGAIN!" I assert that was a blatant violation of the Fair Debt Collections Practices Act.Desired Settlement: $400.00(repossession fees)and any adverse information put on my credit report, from Kirby T[redacted] removed.

Response:

11/10/2014Considering the adverse actions with my employer, then having a medical procedure performed in May 2014, my car loan payments were satisfied up to 7/9/2014. Collection's manager Kirby T[redacted] indicated that my account was delinquent as of 7/18/2014, but failed to convey that a payment was disbursed on 7/9/2014. And because of my financial hardship, I was unable to make the scheduled payment that resulted in my account being default. To avoid my vehicle from being repossessed, I contacted Jayme S[redacted], in collections, to see what my options are, and to arrange paying the past due balance. But to no avail. Despite the repossession, Kirby T[redacted], NCFCU collection's manager violated the Fair Debt Collections Practices Act on 9/4/2014 at 0930 in the presence of an employee, Dee. While trying to get my account resolved, Kirby summoned Dee to call my employer to verify my employment status. Supervisor did not answer. However, Kirby T[redacted], made a threatening statement to me, with Dee being present, he said "...if my supervisor do not contact him by 9/9/2014, he will REPO my vehicle again." According to FDCPA, collectors can't threaten to sue or file charges against you, garnish wages, TAKE PROPERTY, cause job loss, or ruin your credit when the collector cannot or does not intend to take action.
