I took possession of a custom home in March of 2016. Every year since possession, there has been a leak from the roof, into the attic, down into my walls and ceilings causing damage to our home. I have tried to claim via home builders warranty, but New Dawn initially stated that it wasn't covered as they deemed it Ice Damming. I believe the intent of the intent of excluding ice damming from warranty, is that is nature & out of the builders control. Since this happens consistently each spring - it is not a nature issue, it is a build problem.

In the end, I am unable to claim via warranty / insurance, New Dawn isn't stepping up to fix it & I have a leaky new home.

All homes which we build go through a variety of inspections starting with the original application for building permit. The building inspector does a plan check to ensure the plans conform to all building codes. Also, BC has a new home warranty program designed to ensure homeowners are protected from shoddy workmanship. Once the building inspector approves the plans and issues the building permit there are a number of times the inspector will inspect the construction of the home during the construction process. Once the home is completed the building inspector does a final inspection and if everything is completed as per building code the file is closed in their office.

We, the builder, are then responsible to provide warranty coverage and that is done through the Provincially legislated New Home Warranty program. In all of our attempts we have been unable to satisfy Mr. and he did send in a warranty request to New Home Warranty. They inspected his home and concluded that his issues were maintenance related rather than faulty construction. There were a number of items during the construction of his home that he wished to provide his own products. Based on our better building practice and building code restrictions we advised him not to but he went ahead and did his own thing on those items anyway even though they were against the building code requirements. He also made changes to the exterior of his home after construction was complete, which was in direct violation with the architectural controls of the neighbourhood, even though he was asked not to. He wanted lots of sun tunnels installed in his roof and I recommend he not do this due to the amount of snow and the possibility of ice damming, and some were on a low slope portion of his roof. He insisted and we installed them according to building code and manufacturer’s instructions.

His warranty claim in 2017 and again in 2020 was inspected and proved to be ice damming which is a maintenance issue.

Our service department has had many emails and phone calls from them as well as many site visits. He is not prepared to accept what we say or what the various inspectors tell him. We have tried many times to help him. He has stated to the inspectors that he does not want us back in their home.

I am rejecting this response because: saying that I am not prepared to accept their work and that this is a maintenance issue is incorrect. I have a house that leaks water every winter. End of story.

I have accommodated and documented many other code violations that I have fixed at my expense and in fact disengaged dealing with the home builder as they are unwilling to spend anymore time with my home. I have also totaled my personal spending on these violations.

New Dawn has built a house that leaks and says it is my responsibility for "maintenance" ie referring to the fact that I should be shoveling my roof to prevent ice damning? The roof is over 45 ft in the air, no person would every build a new house on a ski hill where the home builder would say "oh, you must shovel your new roof every day to prevent water from leaking into to your home"- that is craziness. A home builder shouldn't be allowed to wiggle out of contracts, claims or insurance dealings when they build a house that leaks water. They should gladly fix it in order to keep their reputation and brand in tact and simply: do the right thing.
